Nick Jr.'s Roary the Racing Car and 2009 FORMULA 1 Australian Grand Prix Competition
Information on how to enter form part of these Conditions of the 'Roary Pack' Competition
The promoter is Nickelodeon Australia Pty Limited ABN 99 627 643 021, Foxtel HQ, 5 Thomas Holt Drive, North Ryde, NSW, 2113.
1. Employees and immediate families of Nickelodeon Australia and agencies associated with this promotion are ineligible to enter.
2. This competition is a game of skill and chance plays no part in determining the winner.
3. By entering this competition, each entrant agrees to be bound by these terms and conditions.
4. There is one method of entry for this competition.

� 1) To enter, entrants must log onto the Nick Jr. website (www.nickjr.com.au) and fill out information form and register. 2) If the entrant has previously registered their details they are only required to enter their NickName and Password in order to enter the competition. Entrants must also answer the question in 25 words or less: Who would be in your child's pit crew and why?
5. The 'Roary Pack' Competition commences from 16/02/2009 at 9.00am and entries close at 11.59pm 06/03/2009. Entries received after the closing date will not be eligible.
6. The competition will be judged between 9-11th March, 2009 at Nickelodeon offices, 5 Thomas Holt Drive, North Ryde, NSW, 2113.
7. There will be one major winner, who will receive a family holiday to the '2009 FORMULA 1TM ING Australian Grand Prix':
- Two (2) adults and two (2) childred (aged 12 and under) return economy class Qantas airfares from each winner's nearest capital city to Melbourne (excluding Victorian residents) (valued at $3,300.00) - four (4) nights' accommodation in a 3-star hotel including breakfast (to the value of $2500.00) - all travel related sales taxes and service tax (subject to availability and permissions); - tickets to the 2009 FORMULA 1TM ING Australian Grand Prix and seating in the Fangio Grandstand for four days for two (2) adults and two (2) children (aged 12 and under) (valued at $1076.00) - a special tour of Pit Lane for two (2) adults and two (2) children (aged 12 and under) (valued at $1,000.00) - VIP tickets to the Roary Pit Zone Party for two (2) adults and two (2) children (aged 12 and under) including Roary and Big Chris (valued at $800) - Merchandise pack including Roary Silver Hatch Race Track, RC Roary, a book pack, a Roary DVD (valued at $256.80) The total value of the major prize is up to the value of $8932.80
8. Ten (10) runners up will each receive a Mega Roary Pack including a Roary Silver Hatch Race Track valued at $129.95, RC Roary valued at $59.95, a book pack valued at $46.94 and a Roary DVD valued at $19.95.
The total value of each Mega Roary pack is $256.80.
9. Total prize pool valued up to RRP $15,000.80
10. Winners will be notified via phone, mail or email within five (5) working days of the draw date. Winners will also be published on the Nick Jr. website (www.nickjr.com.au).
11. If the winners of the Mega Roary Pack prizes do not claim their prizes within two (2) months of being notified, further judging of the remaining entries will be conducted. The drawn result is final and no correspondence will be entered into. Where possible the winners will be notified within five (5) working days and no more than seven (7) working days of the judges' decision. Winners will be notified by telephone or mail. Further judging of the remaining entries relate only to the Mega Roary Pack and not to the major prizes.
12. The major prize (point 7) must be taken on Thursday 26th March, 2009.
13. No responsibility will be taken for late or lost entries.
14. Multiple entries to this competition are permitted.
15. No component of the prize can be transferred or redeemed for cash. All prizes are subject to availability. The Promoter and AGPC accept no responsibility for any variation in the prize value.
16. Flights and accommodation are subject to availability at the time of booking. Additional spending money, meals, taxes, transport to and from departure point, additional transfers, insurance and all other ancillary costs are the responsibility of the winner. It is a condition of accepting the prize that all components of the prize must be taken during the trip and all persons taking the trip depart from and return to the winner's nearest capital city (excluding Victorian residents) at the same time unless otherwise agreed by the Promoter. All persons taking the trip sign a waiver of liability and an indemnity in a form determined by the Promoter and AGPC in their absolute discretion.
17. Frequent flyer points do not form part of this prize. If the winner is under the age of 18 years, the prize will be awarded to the winner's parent/guardian on their behalf.
18. The Judge's decision is final. No correspondence will be entered into.
19. All entries become the property of the promoter and may be used for promotional purposes. By entering the competition, each entrant consents to their personal information being entered on to a database.
20. Entrants agree that each of the Promoter and the AGPC may use the personal information they provide for any purposes associated with this competition, including notifying winners, and for any future marketing purposes without any further reference, payment or other compensation to the entrant, including sending the entrant electronic messages such as SMS and email and telephoning the entrant for an indefinite period. If the information requested is not provided, you may not participate in the competition. Unless otherwise advised, the winner also consents to AGPC using the winner's name, photograph and likeness in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the winner. All personal information collected by AGPC will be dealt with by AGPC in accordance with the Information Privacy Act 2000 (Vic) and AGPC's privacy policy. All details of the entrants will be used and preserved in accordance with the relevant State's Privacy legislation. A request to access, update or correct any personal information held by AGPC, or to access AGPC's privacy policy, should be directed to AGPC by contacting AGPC at 220 Albert Road, South Melbourne, Victoria 3205.
