TERMS AND CONDITIONS

1. Individuals acknowledge that the instant prizes as detailed below may have already been won.
2. This competition ("Competition") is conducted by Coca-Cola South Pacific Pty Ltd, ABN 50 003 029 794, of 71 Circular Quay East, Sydney, NSW 2000 ("Promoter"). Phone number 1800 283 391.
3. Entry to the Competition constitutes acceptance of these conditions. All entry instructions and prize information published by the Promoter form part of these conditions.
4. Only open to Eligible Entrants. An Eligible Entrant is an individual who is an Australian resident aged 13 years or older as at time of entry, excluding any: (i) employee of the Promoter or any of its related corporations or any of their agencies associated with the Competition; (ii) spouse, defacto spouse, parent, child or sibling (whether natural or by adoption) of an excluded employee; and (iii) person who the Promoter has previously notified is not permitted to enter the Promoter's competitions.
5. Competition opens at 00:00 hrs on 02/03/09 and closes at 24:00 hrs on 29/03/09 ("Entry Period"). All times and dates are times and dates in Sydney which will be AEDT during the Entry Period. All times are stated using the 24 hour clock. 00:00 hrs is the start of a day and 24:00 hrs is the end of the day.
6. "Promotional Product" means any of the following specially marked products purchased during the Entry Period from any Coles outlet: 'Powerade' Isotonic 600mL, 'Powerade No Sugar' 600mL or 'Powerade' Multi-pack (3 x 600mL). A multi-pack constitutes three Promotional Products.
7. To be eligible to enter, the Eligible Entrant must purchase a Promotional Product. Entry can only be made via the internet or SMS.
8. To enter via the internet, an Eligible Entrant must visit www.promotion.powerade.com.au/Coles ("Competition Website") and follow the directions to firstly register for a 'Coca-Cola' account if he/she has not done so already. If an Eligible Entrant has not previously registered for a 'Coca-Cola' account, he/she will be required to create an account by providing an e-mail address (which will become his/her user name), password, first and last names, postcode, date of birth, gender and a mobile or landline phone number. An entrant must not register more than once. Once registered, the entrant must visit the Competition Website and, in accordance with the directions, during the Entry Period, provide: (a) the entrant's user name and password, as established during registration; (b) the last five (5) digits of the Promotional Product barcode of the Promotional Product being used to enter; and (c) the last four (4) digits of the Coles transaction number ('Trans No.') printed on the purchase receipt. An Eligible Entrant must not use more than one (1) account to submit entries on the Competition Website.
9. Any cost associated with accessing the Competition Website is the individual's responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an individual to automatically enter repeatedly is prohibited and may render all entries submitted by that individual invalid.
10. To enter via SMS, the Eligible Entrant must, during the Entry Period, send a message via SMS containing the following, in the same order, and with a space between each bit of requested information to 1970 3663: (a) first name; (b) last name; (c) postcode; (d) the last five (5) digits of the Promotional Product barcode of the Promotional Product being used to enter; and (e) the last (4) digits of the Coles transaction number ('Trans No.') found on the purchase receipt.
11. Premium SMS cost is 55c. Eligible Entrants who enter via SMS must have a compatible mobile with SMS premium service access. SMS Service Provider: Dialect Interactive. Helpdesk open 9.00 to 17.00 Monday to Friday on 1800 283 391. SMS winners will, when required, be contacted by SMS and/or phone and the Promoter will record their address details so that the prize may be awarded. SMS entries via the Internet, or by other means other than from a mobile phone, are ineligible. Entries are deemed to be received at the time of receipt into the promotion database and NOT at the time of transmission by the Eligible Entrant. If there is a dispute as to the identity of an Eligible Entrant, the Eligible Entrant will be determined by the Promoter in its absolute discretion.
12. A reply SMS may be sent to the mobile phone used to send each entry. The reply SMS will state that the entry is rejected if the digits from the purchase receipt or product barcode included in the entry are invalid or the daily limit has been exceeded. If the entrant resubmits a rejected entry, the entrant will incur another SMS charge. The time to receive a reply may vary and receipt is subject to network coverage and availability, memory inside the sending mobile phone not being full and any other technical problems.
13. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who, in the Promoter's reasonable opinion, submits an entry that is not in accordance with these conditions or who tampers with the entry process including but not limited to tampering by way of use of techniques designed to avoid the payment of SMS costs. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
14. Incomplete, indecipherable, or illegible entries will be deemed invalid
15. Multiple entries permitted, subject to these conditions, including the following: (a) only one (1) entry permitted per Promotional Product purchased; (b) each entry must be submitted separately and in accordance with entry requirements and these conditions; (c) unrecognised barcodes or Trans No.s will be deemed invalid; (d) a maximum of three (3) entries per Eligible Entrant per day via SMS is permitted; and (e) a maximum of three (3) entries per Eligible Entrant per day via internet is permitted.
16. Entrants must retain a photocopy of their Coles purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant's entries and forfeiture of any right to a prize.
17. Instant winners will be notified immediately in writing according to their entry method: (a) SMS - via return SMS; or (b) online - after entry submission.
18. The Promoter's decision is final and no correspondence will be entered into.
19. Instant win prizes: There will be one (1) instant prize to be won each hour. There will be a total of 672 instant win prizes to be won. Each instant win prize is a Samsung 8.1 MP Camera valued at AUD$99.00 each. The Promoter will randomly determine a time in each hour. The provisional instant winner will be the Eligible Entrant who submits the first entry on or after the selected time during that hour. If the instant prize is not awarded, it will roll over into the next hour, or in the case of the last hour of the Entry Period, the unclaimed prize draw.
20. If the winner of the prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian. If the prize is awarded to a winner's nominated parent or guardian, they take the prize subject to the same conditions as contained herein.
21. If the prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
22. Total prize pool value is $66,528.00.
23. Prizes are not transferable or exchangeable and cannot be taken as cash.
24. A draw for any unclaimed prizes may take place on 06/07/09 at 1/3 Green Street, Brookvale, NSW at 3:00pm, subject to any directions from a regulatory authority.
25. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
26. Quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these Terms and Conditions, all prize claims in excess of the advertised prize pool will be honoured. Instant win notification messages void if stolen, forged, mutilated or tampered with in any way. There will be a maximum of 672 instant win notification messages for this promotion.
27. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier's requirements.
28. If for any reason the conduct or operation of the Competition is interfered with or disrupted in any way (including by vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, computer bugs or viruses, tampering or technical failures), the Promoter reserves the right to cancel, terminate, modify or suspend or recommence the Competition, subject to the approval of the authorities that have issued permits for its conduct.
29. The Promoter assumes no responsibility for: (i) any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise, (ii) any theft, destruction or unauthorized access to, or alteration of such communications; (iii) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Competition; (iv) any incorrect or incomplete information which may be communicated in the course of the administering this Competition (whether as a result of one of the foregoing causes or otherwise); (v) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (vi) any variation in prize value to that stated in these conditions; (vii) any tax liability incurred by a winner or Eligible Entrant. I think there may have been a glitch this morning. I entered a total of 4 times today for coles and six times at safeway and each said congrats etc etc I thought was a bit odd so I rang to confirm. When they got back to me they said I had only infact won twice at coles and twice at safeway out of the total of 10 entries. ( hope that makes sense)

