Terms & Conditions
To enter, individuals must make a purchase at Sydney’s Paddy’s Markets Haymarket or Flemington during the promotion period being from 1000HRS Thursday
29/01/2009 finishing 1600hrs on Sunday 15/02/2009.
When making a purchase, individuals will receive an entry card which must be completed in full and individuals must submit the completed entry card
into the promotional entry boxes located in the Market Office at both Paddy’s Haymarket and Flemington.
Multiple entries permitted, subject to the following: only one (1) entry permitted per purchase.
Only Sydney’s Paddy’s Markets issued entry cards will be considered to be eligible for the prize draw. No photocopies/scans of the Sydney’s Paddy’s
Markets entry cards will be considered eligible for entry.
Individuals must be 18 years or older to be eligible for the prize draw.
Individuals must be an Australian resident.
Prize draw will be conducted from all entries received by the closing promotional period (1600HRS 15/02/2009) and will be undertaken at 11:00AM AEST
17 February 2009 at Sydney Markets Limited located at level 3, Sydney Markets Plaza, Parramatta Rd, Flemington 2140. The first four (4) correctly
completed entry cards drawn will be deemed the “Provisional winners” and will be notified by telephone, email, mail as well as have their names
published in The Australian on Friday February 20, 2009. The promoter will draw additional entries and record them in the order drawn as ‘reserves’.
If after three (3) months a winner is unable to be contacted to claim the prize, or if the entry is incomplete or incorrect the promoter will proceed
to notify the first drawn ‘provisional’ winner as a winner. A declared winner is one that is successfully contacted and meets the criteria as set out
in these terms and conditions.
Each prize consists of two (2) adults to one (1) of four (3) destinations beings either Bali, Phuket or Vietnam .Prize includes return economy
airfares from Sydney to the destination, five (5) nights twin share accommodation at a four (4) star hotel and return airport transfers.
Spending money, meals, taxes, insurance, departure taxes, passports, visas, vaccinations, transport to and from departure point, additional transfers,
items of a personal nature, in-room charges and all other ancillary costs are not included. The winner (and his/her companion) is responsible for
ensuring that they have valid passports, and any requisite visas, vaccinations and travel documentation.
The Prize travel must be completed by 30/03/2010. The winner (and his/her companion) must depart from and return to Sydney and travel together. The
itinerary is to be determined by the Promoter. Frequent flyer points will not form part of the prize. The prize is subject to the terms and conditions
of the participating airline, the hotel and any other prize suppliers. Winner may be required to present credit card at time of accommodation check
in.
Travel blackout periods. Prize travel cannot occur between the following blackout periods:
9 April 2009 through to 28 April 2009
11 July 2009 through to 27 July 2009
3 October through to 19 October 2009
19 December 2009 through to 17 January 2010
GENERAL
Information on how to enter and prizes form part of these Terms & Conditions. By participating, entrants agree to be bound by these Terms &
Conditions. Entries must comply with these Terms & Conditions to be valid. Participation in this promotion is deemed acceptance of these Terms and
Conditions.
Employees and their immediate families of the Promoter and its agencies associated with this promotion are ineligible to enter. Immediate family
means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent,
grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash. The Promoter’s decision is final and
binding - no correspondence will be entered into. The Promoter accepts no responsibility for late, lost or misdirected entries. Entries will be
deemed void if incomplete, indecipherable, illegible, illegitimate, forged, manipulated or tampered with in any way.If for any reason a winner does
not take the prize or an element of the prize within the time stipulated by the Promoter, then the prize or that element of the prize will not be
redeemable for cash.
Subject to the terms and conditions of the participating prize providers, if for any reason a winner does not, once the prize has been booked, take
the prize or an element of the prize at the time it has been booked for the travel to occur, then the prize or that element of the prize will be
forfeited and will not be redeemable for cash.
In the event that any prize becomes unavailable for reasons beyond the Promoter’s control, the Promoter may substitute a prize of equal or greater
value, subject to any written directions from the relevant New South Wales regulatory authorities.
In the event of war, terrorism, state of emergency or disaster,the Promoter reserves the right to cancel, terminate, modify or suspend the promotion,
subject to any written directions from the relevant regulatory authority.
Subject to the unclaimed prize draw clauses, if for any reason a winner does not take the prize or an element of the prize within the time stipulated
by the Promoter, then the prize or that element of the prize will be forfeited.
Total prize value is $18,000.00 made up of four (4) trips for two (2) adults to the value of $4500.00.
The Promoter reserves the right to request verification of age, identity, residential address of winners and any other information relevant to entry
into or participation in this promotion. Verification is at the discretion of the Promoter, whose decision is final. The Promoter reserves the right
to disqualify any individual who is involved in any way in interfering or tampering with the conduct of this promotion. Errors and omissions will be
accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those
rights.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the
entrant.
The Promoter (including its officers, employees and agents) shall not be liable for any loss, damage or injury suffered (even if caused by negligence)
where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any
theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or
not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that
stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant.
Before any prize is awarded, the winner and any other person sharing the prize with the winner may be required to sign an agreement to release the
Promoter and/or prize suppliers from and indemnify the Promoter against any liability arising from the use or participation in the prize.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable
control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any
entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
The Promoter assumes no responsibility for any failure to receive an entry or for inaccurate information or for any loss, damage or injury as a result
of technical, transportation issues or problems, including security breaches.
Entrants consent to the Promoter using their name, likeness, image and/or voice in the event that they are a winner in any media for an unlimited
period of time without remuneration for the purpose of promoting this promotion (including any outcome) and/or promoting any products supplied by the
Promoter.
Details from entries will be collected and used for the purpose of conducting this promotion (which may include disclosure to third parties, including
but not limited to local lottery authorities, for the purpose of processing and conducting the promotion) and for promotional purposes surrounding
this promotion. By entering this promotion entrants consent to the use of their information as described and agree that the Promoter may use this
information, or disclose it to other organisations that may use it, in any media for future promotional, marketing and publicity purposes without any
further reference or payment to the entrant. All entries become the property of the Promoter.
