Conditions of entry
1 Information on how to enter forms part of these conditions of entry. Participation in this promotion constitutes acceptance of these conditions of
entry.
2 Entry to the promotion is open to all eligible entrants aged 12 years and over who have a current Australian passport which is valid for at least 6
months from 29/07/2009, who are able to take the major prize on 14/07/2009 – 21/07/2009 (see clause 9) and who fulfil the entry requirements.
Directors, management, employees, officers and contractors (and their immediate families) of the Promoter or of the agencies or companies associated
with this promotion are ineligible. “Immediate families” means spouse, parent, guardian, natural or adopted child, and sibling (whether natural or
adopted by a parent), whether or not they live in the same household as the director, manager, employee, officer or contractor.
3 The Promotion begins on 3/03/2009 and closes SMS entries: 11.59.59 pm (Sydney time) on 30/03/2009 and mail entries: last mail 30/03/2009 (Promotion
Period).
4 To enter, consumers must purchase any 600ml Gatorade product (Product) from a participating 7 Eleven store during the Promotion Period and either:
(a) send an SMS from their mobile phone to 1997 7777 giving their details and the last 5 digits of the barcodes of the products purchased in one
message in the following format: FIRSTNAME[SPACE]LASTNAME[SPACE]LAST5DIGITSOFBARCODE Computer generated entries will not be accepted. Retain original
product labels from products. Failure to provide these to the Promoter upon request may result in an invalid entry at the Promoter’s discretion (and,
at the Promoter’s discretion, in all of the entrant’s entries being invalid). OR (b) write their name, address and daytime contact number on the back
of a stamped envelope, put the original product label from the Product in the envelope and send it to ‘Gatorade Promotion for npower Ashes Series
2009’, PO BOX 248, Eastern Suburbs MC NSW 2004. Each entry must be in a separate envelope. Entrants must retain a copy of purchase receipt(s) to
verify entries. Multiple entries are allowed, however only 1 entry per Product barcode is allowed, with a maximum of 5 entries per household per day.
5 Sharing receipts or any other use of third party receipts is not allowed. If the Promoter reasonably believes that an entry has been made on this
basis, the Promoter may invalidate all entries affected.
6 SMS entry is only open to consumers with a compatible mobile phone connected to a service provider which permits text messaging to the Promotion SMS
number. It is recommended that entrants check with their individual service provider in this regard. The maximum cost of the SMS is 55 cents (inc
GST). Entries sent outside the Promotion Period cost a maximum of 55c (inc GST).
7 The Promoter accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries,
claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption,
communications failure or otherwise. The Promoter has no control over mobile telephone communications, networks or lines and accepts no responsibility
for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any
consequences of user error including (without limitation) costs incurred8 The draw will be conducted on 14/04/2009 at 10:00am (Sydney time) at Level
1, 379 Crown Street Surry Hills NSW 2010. 9 The first valid entry randomly drawn will win the major prize (Major Prize). The Major Prize is a trip for
two to attend the npower Ashes Series 2009 (14/07/2009 – 21/07/2009) at Lord’s in the UK, and includes: • two return economy airfares to the UK from
winner’s nearest capital city (carrier selected by the Promoter); • return transfers between airport/hotel; • 7 nights accommodation at a 5 star hotel
in London (standard room twin share); • tickets for two to attend the npower Ashes Series 2009 match at Lord’s (16/07/09 – 20/07/09); and • AU $2,000
spending money. The major prize is valued at up to $14,300 (inc GST) depending on the winner’s location of residence. The winner will be notified
immediately by telephone. The winner must confirm their availability to take the prize on 14/07/2009 – 21/07/2009 by 5:00pm (Sydney time) 13/05/2009.
In the event that the winner is unable to take the prize on 14/07/2009 – 21/07/2009, or has not claimed the prize by 5:00pm 13/05/2009, or has not
confirmed their availability to take the prize on 14/07/2009 – 21/07/2009 by 5:00pm (Sydney time) on 13/05/2009, then the winner’s entry will be
deemed invalid and the Promoter reserves the right to conduct further draws at 10:00am on 14/05/2009 at the same location as the original draw to
distribute the prize, if permitted by relevant legislation. In the event that a winner is from South Australia, written directions will be sought from
that authority. If the winner of the prize is under 18 years of age, the prize will be awarded to the winner’s parent or guardian. In the event that
one of the people participating or nominated to participate in the prize is under 18 years of age, a parent or legal guardian of the participant must
be present for the duration of the prize, as one of the participants. The winner and friend taking the trip must depart and return at the same time
using the same air carrier. The winner is responsible for ensuring that all necessary documentation to travel is obtained (including valid passports
and required visas), otherwise the winner’s entry will be deemed invalid All additional spending money, meals, taxes, insurance, transfers and all
other ancillary costs, including any costs associated with passports and visas and costs associated with transport etc from the winner’s place or
places of residence to the winner’s nearest airport are the responsibility of the winner. Each participant is required to sign an indemnity in a form
approved by the Promoter in favour of the Promoter and all involved parties prior to participating. If they do not sign that indemnity form, they will
not be able to participate. The prize winner and participant agree to comply with any reasonable directions or guidelines notified to them by the
Promoter or its agents. The prize is subject to booking and flight availability and must be taken to coincide with the npower Ashes Series 2009 match
at Lord’s. No extension will be permitted. Any alterations to confirmed prize details will be at the expense of the winner and will only be permitted
with the Promoter's prior consent.
