TERMS & CONDITIONS FOR "LAST CHANCE HARVEY" PROMOTION

1. Information on how to enter forms part of the terms and conditions of entry. Entry into the promotion is deemed acceptance of these terms and conditions.

2. The Promoter is Mike Da Silva & Associates (Aust) Pty Ltd (ABN 50 003 894 022), of 15 Grosvenor Street, Neutral Bay NSW 2089 (tel 02 9953 9633). ("Promoter").

3. The promotion commences at 9am (AEST) on 17 February 2009 and concludes at 5pm (AEST) on 22 February 2009 ("Promotion Period").

4. Entry is open only to members of the Qantas Frequent Flyer program who are residents of New South Wales, Victoria, Queensland, South Australia or Western Australia ("Eligible Entrants"), excluding:
(a) officers, management and employees (and their immediate families) of the Promoter, Qantas Airways Limited and their respective related bodies corporate; and
(b) members whose Qantas Frequent Flyer account is suspended or terminated at any time prior to or during the Promotion Period.

5. To enter, Eligible Entrants must, during the Promotion Period:
(a) watch the movie trailer at www.qfpromo.com.au/lastchanceharvey "Promotion Site"); and
(b) when it has finished, submit their full name, state of residence, Qantas Frequent Flyer number, e-mail address and any other required details to the Promotion Site, together with an answer to the following:

6. Each Eligible Entrant is permitted only one entry only into this promotion.

7. The Promoter is not responsible for any problem or technical malfunction of any communications network or any late, lost, incorrectly submitted, delayed, ineligible, incomplete, corrupted or misdirected entry whether due to error, transmission interruption or otherwise.

8. The Promoter will appoint a panel of judges to judge entries based on the creativity and aptness of the answer submitted under paragraph 5(b). The judging will take place at the Promoter's premises at 15 Grosvenor Street, Neutral Bay NSW 2089 on 23 February 2009 at 10.30am (AEST).

9. There are 750 prizes, each consisting of a pass for two people to attend a selected preview screening of the movie "Last Chance Harvey" ("Movie Pass"). Based on the recommended retail value at the time of printing, the maximum value of each Movie Pass is A$31 and the maximum prize pool value is A$23,250. The Promoter accepts no responsibility for any variation in the value of any prize.

10. 150 prizes will be allocated to winners from each relevant state.

The Promoter will award, to each of the 150 best entries (as determined by the judges based on the criteria in paragraph 8):

(a) from all valid entries submitted by Eligible Entrants residing in New South Wales, a pass for two people to attend the following preview screening of the movie "Last Chance Harvey":

11. Each Movie Pass is only valid for the corresponding preview screening identified in paragraph 10. Movie Passes are not valid for any other times or at any other cinemas. The prize does not include any travel or transportation. All costs incurred prior, during and after the relevant preview screening are the sole responsibility of the winner.

12. The decision of the judges is final and no correspondence will be entered into. This promotion is a game of skill and chance plays no part in determining the winners.

13. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated. If a Movie Pass is not used on the date specified on that Movie Pass, it will be forfeited and no compensation will be payable to a winner. The Movie Passes are not exchangeable or redeemable for cash or other goods or services and cannot be transferred to any other person, unless agreed to by the Promoter. Winners may be asked to show their Qantas Frequent Flyer membership card upon presentation of their Movie Pass to gain entry to the relevant cinema as a proof of eligibility to enter this promotion. As a condition directed by the film's distributors, mobile phones and mobile cameras will not be allowed in the cinemas.

14. All winners will be notified by email that they are a winner within two business days of the judges’ decision and will be directed to a web site to download and print.

15. The Promoter, Qantas Airways Limited, their related bodies corporate, and their respective officers, employees, contractors and agents will not be liable for any loss, damage or personal injury whatsoever (including but not limited to direct, indirect and consequential loss) suffered or sustained in connection with this promotion, the promotion of this promotion or the use of any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

16. If for any reason the promotion is not capable of running as planned (including but not limited to) infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right (subject to any written directions given under applicable law) to disqualify any individual who tampers with the entry process and to cancel, terminate, modify or suspend the promotion.

17. Entry details remain the property of the Promoter. The name and photograph of each winner may be used for promotional purposes by the Promoter and Qantas Airways Limited, unless the winner otherwise notifies the Promoter at the time of accepting the prize. Entrants consent to the Promoter using personal information provided in connection with this promotion for the purposes of facilitating the conduct of the promotion and awarding any prizes.
