2009 Dark Room Voting Competition Terms & Conditions

The Promoters of this competition are The Herald & Weekly Times Pty Limited (ABN: 49 004 113 937) of 40 City Road, Southbank VIC 3006 (HWT) and the Melbourne Fashion Festival Limited Pty Ltd (ABN 93 074 236 294) of Level 1, 175 Flinders Lane, Melbourne VIC 3000 (MFF).

Entry is open to residents of Victoria ONLY.

Instructions on how to enter and all prize details form part of the conditions of entry. By entering, entrants accept these conditions. The Promoters' decision is final and no correspondence will be entered into.

To enter the competition entrants must vote for their favourite photograph in the 2009 Dark Room Competition on www.heraldsun.com.au and enter their details.

Competition opens on Monday March 2, 2009 and closes at midnight on March 6, 2009 (Competition Period).

The judge's decision is final and no discussion will be entered into.

The promoter does not accept responsibility for any late, lost, damaged or misdirected entries.

The winner will be notified by phone and mail. Their name and postcode of residence will also be published in the Herald Sun Public Notices on Friday March 6, 2009.

The first entry randomly selected will win a Sony Cyber-shot T Series digital camera valued at $429.

The Promoters reserve the right to verify the validity of entries and to disqualify any entrant who tampers with or benefits from tampering with the entry process or the operation of the competition or who submits an entry which is not in accordance with these Terms and Conditions. Incomplete or incomprehensible entries will be deemed invalid and will not be included in the draw.

The Promoters accept no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise.

The Promoters have no control over the Internet, networks or lines and accept no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. The Promoters are not liable for any consequences of user error including (without limitation) costs incurred.

The prize is strictly as stated above. The prize is not exchangeable or transferable and cannot be taken as cash. Where a prize is unavailable for any reason, the Promoters may substitute for that prize another item of equal or higher value as determined by the Promoters.

To the full extent permitted by the law, the Promoters will not be liable for any loss (including, but not limited to, direct, indirect, special or consequential loss or damage, loss of opportunity, revenue or profit), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence) arising directly or indirectly out of or in connection with this promotion or from accepting or using the prize.
