Information on how to enter forms part of the terms of entry. Entry into the competition is deemed acceptance of these terms and conditions.
Entry is open to all permanent residents of South Australia. However, employees and their immediate families of Nippy’s Fruit Juices Pty Ltd and their
associated agencies and companies are not eligible to enter.
The competition commences on Monday 15 December 2008 at 12.01am (S.A Time) and concludes on Friday 20 March 2009 at 11.59pm (S.A Time).
There are two (2) components to the Nippy’s Summer 2008/2009 Competition, a Prize Draw component (10 x Riverland Holidays) and an Instant Win
component (7 x Plasma TV’s).
To enter the Prize Draw component, participants must, during the promotional period make a purchase at any participating Foodland, IGA or other
independent supermarket in South Australia of one (1) x 2 Litre Product of Nippy’s Fruit Juice (Orange Juice Unsweetened, Orange Juice Sweetened,
Orange & Passionfruit Juice, Orange & Mango Juice, Apple Juice Unsweetened, Apple & Blackcurrant Juice Unsweetened, Pineapple Juice
Unsweetened, Tropical Juice Unsweetened, Grapefruit Juice Unsweetened or Tangy Lemon 25% Fruit Juice Drink) and obtain an entry form from the shelf.
Participants must then:
log on to www.nippys.com.au and register the required details including but not limited to full name, address, daytime phone number, valid email
address and last six (6) digits from the barcode of their Nippy’s 2 Litre product purchased. Once the entry is successfully received a confirmation
message will appear on screen.
OR
mail their completed entry form to 'Nippy’s Riverland Holidays Competition – Po Box 7423 – Hutt Street – Adelaide SA 5000.'
To enter the Instant Win component, participants must, during the promotional period make a purchase at any participating Route outlet (including but
limited to delicatessens, corner stores etc.) or any other store or supermarket where Nippy’s 500ml products are sold in South Australia, of one (1) x
500ml bottle of Nippy’s Fruit Juice (Orange Juice Unsweetened, Orange Juice Sweetened, Orange & Passionfruit Juice, Orange & Mango Juice,
Apple Juice Unsweetened, Apple & Blackcurrant Juice Unsweetened, Pineapple Juice Unsweetened, Tropical Juice Unsweetened or Tangy Lemon 25% Fruit
Juice Drink). Participants must then look under the cap to see if they have a winning cap. There will be a total of seven (7) promotional caps
produced which will contain a 7 character instant win message. To claim the prize the winner must call the Promoter on (08) 8268 1504 by 5pm (S.A
Time) by 20/3/09 quoting the message printed inside the winning cap. The winner will also be required to mail (with full contact details) or
personally deliver the winning cap to the Promoter for validation. Exact validation procedure will be explained when the winner phones the Promoter.
The prize may be forfeited if the winner does not claim their prize according to these requirements. If a prize winner loses their winning cap (for
example, when sending it to the Promoter in the mail) before the Promoter is able to validate the cap, the Promoter accepts no responsibility. It is
up to the winner to ensure the safe arrival of the winning cap to the Promoter.
To enter the Unclaimed Prize Draw, eligible entrants must make an eligible purchase during the stated promotional period. They must then write on the
back of an envelope their full name, address, suburb, state, postcode, daytime phone, email address and the last 6 digits of their Nippy’s 500ml or
Nippy’s 2 Litre product purchase and send by last mail received 20/3/09 to 'Nippy’s Unclaimed Prize Draw – Po Box 7423 – Hutt Street – Adelaide SA
5000.' To opt-out of the mailing list the words ‘opt-out’ need to be written on the envelope as well. Eligible entrants can enter as many times as
they wish however each entry must be sent in a separate envelope.
The following table outlines the prizes to be won as part of the Prize Draw component. The Promoter reserves the right to substitute a prize of equal

objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry
process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in
conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion
and/or Promoter. The Promoter reserves the right to disqualify a winner if the Promoter becomes aware that the winner and/or the winner’s entry is of
a type described in this clause.
The Promoter accepts no responsibility for any late, lost or misdirected entries.
The Riverland Houseboat Prize includes $200 worth of fuel and any fuel costs exceeding $200 is at the winners’ expense. A $400 refundable cash bond is
to be paid on boarding. Further details on the conditions of houseboat hire can be viewed at www.orchardriverhol.com.au/Rateshouseboat.htm Meals,
transport to and from departure point, other transfers, items of a personal nature and all other ancillary costs are not included and are the
responsibility of the winner. The Holiday must be taken as specified. If the winner is under the age of 18 years, the prize will be awarded to the
winner's nominated parent or guardian. During the entire duration of the prize, a nominated parent/guardian must accompany any person under 18 years
of age. The prize must be taken by 1 December 2009 and is subject to booking and availability. The winner must give at least 60 days notice of their
intention to take the prize prior to the departure date. As a condition of accepting the houseboat prize, the winner (and companions) may need to sign
any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to
a legal release and indemnity form.