21. If there is any event that prevents or hinders the Promoter's conduct of this competition or the Promoter's or AGPC's ability to deliver the prize(s) to the winner(s) of this competition, the Promoter may, at its absolute discretion, offer another prize of similar value to the winner or cancel this competition and recommence it at another time under the same conditions or select another winner.
22. Neither the Promoter nor AGPC shall be liable for any loss or damage whatsoever (including but not limited to indirect or consequential loss, including loss of profits or loss of earnings) or personal injury suffered or sustained arising from or in connection with the competition, any omission to enter a person into the draw, acceptance of the prize or the prize itself, except for liability which cannot be excluded by law. Both the Promoter and AGPC accept no responsibility in the event that the Event is cancelled, or the Event dates are re-scheduled for any reason beyond the control of AGPC. By entering this Promotion, each entrant who wins a prize that includes entry to the 2009 FORMULA 1� ING Australian Grand Prix, and any other person who shares the prize with the winning entrant (Winning Entrant) (whom the Winning Entrant must make aware of these Conditions), must comply with the Conditions of Entry and Conditions of Sale to the 2009 FORMULA 1� ING Australian Grand Prix (posted at the entry to the Grand Prix circuit and also available at www.grandprix.com.au or by calling AGPC on 03 9258 7100) and reproduced below.
ENTRANTS ARE REMINDED AND AGREE, ACCEPT AND ACKNOWLEDGE THAT MOTOR RACING, THE EVENT AND CERTAIN ACTIVITIES ASSOCIATED THEREWITH (INCLUDING, WITHOUT LIMITATION, PARTICIPATION IN THE PRIZE) ARE DANGEROUS AND ACCIDENTS CAN HAPPEN.
Entrants are warned that there is a possibility of an accident causing injury, death or property damage or loss and attendance at the Event and participation in the prize is at entrants' own risk. Entrants acknowledge that the risks associated with attending the Event and participating in the prize include but are not limited to the risk of suffering harm as a result of cars (or parts of them) colliding with other cars, persons or property. Entrants acknowledge that entry to and remaining at the Event and participating in the prize has a degree of danger and, to the extent permitted by law (in particular sections 32J and 32JA of the Fair Trading Act 1999 (Vic) and section 74 of the Trade Practices Act 1974 (Cth)), hereby exclude, release and forever discharge the Promoter, AGPC the Crown in right of the State of Victoria, the Minister administering the Australian Grands Prix Act 1994 (Vic), the Minister administering the Crown Land (Reserves) Act 1978 (Vic), F�d�ration Internationale de l'Automobile, Formula One Administration Limited, Formula One Management Limited, Confederation of Australian Motor Sport Limited, Parks Victoria, the State Sports Centres Trust, Kellogg Brown & Root Pty Ltd, Event sponsors and all other persons involved in the organisation, conduct and promotion of the Event or the prize (Associated Entities) from all liability for claims, loss, damage, costs or expenses arising from any personal injury or death (whether arising from negligence (but excluding gross negligence) or otherwise), arising from or connected with participation in Recreational Services (as defined below) at the Event (including the prize) including but not limited to: any technical difficulties or equipment malfunction (whether or not under the Promoter's or AGPC's control); any theft, unauthorised access or third party interference; any entry or prize claim that is late, lost, altered, damaged or misdirected due to any reason beyond the reasonable control of the Promoter or AGPC; any variation in prize value to that stated in these Conditions; or any tax liability incurred by a winner or entrant. Each Winning Entrant must, on request of AGPC, execute any and all documentation (if any) necessary to give effect to this clause.
To the extent permitted by law (in particular sections 32J and 32JA of the Fair Trading Act 1999 (Vic) and section 74 of the Trade Practices Act 1974 (Cth)), entrants acknowledge that, to the extent to which they participate at the Event in:
- a sporting activity or similar leisure time pursuit; or - an activity that: - involves a significant degree of physical exertion or physical risk; and - is undertaken for the purposes of recreation, enjoyment or leisure, (Recreational Services), including, without limitation, participation in the prize, the Associated Entities do not make any warranty that the Recreational Services at the Event, including the prize, will be provided with due care and skill or that any materials provided in connection with the Recreational Services, including the prize, will be fit for the purposes for which they are supplied. Entrants acknowledge that, to the extent that any warranty is implied it is excluded to the full extent permitted by law.
WARNING: If you participate in these activities your rights to sue the supplier under the Fair Trading Act 1999 if you are killed or injured because the activities were not supplied with due care and skill or were not reasonably fit for their purpose, are excluded, restricted or modified in the way set out in this notice.
NOTE: The change to your rights as set out in this notice, does not apply if your death or injury is due to gross negligence on the supplier's part. 'Gross negligence' is defined in the Fair Trading (Recreational Services) Regulations 2004. For the purpose of this Condition 21 'the supplier' shall mean and include the Associated Entities. Without limiting any other release or limitation of liability contained in the Conditions, the Associated Entities will not be liable for any indirect or consequential loss suffered by any Entrant caused by any acts or omissions of the Associated Entities, their directors, employees, agents and contractors arising out of or in relation to the Event or the prize. Nothing in this Condition 21 or these Conditions generally affects your rights under the Trade Practices Act 1974 (Cth), Fair Trading Act 1999 (Vic) or similar legislation regarding implied conditions and warranties to the extent that such implied conditions and warranties cannot be excluded by law.
