4. Entry is open to all permanent residents of Australia, who (i) have the MOVIE NETWORK Channels as part of their subscription television package on FOXTEL, AUSTAR, OPTUS Television, Neighborhood Cable, Telstra, Telstra Countrywide (a �Subscriber�
; (ii) are a member of a subscription household and (ii) are not (a) employees
of, or contractors to, the Promoter or its related companies, or the Promoter�s distributors, external auditors and subscription television
service providers FOXTEL, AUSTAR, OPTUS Television, SELECTV, Neighborhood Cable, Telstra, Telstra Countrywide, including Beinteractive and their
associated agencies and companies or (b) members of the immediate family of such employees and contractors. "Immediate family" means spouse, defacto
spouse, parent, natural or adopted child, and sibling (whether natural, or adopted by a parent), whether or not they live in the same household as the
employee/contractor (each an �Eligible Person�.5. For the purpose of this promotion, a Participant is considered a person who actively participates in the promotion by physically submitting an entry or entries in the promotion using one of the entry mechanics listed in Clause 6.
6. In order to be deemed a Valid Participant and be eligible to win a prize in the Mad Men Watch and Win Promotion, viewers will be required to watch MOVIE ONE or MOVIE TWO during the promotional period when a competition spot will be aired. Entrants can enter online, red button or via SMS. To enter online, entrants must log onto www.movieone.com.au and register their details and advertised code word. To enter the competition via red button; subscribers are able to enter the competition simply by submitting their details and advertised code word via pressing the red button on their remote control. To enter the competition via SMS, subscribers are able to enter the competition by sending an SMS containing their details and the advertised code word to 1998 8899. Entrants will be required to supply all their details as instructed which could include their name, address, postcode, telephone phone number, age, gender and advertised code word in order for their entry to be valid. The prize is associated with each episode and the codeword for that prize will be shown after the screenings of that episode as listed in Clause 3.
7. If a person is unable to submit their own entry or entries in the promotion due to physical disability or technical difficulties, they must notify the promoter in writing addressed to Mad Men Watch and Win Promotion, PO Box 107, St Leonards, NSW 2065 prior to the draw date and nominate another individual to submit the entries on their behalf. If notification is not received, and it is determined that an entrant did not submit their own entries in the competition their entries may be deemed invalid and ineligible.
8. Incomplete entries will be deemed invalid and ineligible.
9. If the Promoter becomes aware of any Participant who supplies false or misleading information for registration or entry in the Promotion including under:
- an address which is not their permanent residence;
- an identity which is not their correct legal identity;
- a false claim that they are a member of a Subscriber household;
- multiple, differing email addresses
the entries awarded to that Participant will be cancelled and if they have received prizes, they will be recoverable by the Promoter on demand. The Promoter reserves the right to ask for any supporting documentation or evidence in order to determine the above. The Participant will not have any claim against the Promoter.
10. Maximum SMS entry cost is $0.55 inc GST, regardless of whether or not the entry complies with the terms and conditions of the Promotion. SMS entries via the internet or computer generation are invalid and will not be accepted or included in the prize draw. The Promoter accepts no responsibility for any SMS messages or red button entries not received by the Promoter or delays in the delivery of the SMS message or red button entry due to technical disruptions, network congestion or for any other reason
11. Each valid entry entitles the Participant to one (1) entry into the prize draw.
12. Any subscriber household that has been awarded a major prize from any MOVIE NETWORK CHANNELS Promotion in the last 12 months is ineligible to win a prize in this competition. Any person who is a member of such subscriber household at the time of this promotion is ineligible to win. A major prize is considered to be any prize with a total value of over $100.
13. A Maximum of five (5) web entries per person per day will be permitted. There is no limit for the number of SMS entries or Red Button entries permitted each day, per person.
14. All valid entries will be included in the draw which will take place at Beinteractive, Level 9, 155 George Street Sydney NSW 2000 on the dates set out in Clause 3.
15. Judges� decision is final and no correspondence will be entered into. Prizes cannot be transferred for other goods and services. Prizes cannot be redeemed for cash.
16. If any winner is under the age of 18 years the prize will be awarded to their parent or legal guardian, at the discretion of the Promoter.
17. The Promoter reserves the right to request the winner to provide proof of identity, proof of valid subscription to their service provider at their residential address, proof of residency at the nominated prize delivery address, and/or proof of entry validity. Proof of identification, residency, subscription, and entry considered suitable for verification is at the discretion of the Promoter. Prizes will only be awarded to the account holder of the entry mechanism used to submit their entry (ie mobile phone account holder). The winner will therefore be, in each case, the account holder.
18. Prize winners are advised that Tax implications may arise from their prize winnings and they should seek independent financial advice prior to the acceptance of the prize.
19. The Promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the Promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
20. If for any reason this Promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to State Regulation.
21. The Promoter is not liable for the cancellation of all or any part of the prizes (�Prizes�
, the Promoter reserves the right to change the Prizes at any time if the Prize
or a component of the Prize becomes unavailable. The Promoter is not liable for the repair or replacement of Prizes, or components of Prizes which
are defective, except for liability which cannot be excluded by law. In the case of South Australia, this condition is subject to the relevant South
Australian legislation.22. All winners will be notified by mail and will have their details published in the Public Notices section of The Australian newspaper on 6 February 2009 (Episode 5, 6 winners), 20 February 2009 (Episode 7, 8 winners), 6 March 2009 (Episode 9, 10 winners) 27 March 2009 (Episode 11, 12 winners), 3 April 2009 (major winner).