If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value,

The Promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the Promoter determines, in their
absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize.
Once prizes have left the Promoter’s premises (or the premises of their fulfilment house), the Promoter takes no responsibility for prizes damaged,
delayed or lost in transit. Prizes will be delivered within 28 days of winner validation.
By accepting the prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the
prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of the prize.
In consideration for the Promoter awarding the prize to the winner, the winner hereby assigns to the Promoter all right, title and interest in and to
all copyright in any material created pursuant to the winner’s participation in any aspect of the prize (Works). The winner acknowledges that the
Promoter is free to use the Works and to exercise its rights in relation thereto and the winner will not be entitled to any fee for such use.
In consideration for the Promoter awarding the prize to the winner, the winner hereby permits the winner’s image and/or voice, as recorded,
photographed or filmed during the winner’s participation in the prize to appear in connection with Nippy’s or the advertising or marketing thereof, in
any media whatsoever throughout the world and the winner will not be entitled to any fee for such use.
In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of
the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
Prize values are based upon the recommended retail prices at the time of printing (inclusive of GST). The Promoter accepts no responsibility for
change in prize value between now and the ultimate prize redemption date.
Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.
Each valid entrant who has entered the competition over the duration of the promotional period will be entered into the draw. The draws will take
place at The Twentyseven Agency Pty Ltd, 182a Hutt Street, Adelaide SA 5000 at 11am on the following dates for the Riverland Accommodation Prizes -
Monday 29/12/08, 5/1/09, 12/1/09, 19/1/09, 26/1/09, 2/2/09, 9/2/09, 16/2/09, 23/2/09 – and on Monday 23/3/09 for the Riverland Houseboat Prize.
Closing date for the draws will be last mail received the last Friday before each draw and 9.55am (S.A Time) on the day of each draw for all online
entries except for the final draw on 23/3/09 which closes 11.59pm 20/3/09 (S.A Time). All valid entries received will be included in each draw
depending on when the entry is received. All entries via www.nippys.com.au will be printed out and included with the mail entries received for each
manual draw. Eligible entrants can enter up to a maximum of five (5) times per day via the online entry form at www.nippys.com.au.
Printing errors or other quality control matters will not be used as a reason for refusing payment of prizes.
The winners will be notified in writing advising them of their prize. Winners of prizes valued over AU$100 will be published in the Public Notices
section of The Advertiser on 14/1/09, 11/2/09, 11/3/09 and 8/4/09.
Should an entrant’s contact details change during the promotional period, it is the entrant's responsibility to notify the Promoter. A request to
access or modify any information provided in an entry should be directed to Promoter.
The Unclaimed Prize Draw will take place at The Twentyseven Agency Pty Ltd, 182a Hutt Street, Adelaide SA 5000 on Monday 22 June 2009 at 11am (S.A
Time) and winners of prizes valued over AU$100 will be published in the Public Notices section of The Advertiser on Friday 26 June 2009.
The Judge’s decision is final and the Promoter will not enter into correspondence regarding the competition result.
It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s
requirements.
In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the
competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests,
natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and
recommence it from the start on the same conditions, subject to any written directions given under State Regulation.
The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or
for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law..
The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these
conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The
Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
Nippy’s Fruit Juices Pty Ltd and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion,
defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and
reserves the right to take any action that may be available.
All entries become the property of the Promoter. The Promoter collects personal information about you to enable you to participate in this promotion.
By entering the Promotion, the entrant consents to the Promoter using personal information given by the entrant to (a) administer the Promotion (b)
publish the winners (c) provide the entrant’s personal details to organisations assisting the Promoter with administering the Promotion and (d)
provide the entrant’s personal details to the permit authorities as required by law. By entering the Promotion, each entrant also consents to their
personal information being used by the Promoter for future marketing and promotional purposes including but not limited to newsletters, special
offers, product updates etc. The entrant will be able to opt-out by removing the tick from the box identified during online entry or by ticking the
opt-out box on the entry form or writing the words ‘opt-out’ on the envelope when entering the Unclaimed Prize Draw. The Promoter is bound by the
