1. Information regarding how to enter and/or claim gifts or prizes form part of these Terms and Conditions. Submission of an entry and/or claim into
this promotion is deemed to be in acceptance of these Terms and Conditions. Entries or claims not completed in accordance with these Terms and
Conditions are ineligible.
2. Promotion is only open to permanent residents of Australia. Directors, management and employees (and their immediate families) of the Promoter,
participating retailers, agencies and companies associated with this promotion are ineligible to enter.
3. The Promoter reserves the right, at any time, to verify the validity of entries and/or claims (including a participant’s identity, age and place of
residence) and to disqualify any participant who submits an entry and/or claim that is not in accordance with these Terms and Conditions or who
tampers with the entry and/or claim process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those
rights. The Promoters’ decision is final and no correspondence will be entered into.
4. Incomplete, indecipherable or illegible entries will be deemed invalid.
5. The promotion commences at 12:01am AEDST on 01/02/09 and closes at 3.30pm AEDST on 28/02/09 (Promotional Period). To be a valid entry and/or claim,
all of the necessary information must be included with an entry and/or claim and must be received by the Promoter within 14 days of the Promotional
Period (14/03/09).
6. To be eligible to participate in the promotion, eligible participants must purchase any Westinghouse dishwasher product (Product) between 01/02/09
and 28/02/09 from a participating Westinghouse retailer and follow the steps below to redeem a gift with purchase and/or enter into the Finish
Westinghouse competition.
Redemption of Gift with Purchase
7. To redeem a gift with purchase, eligible participants must complete one of the below steps by 14/03/06:
(a) visit www.savebucketloads.com.au; (i) follow the prompts to the PDF form; (ii) download, print and complete the PDF form in full; (iii) tick the
‘redeem gift with purchase’ box on the form; and (iv) mail the completed form together with a copy of the Product purchase receipt to Finish
Westinghouse Promotion, PO Box 967 Brookvale NSW 2100. ; or
(b) complete an entry form provided in-store in full; (ii) tick the ‘redeem gift with purchase’ box; and (iii) mail the completed entry form together
with a copy of the Product purchase receipt to Finish Westinghouse Promotion, PO Box 967 Brookvale NSW 2100.
Finish Westinghouse Competition
8. To enter into the Finish Westinghouse Competition, eligible participants must:
(a) visit www.savebucketloads.com.au; (i) tick the game of skill box; (ii) complete the online entry form in full; (iii) answer the competition
question in 25 words or less; and (iv) follow the prompts to submit the entry online; or
(b) complete the entry form provided in store in full; (ii) answer the competition question in 25 word or less; and (iii) mail the completed entry
form to Finish Westinghouse Promotion, PO Box 967 Brookvale NSW 2100.
(c) All entrants must retain their proof of purchase for all entries in order to claim the major prize
9. The same entry form can be used for redemption of a gift with purchase and entry into the Finish Westinghouse competition provided that all of the
requirements listed at clauses 7 and 8 are completed. Online submission of entry into the Finish Westinghouse competition is only available where the
participant is not claiming a gift with purchase. When completing an entry form, eligible participants must provide all requested mandatory details,
including their first and last names, residential address, telephone number, current and valid email address and an answer to the question in the text
field provided. The maximum number of words able to be used to answer the competition question for each entry is 25.
10. At the Promoter’s request a participant must provide a copy of their purchase receipt(s) for all entries if they have not already done so for
redemption of a gift with purchase. Failure by the participant to provide such proof of purchase to the Promoter upon request may, in the sole
discretion of the Promoter, result in the corresponding entry/entries being invalidated and forfeiture of that entrant’s right to a prize.
11. Each entry submitted will be individually judged on the basis of originality and creativity as determined by the judges in their sole discretion.
The competition entries will be judged at Tactics Marketing, 4b/106 Old Pittwater Road, Brookvale NSW 2210 on 20/03/09 at 3pm AEDST. This is a game of
skill and chance plays no part in determining the winners. All eligible entries received will be judged by a panel of appropriately qualified judges.
12. The winners will be notified by 27/03/09 and the winning entries will be published in the Australian on 03/04/09. All reasonable steps to notify
the winners of the results of judging will be taken by the Promoter. The judges' decision is final and no correspondence will be entered into.