23. Prize values are the recommended retail value as provided by the supplier and are correct at time of printing. All prize values are in Australian dollars.
24. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to direct or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s, except for any liability which cannot be excluded by law.
25. The Promoter and its agencies and companies associated with this Promotion will take no responsibility for prizes damaged in transit. Once prizes have left the Promoter's premises, the Promoter will not be responsible for any delay in delivery, or failure of safe delivery of prizes.
26. Should a Participant�s contact details change or their pay television provider changes during the Promotional period, it is the Participant�s responsibility to notify the Promoter.
27. By accepting the Terms and Conditions and entering the Promotion, the Participant consents to the Promoter retaining and using the Participant�s Information for the purposes of promoting and marketing the Promoter. All winning entries will be entered into a database and the Promoter may use the winners' names, addresses and telephone numbers for future promotional, marketing and publicity purposes in any media worldwide without notice and without any fee being paid unless otherwise advised by the entrant.
28. There will be 9 prizes awarded for the competition. 1 x Major prize and 8 x runner-up prizes.
29. Major Prize: There will be one major prize awarded for the competition. The major prize will be a trip for 2 adults to New York for 5 nights. The prize includes return economy airfares from the winner�s nearest state capital city to New York (based on ex Perth), return private airport/hotel transfers, 5 night�s accommodation at the 5 star Morgan�s Hotel on Madison Avenue in a standard room including taxes and daily continental breakfast for 2 people and $1,000 AUD cash spending money. The major prize is valued at a maximum of $14,500.
30. Runner-up Prizes: 8 x weekly runner-up winners will each receive $500 cash in the form of a cheque. The runner-up prize pool is valued at a total of $4,000.
31. The total maximum value of the prize pool is AUD$18,500. All values are correct at the time of printing.
32. The major winner (and their companions) are responsible for all other expenses including additional spending money, meals, drinks, transfers (unless specified), laundry charges, activities (unless specified), incidentals, taxes (including departure taxes), energy surcharges, gratuities, services charges, passports, visas, travel insurance and all other ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances.
33. The major winner and travelling companions must travel at the same time, must depart from the same capital city and are responsible for transport from their residence to their nearest capital city for flight departure.
34. Government taxes are an additional cost to the winners and their travelling companions and are required prior to ticketing.
35. If the winner is under the age of 18 as at the date of the draw, an adult must accompany the minor in the participation of the prize.
36. The prize must be taken by 20 March 2010 and is subject to hotel and flight availability. The prize is not available during peak times such as public holidays and school holidays including a block out period from 1 December 2009 to 25 January 2010 and cannot be changed once the booking has been made.
37. Air tickets are available on the regular scheduled services of each airline and are subject to seasonal embargos. Flight itinerary may have to be adjusted depending on the airlines departure city and their current flight schedule. Frequent Flyer points are not available from any airline.
38. A credit card imprint or cash deposit may be required from the winner at check-in to the hotel, for all incidental charges. Once accommodation vouchers are issued they are non-changeable.
39. It is the traveller�s personal responsibility to ensure that they have valid documentation, including but not limited to valid passports and visas, which meet the requirements of immigration and other government authorities at every destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the traveller/s.
40. The prize is not transferable or redeemable for cash and is subject to availability. The Promoter is not liable for the cancellation of all or any part of the prize (�Prize�
, the Promoter reserves the
right to change the Prize at any time if the Prize or a component of the Prize becomes unavailable. The Promoter is not liable for the repair or
replacement of the Prize, or components of the Prize which is defective, except for liability which cannot be excluded by law. In the case of South

42. Additional costs and all other ancillary costs are the responsibility of the winner. The prize comes with the components list above only.
43. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
44. The Promoter reserves the right to request the winner to provide proof of identity, proof of valid subscription to their service provider at their residential address, proof of residency at the nominated prize delivery address, and/or proof of entry validity. Proof of identification, residency, subscription, and entry considered suitable for verification is at the discretion of the Promoter.
45. Neither the Movie Network or their associated companies is responsible, to the extent permitted by law, for acts of god, acts of terrorism or war (declared or undeclared) or other events beyond the Promoter's control which prevent awarding of the prize in accordance with the prize description, or subject to any applicable laws, to cancel, terminate, modify or suspend the promotion.
46. The Promoter shall conduct such further draws as may be necessary at the same place as the original draw at 11am (AEST) on 22 June 2009 to distribute any prizes should they remain unclaimed by that date subject to State Regulation. Any winners will be notified in writing and any winners of prizes valued over $250 will be published in the public notices section of The Australian newspaper on 1 July 2009.
47. The promoter reserves the right to announce or publish the winner�s name and/or photograph for publicity purposes.
48. The Promoter shall not be liable for any loss or damage suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained as a result of accepting the prize except for liability that cannot be excluded by law. The winner and their guests must sign a waiver accepting full responsibility for any loss or injury before taking part in any of the activities associated with the prize.
49. In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders it's determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes, war, terrorism, state of emergency or disaster, the Promoter reserves the right (subject to any written directions under State Regulation) to cancel, terminate, modify or suspend the promotion.
