Information on how to enter and prizes form part of the Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
Entry to the promotion is only open to residents of Australia aged 18 years or over, who subscribe to or renew their subscription to Australian Gourmet Traveller within the promotional period (for a minimum period of 12 months). Entry is subject to the correct use of a valid credit card or, if payment is made by cheque, the cheque must be cleared for payment by the closing date of the promotion. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
This offer is not valid in conjunction with any other offer. Only one entry is permitted per person per subscription. If the subscription is a gift, only the gift recipient (i.e. person receiving the subscription) will be entered into the prize draw.
By subscribing to this ACP Magazines Ltd magazine title entrants acknowledge that they understand that "tip ons" and gifts that may be available with non-subscriber copies may not be provided with subscriber copies, depending on the sole discretion of ACP Magazines Ltd.
Incomplete, indecipherable, inaudible or illegible entries will be deemed invalid.
Promotion commences 26.01.09. Entries close 22.02.09 at 11.59pm AEDST. The draw will take place at ACP Magazines Ltd, 54 Park Street, Sydney NSW 2000 on Monday 02.03.09 at 11.00am AEDST. The winner will be notified by mail and their name will be published in The Australian on Tuesday 10.03.09. Promoter’s decision is final and no correspondence will be entered into.
The first valid entry drawn from all entries received will win a holiday for two adults to Royal Davui Island Resort Fiji, valued at up to $11,016.45 depending on point of departure.
The prize package includes:
Two (2) return tickets to Fiji departing from winners nearest capital city and includes all Government surcharges, fees and taxes as at 27 November 2008, valued at up to $2,963. Any change in the value of the flights during the promotion is not the responsibility of the promoter. Travel insurance is not included in the prize, however is strongly recommended. The successful applicants release the Promoter from any and all causes of action, losses, liability, damage, expense (including legal expenses) cost or charge suffered, sustained or in any way incurred by the winner as a result of any loss or damage to any physical property of the winner, or any injury to or death of any person arising out of, or related to, or in any way connected with the Promoter or the promotion. Island launch transfers included.
Four (4) nights accommodation in a Private Vale with plunge pool including breakfast, lunch and dinner each day for two people, valued at $8,053.45. Transport to and from point of departure, taxes, additional meals, alcoholic beverages, spending money, optional excursions whilst on holiday, additional transfers, items of a personal nature, in-room charges and insurances will be the sole responsibility of the winner. Promotional prize cannot be combined with additional offer.
Prize must be taken between March 2009 and December 31 2009 and excludes the periods between February 20th – March 17th 2009 and 25th December – 31st December 2009.
Prize subject to both flight and accommodation availability.
Total prize pool value is up to $11,016.45. Prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be taken as cash.
The prize does not include any ancillary costs; these are at the prize-winners own expense. Prize excludes: meals, visas, passport costs, travel insurance, spending and other transport costs.
If for any reason a winner does not take an element of the prize at the time stipulated by the Promoter, then the prize or that element of the prize will be forfeited.
If the prize (or part of the prize) is unavailable, the Promoter, in its discretion reserves the right to substitute the prize (or part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion, subject to any written directions from a relevant regulatory authority.
A draw for the prize, should it remain unclaimed, may take place on 04.05.09 at 11am AEST at the same place as the original draw, subject to any directions from a regulatory authority. Winner’s names will be published in The Australian on 12.05.09.
Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) participation in the prize.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
All entries become the property of the Promoter. The collection, use and disclosure of personal information provided in connection with this competition is governed by the Privacy Notice (see Contents Page for location in this issue).