10 The next 50 valid entries randomly drawn will each win a minor prize (Minor Prize). The Minor Prize is a cricket set comprising wooden bat, 4
yellow stumps, twin bail, red bouncer ball and carry bag. Each Minor Prize is valued at $29.95 (inc GST).
11 The total prize pool is valued at up to $15,797.50 (inc GST).
12 At the Promoter’s request, winners must, and where relevant, must procure that the winner’s friend, participate in all promotional activity (such
as publicity and photography) surrounding the winning of the prize, free of charge, and they consent to the Promoter using their name and image in
promotional material.
13 The Promoter, its associated agencies and companies, and the agencies and companies associated with this promotion will not be liable for any loss
(including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is
suffered or sustained (whether or not arising from any person’s negligence) by any person in connection with this Promotion or accepting or using a
prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
14 Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for any damage in transit to
prizes.
15 All winners will be notified in writing. The name and state of residence of the Major Prize winner will be published in The Australian on
20/04/2009. The Promoter may also publish the name and the State/Territory of residence of the winner on its website or in a trade publication. By
entering this Promotion, each entrant requests that his or her full address not be published. 16 Prizes are not transferable or exchangeable and
cannot be redeemed for cash or any other form of compensation. In the event for any reason a prize winner does not take an element of a prize at the
time stipulated by the Promoter, then that element of the prize will be forfeited by the winner and neither cash nor any other form of compensation
will be supplied in lieu of that element of the prize. The value of the prizes is accurate as at the commencement of this promotion. The Promoter
accepts no responsibility for any variation in the value of a prize after that date. If for any reason a prize is not available, the Promoter reserves
the right to substitute another item for it, in its sole discretion, of equal or higher value, subject to the approval of the gaming authorities in
each State/Territory, where relevant.
17 If a Minor Prize is not claimed within 3.5 months of the draw, the relevant winner’s entry will be deemed invalid and the Promoter reserves the
right to conduct such further draws at 10:00am (Sydney time) on 22/07/2009 at the same location as the original draw as are necessary to distribute
the prizes subject to any written directions given by the relevant gaming authorities. Any winners will be notified in writing. 18 The Promoter may
require entrants to validate any one or all of their entries in the promotion at any time during the promotion prior to being eligible to claim a
prize. The Promoter may require the winner to provide proof of identity, proof of age, proof of residency at the nominated prize delivery address
and/or proof of compliance with any other eligibility or entry criteria. Identification considered suitable for verification is at the Promoter’s
discretion.
19 If a winning entry is deemed not to comply with these conditions of entry, the entry will be discarded and a new winner of the prize will be
determined by drawing a further valid entry. The judges’ decision is final and no correspondence will be entered into.
20 The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this Promotion by, any person who
tampers with or benefits from any tampering with the entry process or with the operation of the Promotion or acts in violation of these conditions,
acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person.
21 If for any reason any aspect of this promotion is not capable of running as planned, including by reason of infection by computer virus, mobile
network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter which corrupts
or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter may in its sole discretion cancel,
terminate, modify or suspend the promotion, or invalidate any affected entries, subject to the approval of the gaming authorities in each state and
territory, where required.
22 The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be
sought. Where the operation of the promotion results in, for GST purposes, supplies being made for non-monetary consideration, entrants agree to
follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST
inclusive market values.
23 All entries will be the property of the Promoter. The information entrants provide will be used by the Promoter for the purpose of conducting this
promotion and for the other purposes of collection as set out in the Promoter’s privacy policy. The Promoter may disclose entrants’ personal
information to its contractors and agents to assist in conducting this promotion or communicating with entrants and to State and Territory lottery
departments and winners’ names may be published as required under the relevant legislation. The Promoter is bound by the National Privacy Principles
in the Privacy Act 1988. Entrants can request access to the personal information the Promoter holds about them by contacting Consumer Services on 1800
