TOURISM NSW SOUTH COAST PROMOTION
TERMS AND CONDITIONS

By entering “The Sunday Telegraph / Sunday Herald Sun Tourism NSW South Coast Promotion”, you are agreeing to the following terms and conditions:

1.STANDARD TERMS

1.1 Information on how to enter forms part of the terms of entry.

2. WHO CAN ENTER?

2.1 Subject to clauses 2.2 and 2.3 entry is open to all residents of NSW and VIC.

2.2 Employees and their immediate families of Nationwide News Pty Ltd and Herald Weekly Times Pty Ltd, Dialect Interactive, Tourism NSW and their associated agencies and companies are not eligible to enter. Immediate family means any of the following: spouse, ex‐spouse, de‐facto spouse, child or step‐child (whether by natural or by adoption), parent, step‐parent, grandparent, step‐grandparent, uncle, aunt, niece, nephew, brother, sister, step‐brother, step‐sister or first cousin.

2.3 If the winner is under the age of 18 years old they must be accompanied by an adult.

3.HOW TO ENTER

3.1 The competition commences on Sunday 8 March 2009 at 00:01 (AEST) and concludes on Saturday 14 March 2009 at 23:59 (AEST) (“the Competition Period”).

3.2 In order to enter the competition entrants must locate the Tourism NSW South Coast promotional link on www.sundaytelegraph.com.au (NSW residents) or www.sundayheraldsun.com.au (VIC residents) and answer in 25 words or less why they need a break to the South Coast. Entrants must supply their full name, address, state and daytime telephone number.

3.3 Entrants (including winners) in the competition may enter only once. SMS entries via the internet or computer generation are invalid and will not be accepted.

3.4 Only one (1) entry permitted per person. 1 x prize will be awarded per person.
3.5 Entrants under the age of 18 years must obtain the prior permission of a parent or guardian over the age of 18 years before entering the competition.
4.PRIZES

4.1 There are five prize packages on offer. One prize will be awarded per person. There are five prize winners.
Prize package 1, The Silos 7 Night Dream Escape:

Total prize pool is valued at $10,200

4.1 The prizes are subject to availability and are valid until 30 November 2009. Validity of the prizes cannot be extended. Prizes are not valid for redemption during public or school holiday periods.

4.2 The prize winners will be requested to provide at least 6 weeks notice of intent to travel. All components of the prize are subject to availability at the time of booking. Once accommodation is booked and confirmed it is non‐changeable.

4.3 All components of the prizes must be taken together.
4.4 Spending money, meals, insurance, transport, items of a personal nature, in‐room charges and all other ancillary costs are not included unless otherwise stated as part of each prize package.

4.5 A credit card imprint or cash deposit may be required from the winner at check in to the hotel for all incidental charges.
4.6 In the event that the winner is under 18 years of age, the winner must be accompanied by an adult aged 21 years and over.

4.7 The prizes cannot be transferred and cannot be redeemed for cash.

4.8 The winners must, on request by the Promoters, be able to provide evidence which, to the reasonable satisfaction of the Promoters, demonstrates that the winners are an eligible entrant (as per clause 2.1, 2.2 and 2.3) has complied with these Terms and Conditions.

4.9 The prizes must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated. If a winner is unable to satisfy these terms and conditions or a prize is not utilised or able to be taken within the specified timeframe, the prize will be forfeited by the winner and cash will not be awarded in lieu.

4.10 The prize is not transferable, exchangeable or redeemable for cash. In the event that any prize item is unavailable, the Promoters reserve the right to substitute a prize or item of equal or greater value. Any taxes (other than GST, if any) which may be payable as a consequence of a winner receiving the prize are the sole responsibility of the winner.

4.11 In participating in the prizes, the winners agree to participate and co‐operate as required in all editorial activities relating to the promotion, including but not limited to being interviewed and photographed. The winners grant the Promoter a perpetual and non‐exclusive licence to use such footage and photographs in all media worldwide and the winners will not be entitled to any fee for such use.

4.12 The winners agree that they will not sell or otherwise provide their story and/or photographs to any media or other organisation.

5. HOW TO WIN

5.1 Each entrant who has entered the competition over the Competition Period and registered all details in accordance with clause 3 will be entered into the prize draws. All draws will take place at News Limited, 2 Holt Street, Surry Hills NSW 2010 on Monday 16 March 2009 at 12:00pm (AEST).

5.2 The winners will be notified by phone call within 3 days of the draw and their name published in the Public Notices section of The Sunday Telegraph and Sunday Herald Sun on Sunday 22 March 2009.

5.3 The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the result.

5.4 It is a condition of accepting the prize that the winners may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.

5.5 Subject to any written directions given under regulation 37 of the Lottery and Gaming Regulation 1993 (SA), an unclaimed prize draw will take place at News Limited, 2 Holt Street, Surry Hills NSW 2010 on Monday 13 April 2009 and winners will be published in the Public Notices section of The Sunday Telegraph and Sunday Herald Sun on Sunday 19 April 2009.

6.NO LIABILITY

6.1 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoters’ ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoters may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to State Legislation.

6.2 Nationwide News Pty Ltd, Herald and Weekly Times, Tourism NSW and their associated agencies and companies will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected entries.

6.3 Nationwide News Pty Ltd, Herald and Weekly Times, Tourism NSW and their associated agencies and companies will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur:

6.3.1 during the draw;

6.3.2 as a consequence of late, lost or misdirected entries;

6.3.3 due to the broadcast of any program relating to the competition or the publication of any material, including any statements made by any compere, staff member, journalist, other entrants or any other person;

6.3.4 in relation to failure of an SMS entry message to be received by the Promoter on account of technical problems or traffic congestion;

6.3.5 arising from or related to any problem or technical malfunction of any telephone network or lines or mobile communications network related to or resulting from participation in this promotion;

6.3.6 due to circumstances outside the Promoters’ reasonable control.

6.4 Nationwide News Pty Ltd, Herald and Weekly Times, Tourism NSW and their affiliates assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of, entries, and reserves the right to take any action that may be available

6.5 If, for any reason, this competition is not capable of being conducted as planned, including, but not limited, due to tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoters which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to State Legislation.

7.2 Nationwide News Pty Ltd and The Herald and Weekly Times (publisher of this newspaper) collect your information to include you in this competition and will disclose the information to others who help us run the competition. The winning entry will be as per paragraph 5 above. We may also use the information to assist us in improving our goods and services and to contact you in the future in regard to our other goods and services. We may share your information with other persons or entities who assist us in performing the above or with another company which provides prizes for the competition or reader offer. Nationwide News Pty Ltd and The Herald and Weekly Times are part of a global media and entertainment company which, in Australia, publishes newspapers, magazines and distributes movies (among other things).
