Australian Open Tennis Competition Terms & Conditions
This competition is being conducted by Aviva Australia Holdings Limited ABN 38 095 045 784 of Level 6, 509 St. Kilda Road, Melbourne, Vic 3004
(‘Aviva’). Entry is free and is open to any resident of Australia who is 18 years of age, or older and who completes a valid entry form supplied by
Aviva either:
* at the Aviva marquee at the Australian Open 2009, Melbourne Park, Batman Avenue, Melbourne, Victoria; or
* online at www.avivaballkids.com.au
Employees of Aviva and their immediate families are not eligible to enter. Only one entry per person is permitted. Late, incomplete,
incorrect or illegible entry forms will not be accepted and are invalid. All determinations as to validity will be in Aviva’s sole discretion.
The competition commences at 10am on Monday, 29 December 2008 and closes at 5pm on Friday, 6 March 2009. The winner will be drawn on Friday, 13 March
2009 at 10.00am at Level 6, 509 St Kilda Road, Melbourne, Victoria through a barrel draw comprising both hard copy and printed electronic entry
forms. No less than three entries will be drawn. A representative of Tennis Australia will be present for the draw and will act as scrutineer. The
first valid entry drawn will be the winning entry and the entrant will be notified by mail and his or her name and state of residence will be
published in The Australian newspaper on Saturday, 21 March 2009. If the winner has not claimed the prize by 5pm on Monday, 6 April 2009 or his or her
entry is judged to be invalid, the prize will be forfeited and the second entry drawn will be the winning entry and the entrant notified by mail and
his or her name and state of residence advertised in The Australian newspaper on Saturday 11th April 2009. If the second winner has not claimed the
prize by 5pm on Monday, 20 April 2009 or his or her entry is judged to be invalid, the prize will be forfeited and the third entry drawn will be the
winning entry and the entrant notified by mail and his or her name and state of residence advertised in The Australian newspaper on Saturday, 25 April
2009. If the third winner has not claimed the prize by 5pm on Monday, 4 May 2009 or his or her entry is judged to be invalid, the prize will be
forfeited and the competition will be subject to a redraw and any subsequent winners notified by mail and their name and state of residence will be
published in The Australian newspaper as soon as practicable.
The winner will be determined by Aviva in its sole discretion. Aviva’s decision is final and no correspondence will be entered into.
The prize is valued at a maximum of A$24,000 and consists of the following:
* Two return economy airfares to London with Qantas Airways (departing from the winner’s nearest Australian capital city). The winner must confirm
preferred travel dates and names of travellers within 20 days of being notified by Aviva, however, flight dates are subject to availability.
* 3 nights accommodation in London at the Ibis Earls Court Hotel in a twin bedroom with daily English breakfast. Upgrades may be available at the
winner’s expense subject to availability. Accommodation is only valid from 3 July 2009 (check in) to 6 July 2009 (check out).
* Information Pack - Containing itinerary, event card, travel and hotel information.
* Membership to the Gatsby Club at Wimbledon for 2 days, including applicable VIP hospitality throughout the day. Membership is not available to
children under 18 years of age. Admission to the Wimbledon Lawn Tennis Museum.
* Two reserved seats for Wimbledon 2009 – Women’s Final & Men’s Final.
Further details of the prize will be notified to the winner. The Wimbledon 2009 Championships finals will take place on
3-5 July 2009. The prize package (excluding the Qantas flights) is only valid between those dates. Once the winner has notified Aviva
the names of those travelling, the prize is not transferable even if those named are unable to attend on the specified dates for any reason. Qantas
flights are also subject to applicable Qantas’ terms and conditions.
Unless otherwise stated, all other expenses, including spending money, meals, travel, transfers, insurance and all other ancillary costs are the
responsibility of the winner. Incidental charges charged to the winner’s room, such as meals, mini bar, laundry room services, telephone calls etc,
are at the expense of the winner. All passport and visa requirements are the responsibility and at the cost, of the winner. Aviva reserves the right
in its sole discretion to modify or cancel the prize (or any part of it) if any factor outside of Aviva’s reasonable control affects Aviva’s ability
to offer the prize (or any part of it) as contemplated in these terms and conditions.
Subject to any applicable laws or regulations, neither Aviva nor any of its related bodies corporate will be liable for any loss, damage or injury
whatsoever (whether direct, indirect or consequential) which is suffered or sustained in connection with the winner’s participation in this
competition and/or the redemption or use of the prize (or any part of it). The winner agrees to hold harmless Aviva and its related bodies corporate
from and against any claim, action, proceeding, judgement, damage, loss, expense or liability suffered by Aviva or its related bodies corporate in
connection with the winner’s participation in this competition and/or the redemption or use of the prize (or any part of it).
No part of this prize package is transferable, exchangeable, or redeemable for cash. The winner shall accept the prize “as is” and acknowledges that
Aviva accepts no responsibility for any variation in the value, or content, of the prize.
All entries become the sole property of Aviva. The answers completed on all entries (including entrants’ names and State of residence) will be entered
into a database and Aviva reserves the right to use and publicise those results.
If any part of these terms is unenforceable, invalid or illegal, such term (or part of it) shall be deemed severed from these terms and the remaining
terms will remain in full force and effect.
Entry into this competition shall be deemed to be an acknowledgment of these terms and conditions.