13. An entry is deemed to be received at the time of its receipt by the Promoter and NOT at the time of transmission by the entrant.
14. Multiple entries are permitted, subject to the following: (a) each entry submitted must be the entrant’s original work; (b) each entry
submitted must be substantially unique; and (c) each entry and/or claim must be submitted separately and in accordance with entry and/or
claim requirements. Only one entry and one claim per purchase of a Product is permitted.
15. Major Prizes: The four (4) best entries judged on creative merit will each receive a Westinghouse Kitchen appliance package valued at up to $5,000
(RRP). The winners are entitled to select products from the Westinghouse range to the value of $5,000. The prize includes delivery to one metro
location per winner and is valid for 12 months. Redemption of the prize is subject to any terms and conditions of the issuer including those specified
on the entry form(s). The total major prize pool is valued at $20,000 (RRP).
16. Gift with purchase: Each valid claim received during the promotional period will receive a Finish tablet starter pack valued at $31.56 (RRP). The
gift is not transferable, exchangeable or redeemable for cash.
17. Any additions, accessories or alterations to the prizes (including without limitation, installation of any element of a major prize or any costs
to do so) or any other ancillary costs not specifically included in these Terms and Conditions are the sole responsibility and cost of the prize
winner. Prizes are not transferable, exchangeable or redeemable for cash.
18. Any cost associated with accessing the promotional website is the participant’s responsibility and is dependent on the Internet service provider
used. The use of any automated entry software or any other mechanism or electronic means that allows an entrant to automatically enter repeatedly is
prohibited and will render all entries submitted by that participant invalid.
19. If a prize, or any part of a prize, is unavailable, the Promoter, in its absolute discretion, reserves the right to substitute the prize (or that
part of the prize) with an alternative prize to the equal value and/or specification, subject to any written directions from a regulatory
authority.
20. If the winner of a prize is under the age of 18 years at the closing date of the promotion, the prize may, at the absolute discretion of the
Promoter, be awarded to the winner’s parent or guardian.
21. If for any reason whatsoever a participant does not redeem a prize and/or gift by the time stipulated by the Promoter, then the prize and/or gift
will be forfeited by the participant and cash will not be awarded in lieu.
22. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the
reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify
any participant; and/or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as
appropriate.
23. Each work submitted as an entry or part of an entry (“Work”) becomes the property of the Promoter. Work(s) will not be returned to any entrant. As
a condition of entry, each entrant irrevocably grants to the Promoter a non-exclusive perpetual worldwide licence to use and exploit all intellectual
property rights (including without limitation, copyright) in and to the Work and consents to the Promoter doing (or omitting to do) any acts in
respect of the Work which may otherwise constitute an infringement of the entrant’s moral rights. For the avoidance of doubt, the Promoter may use all
or any part of an entrant’s Work(s) for any purposes at its discretion, including, without limitation, using the entrant’s Work(s) for promotional,
marketing or publicity purposes, whether in respect of this promotion, the Promoter, or otherwise. Each entrant warrants to the Promoter that the Work
submitted is an original literary work of the entrant which does not infringe any rights of any third party. A breach of the warranty set out in this
condition will result in the entrant’s entry being invalid. In addition, each entrant indemnifies the Promoter against all loss, damages and costs
incurred by the Promoter arising from that entrant’s breach of the warranty set out in this condition.
24. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability
(including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or
consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical
difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference;
(c) any entry or claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason
beyond the reasonable control of the Promoter; (d) any variation in prize/gift value to that stated in these Terms and Conditions; (e) any tax
liability incurred by a winner or participant; or (f) a prize/gift or use of a prize/gift.
25. The Promoter collects personal information in order to conduct the competition and may, for this purpose, disclose such information to third
parties, including, but not limited to, prize suppliers. Entry is conditional on providing this information. Unless a participant “opts out” at the
time of entry, the Promoter may also use the information for promotional, marketing and publicity purposes including sending electronic messages or
telephoning the participant. Participants should direct any request to access, update or correct information to the Promoter. All entries become the
property of the Promoter.
