Terms and Conditions



By entering the "Quiksilver Pro VIP Experience" (the "Competition"), you are agreeing to the following terms and conditions (the "Terms and Conditions"):



1. STANDARD TERMS

1.1 Information on how to enter forms part of the terms of entry.



2. WHO CAN ENTER?

2.1 Subject to clause 2.2, entry is open to all residents of Australia.

2.2 Directors, management, employees and their immediate families of Yahoo!7 Pty Limited (the "Promoter"), UG Manufacturing Co Pty Limited (the "Sponsor"), m.Net Corporation Ltd, and their associated agencies and companies are not eligible to enter the Competition.



3. HOW TO ENTER

3.1 The Competition commences on Monday 19th January 2009 @ 00.01 (AEDT) and concludes on Sunday 22nd February 2009 at 23.59 (AEDT) (the "Competition Period").

3.2 In order to enter, entrants must:

(a) go online at http://au.docs.yahoo.com/quiksilverhomepageset/

(b) set Yahoo!7 as their home page; and

(c) register their details for the Competition including their name, email address and contact daytime telephone number (including STD area code).

3.3 All entrants in the Competition may only enter once during the Competition Period and may not use "scripting" for multiple entries (which will be deemed invalid and rejected by the Promoter in its sole discretion).

3.4 All entries must be received by Sunday 22nd February 2009 at 23.59 (AEDT). The time of entry will be the time at which the completed online entry is received by the Competition's online database. Entrants will be presented with a confirmation page once the completed online entry is submitted by the entrant.

3.5 All entrants under the age of 18 must obtain the prior permission of a parent or guardian over the age of 18 to enter.


4. PRIZES
4.1 There will be One (1) major prize winner (the "Major Prize Winner") and Five (5) minor prize winners (the "Minor Prize Winners") drawn from all entries received during the Competition Period (collectively, the "Winners").

4.2 The prizes consist of the following (the "Prizes"):

4.3 Total Prize value is $12,750.00 (including GST). Prize values are based upon the recommended retail prices and are correct as at 6th January 2009. The Promoter accepts no responsibility for any change in Prize value between now and the ultimate date on which the Prize is taken.

4.4 Unless expressly stated in these Terms and Conditions, all other expenses associated with the Major Prize become the responsibility of the Major Prize Winner. The Major Prize Winner (and their companion) is responsible for all expenses other than that specified, including but not limited to spending money, meals and drinks, incidentals, mini-bar, laundry, room service, telephone calls, activities, insurance, taxes (including departure taxes), energy surcharges, gratuities, services charges, travel insurance and all other ancillary costs. Travel insurance is the responsibility of the Major Prize Winner and their companion. The Promoter and the Sponsor are not liable for any costs incurred if the Major Prize Winner or their companion travels without insurance. A credit card imprint or cash deposit may be required from the Major Prize Winner at check-in to the hotel for all incidental charges.



4.5 The Major Prize Winner and their companion must travel on the same flight. Travel arrangements to and from the Major Prize Winner's nearest capital city airport (Sydney, Melbourne, Brisbane, Adelaide and Perth) do not form part of the Major Prize and are the responsibility of the Major Prize Winner.

4.6 The Major Prize is only valid for travel between Friday, 6th March 2009 and Sunday, 8th March 2009, unless the dates are changed by the Promoter. Flights and accommodation are subject to availability at the time of booking and cannot be exchanged for other destinations. Embargo restrictions apply during certain periods. All bookings will be undertaken by an agent nominated by the Promoter.

4.7 The accommodation type offered for the Major Prize must be taken in consecutive nights' stay. Where the accommodation type has not been specified, it will be provided as a twin share standard room.

4.8 In participating in the Prizes, the Winners (and their companions) agree to participate and co-operate as required in all editorial activities relating to the Competition, including but not limited to being interviewed and photographed. The Winners (and their companions) agree to grant the Promoter and Sponsor a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide and the Winners (and their companions) will not be entitled to any fee for such use. The Winners agree they will not sell or otherwise provide their story and/or photographs to any media or other organisation.

4.9 If the Major Prize Winner is under the age of 18 as at the date of the draw, an adult must accompany the Major Prize Winner in the participation of the Major Prize.

4.10 Prizes are not transferable and cannot be redeemed for cash. Winners should seek independent financial advice about any tax implications that may arise from the Prize winnings.

4.11 The Sponsor is solely responsible for all Prize fulfilment in respect of the Competition.


5. HOW TO WIN
5.1 Each entrant who has entered the Competition over the Competition Period in accordance with clause 3 of the Terms and Conditions will be entered into a random draw.

