Online Competition Terms and Conditions Advantages Summer 2008/09
By entering any competitions in Advantages, entrants are taken to accept and agree to abide by these terms and conditions.
Information on how to enter and prizes form part of these terms and conditions.
The Promoter's decision regarding the draw, deciding winners and the conduct of each competition is final and cannot be contested. No correspondence shall be entered into.
Prizes must be taken as supplied and cannot be varied, extended, exchanged, transferred or redeemed for cash. Any additional products or services not included in a prize will need to be arranged and paid for by the winner. If the stated prizes are unavailable for any reason, the Promoter reserves the right to offer substitute prizes of equivalent value.
Only entries received through the Alinta website by the stated closure dates will be eligible.
Employees, relatives and agents of Alinta Sales Pty Ltd, Alinta Pty Limited, Alinta Assist and prize donors/suppliers are not eligible to enter.
The Promoter reserves the right to terminate any of these competitions early or vary any of these terms and conditions, subject to obtaining any necessary approval from the WA Gaming and Wagering Commission.
For all competitions, to be eligible to enter, you must [except where otherwise mentioned] be at least 18 years of age, a resident of Western Australia and a holder of a current Alinta account, which is not overdue by more than 5 days. Entry is limited to one entry per Alinta account holder per competition.
All competitions commence on 3rd November 2008 and close on 20th February 2009 at 5pm.
All competitions will be drawn or decided on 27th February 2009. Winners will be drawn electronically using random selection or decided [where judgingis required] on this date by the Promoter's staff at the Promoter's address [below]. Entrants need not be present to win.
For "Your Chance to Swim with the Dolphins", each prize is for 2 people and there are three prizes to be won. The prize activity is conducted by Rockingham Wild Encounters and their terms and conditions also apply. A child over 6 years of age can take part if their parent / guardian deems their swimming / water safety skills strong enough, but they must be accompanied by a person over 18 years of age.
All competition winners consent to the Promoter and/or Alinta Assist using their name, suburb and photograph for publicity purposes.
The Promoter will endeavour to notify competition winners by mail and/or telephone [using the contact details supplied with their entry], usually within two weeks of the relevant prize draw date. The Promoter accepts no responsibility if winners are not reasonably contactable. Unless otherwise indicated in these terms and conditions, prizes must be claimed within 30 days of the draw and, in the case of services, utilised within 12 months of the draw. Any unclaimed prizes remain the property of the Promoter/prize supplier.
Winners' names will be listed on the Alinta website as soon as reasonably practicable after each draw.
Winners accept all risks, responsibilities and restrictions associated with the acceptance and use of their prize by themselves and anyone else.
To the maximum extent permitted by law, neither the Promoter, Alinta Assist nor any of their respective related bodies corporate or their respective officers, employees, agents or contractors accepts or otherwise has any responsibility for any loss, damage, accident, death or injury resulting from or arising out of or in any way connected with any Advantages competitions, promotions or prizes, including, but not limited to, for any defect in or unsuitability of any goods or services supplied as prizes.
However, to the extent such liability cannot be excluded by law, it is to be limited to repairing or replacing the defective goods or services. Any queries or complaints regarding the use or operation of a prize [including, but not limited to, warranty claims] should be directed to the prize donor/supplier or manufacturer.