normally when coles express is included it actually has it in the t&c's. They just say provide a copy of your Coles receipt.Maybe ring and check first

WA - Public Holiday - no shops open arhhhhh

Banana I entered 3 for me and 1 for hubby at coles and then 3 for me and 3 for hubby at woolies ( so within the t&c's).I thought something was wrong so I entered 3 for hubby in the same hour and they all came back winners. They confirmed the entries had gone through but they are not showing as winners at their end.

Does this mean they will honour them?

As I see it, you had to confirm your details on the congrats so surely they will get all the win details. They had plenty of time this morning to check the comp was working properly.

I called them because the barcodes were not working for the IGA comp....and thats when they called me back and asked what bottles they were, they said it wasn't my fault that the barcodes were not being accepted and as long as I had the receipts was fine....I used same barcode, the only one that worked.

Can someone clarify with the terms and cond.
With multiple enteries - is it max 3 per person via sms per day and max 3 per person via internet allowed. (Total 6 for the day) Or does it say in their language only 3 per person per day either via SMS or email. (total 3 for the day)

I had a call back from andrew and he says that they are legit wins as they may be carried over from the midnight through to 9am entries that no one won.....hmmmm will believe when they arrive I guess.
They are in process of updating the barcodes that were not working.

Same thing happened here. I entered my three codes and no reply. So entered again and said I had reached my 3 daily limit. Hopefully that means they went through.

I won a camera on Friaday and I just got a call asking for my postal details - very quick.

Must be blind but I can't see a 4 digit receipt number on my Coles receipt only 3 digit? Not a Coles shopper and entering 3 digits on the entry site keeps coming back with, enter your 4 digit number?

She said she was sending 'paperwork' out for camera win, thought it was a bit odd that she didnt ask me to send in receipts instead. A stat dec for a $100 prize is a bit ridiculous, hardly worth the time to go and find a JP or Public Servant to sign it, would rather just send in receipts!!!!