5.2 The draws will be conducted by m.Net Corporation Ltd at their offices on Level 2, 8 Leigh Street, Adelaide, South Australia 5000 on Monday 23rd February 2009 at 11.00am (AEDT).

5.3 The first entrant drawn from the pool of entrants will be the Major Prize Winner. The following five entrants drawn from the pool of entrants will be the Minor Prize Winners.

5.2 All Winners will be notified by a phone call on the day of the draw, and a letter advising the Winners of their prize will also be mailed. The details of the Winners will be published in the Public Notices section of The Australian newspaper on Monday 2nd March 2009.

5.3 The Promoter's decision is final and the Promoter will not enter into correspondence regarding the result.

5.4 It is a condition of accepting a Prize that the Winners must comply with all the conditions of use of the Prize and Prize supplier's requirements. To the extent of any inconsistency with these Terms and Conditions, the terms and conditions of the Prize supplier shall prevail.

5.5 It is a condition of accepting a Prize that the Winners (and any companions) may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.

5.6 Subject to state government legislation:

(a) if the Major Prize is not claimed by the Major Prize Winner by Monday, 2nd March 2009, a second draw will be conducted by m.Net Corporation Ltd at their offices on Level 2, 8 Leigh Street, Adelaide, South Australia 5000 on Tuesday, 3rd March 2009 at 11.00 AEST and the winner will be published in the Public Notices section of The Australian newspaper on Thursday 5th March 2009; and

(b) if any Minor Prize is not claimed by a Minor Prize Winner for a period of 3 months, a second draw will be conducted by m.Net Corporation Ltd at their offices on Level 2, 8 Leigh Street, Adelaide, South Australia 5000 on Monday 25th May 2009 at 11.00 AEST and the winner will be published in the Public Notices section of The Australian newspaper on Monday 1st June 2009.

5.7 In addition to any other rights, the Promoter reserves the right at its sole discretion to disqualify any entrant who tampers with the entry process or the operation of the Competition in a manner which the Promoter determines in its absolute discretion to be a violation of these Terms and Conditions.



6. NO LIABILITY

6.1 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter's ability to proceed with the Competition on the dates and in the manner described in these Terms and Conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Competition and recommence it from the start on the same conditions, subject to government legislation.

6.2 The Promoter, the Sponsor, m.Net Corporation Ltd and their affiliates, associated agencies and companies will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail.

6.3 The Promoter, the Sponsor, m.Net Corporation Ltd and their affiliates, associated agencies and companies will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may be suffered or brought by a Winner:

a) during the draw;

b) whilst undertaking any travel won on or connected with their entry into the draw;

c) in the participation in any Prize;

d) as a consequence of late, lost or misdirected mail;

e) due to the broadcast of any program relating to the Competition or the publication of any material, including any statements made by any staff member, journalist, other entrants or any other person; or

f) arising from or related to any problem or technical malfunction of any telephone network or lines or mobile communications network related to or resulting from participation in this promotion.

6.4 The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries, and reserves the right to take any action that may be available.

6.5 If, for any reason, this Competition is not capable of being conducted as planned, including, but not limited, due to tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this Competition, the Promoter reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the Competition, subject to state legislation.

7. General Conditions

7.1 This Competition is governed by the laws of New South Wales, Australia.

7.2 By entering, you release and hold harmless the Promoter, the Sponsor and their partners, subsidiaries, affiliates, directors, officers, employees, and agents from any and all liability for any injuries, loss or damage of any kind to persons, including death, or property damage resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any Prize, participation in this Competition, or while travelling to, preparing for, or participating in any Prize-related activity.

7.3 The Promoter reserves the right to alter the Terms and Conditions, withdraw any Prize from the Competition, substitute any component of the prize, or alter or cancel all or part of the Competition in its absolute discretion without notice, subject to state government legislation.

7.4 In the event of a dispute, the Promoter's decision is final and no correspondence will be entered into.



8. PROMOTER'S DETAILS

8.1 The Promoter is Yahoo!7 Pty Limited (ABN 60 089 187 100) of Level 2/Lot 2/Pier 8&9, 23 Hickson Rd, Millers Point NSW 2000.

8.2 The Sponsor is UG Manufacturing Co Pty Limited (ABN 63 005 047 941) of 27 Baines Crescent Torquay VIC 3228.

8.3 By entering this Competition you agree to the Promoter's use of your personal information as described on Yahoo!7's Privacy Policy http://privacy.yahoo.com/privacy/au. All entries become the property of the Promoter and your name may be included on a database. By entering this Competition you consent to the Promoter including your name in future mail, email, SMS or other campaigns. By entering this Competition you consent to the Promoter sharing your personal information with the Sponsor, and you acknowledge that the Sponsor is solely responsible for its use of that information.