I didn't win on the first day I think it was Friday that I won both of mine.

Who knows what they are doing. They seem to be telling people they are sending out stat decs. It does seem a bit odd. I would rather just send in receipts. Perhaps stat decs are for the multitude of first day winners?? Who knows.

I haven't had a phone call from anyone yet about the woolies or coles comp.

I have all my receipts and bottles. The only thing is the first lot I bought I had coles,woolies and iga bottles and I forgot to write on them which went with which. The rest after that I wrote coles, woolies or iga on so I would know. So hopefully they won't check all the labels or will let me know which ones went with which. I have receipts anyway.

Just received a stat dec for my one win, I don't think people will get away with entering and not purchasing, so that is good news for us who enter legit.

does everyone have 'specially marked' labels? or are they just normal?

I've bought multi packs and when I win on a receipt i dont enter anymore on it just in case. I have won three on the same barcode. weird.

thanks mixymouse. i called the company when a barcode wouldn't go through and they said they have to be 'specially marked' bottles but they arent anywhere.

They are definately not specially marked bottles, and when I spoke to them a couple times there was no mention either.

Here's a funny thing when you entre via sms and you reach your daily limit you get an sms saying "keep your receipts and try again tomorrow" . Now the T&C say 1 entry per product hmmmmm

Just a little worried about something.........

I bought a multipack and entered the barcode number on each bottle seperately - as in three seperate entries with 3 different barcode numbers.
2 of my 3 entries were winners.
But - I've just noticed there is a different barcode number on the multipack case.
Was I supposed to enter that number for all 3 entries?
Could this be a problem?
Can any other 'multipack winners' please tell me what they used?

Firefly I had the same problem I had written on one of mine and not the other. I had to take a guess. I am sure they will let me know if its wrong lol.

I have five confirmed wins for cameras,(as per computer screen) but have nine congratulation letters, ect.

So what I think I will do is post of all the receipts that I thought I lost on, together with all the labels and stat dec, and see what happens! (with a note, explaining that)

That is bizarre mudcrab. I don't think they have any idea what's going on. One minute they say people did not win the next you are getting extras.

She rang today and was told that they were still sending out letters and to be patient!!!!!

Yes it seems to be a bit random when you get the letters. I won around the 6th March I think and have received all my letters for those wins. Had a couple of wins just recently waiting on letters for them. All my entries are online.

I received a Congrats letter in the mail today but my entries were non-winning ones. HUH? What's going on with this comp? Not that I'm complaining about winning but now I'm not sure on which receipts and labels I won on.

I have won two cameras (one near the start and one near the end) I got a phone call last week confirming address but have had no letters yet.... I hope they know what they are doing.......this comp seems very messy and confusing

I won a camera online on 5th hadn't heard anything so rang the help desk last week - they told me not to worry that letters weren't being sent out til after the promotion. Rang help desk again today who gave me the phone number of Handling Matters - they have no record of my win - they are going to get back to me after running some checks. I will be ringing them again tomorrow!

The whole thing is such a crazy mess.
We won 2 cameras but the purchases are all on one docket.
Had only received 1 stat dec.
When I rang lady told me .....send in original receipt etc and we'll send out another stat dec soon for the other win.
So I questioned how I would be able to send an original receipt with the 2nd entry if they have my receipt.
She said "send a photocopy"

Knowing darned well what has happened with everyone else with sending copy receipts, there is no way I'm doing that.....

They obviously didn't think this one out too well, and have no guidelines to follow. Each person you talk to there, tells you a different thing!

Will be sending them the 2 stat decs together with receipt etc all in one lot!

Just received my stat dec filled it all in photocopied reciept, label and license then got the chemist to sign everything and sent it of.

Mind you got a very strange look from the chemist thankgoodness I have known him for years

Hi Everyone!!! I rang on Friday saying I haven't received all my stat dec's. Then I got another one today. She said more stat dec's are being sent out and the first lot of cameras are going out this week. Hope that helps.

NOTICED Letters say "Pursuant to the T&C's blah blah blah , yet no where in the T&C's does it say original receipts or labels & certainly no mention of stat dec's .
When I had a win I printed all but 1 page & attached the label to it .
If they wanted original receipts it should have been stated in T&C's & we could have got separate receipts .

Nothing yet. I sent my forms away very early in the comp.

I have been to a post office and two chemists and no-one will take the time to sign my forms. Very disappointed.

What about going to your local council. They always have a JP there.

People in the professions from the following document should be able to witness/sign a stat dec.
