Terms & Conditions</p>
<p>1. Instructions on how to enter the competition and how to claim prizes form part of these terms and conditions.</p>
<p>2. Entry is only open to all legal Australian residents. No purchase is necessary to enter. Employees of the Promoter (Western Digital Technologies, Inc.), its affiliates & agencies associated with the promotion (& their immediate families) are ineligible. Limit one entry per person. All state, territory and local laws and regulations apply. Void where prohibited. Eligible entries must comply with all entrance requirements published by Promoter in connection with this competition. Promoter shall select one winner at the end of each month from those entries that it has received in the course of that month, during the duration of the competition period.</p>
<p>3. Competition commences AEST 9.00am March 1 2009 and lasts until AEST 5.00pm March 31 2009.</p>
<p>4. To enter the competition, entrants must answer the question, “What color WD hard drive are you and why?” in 25 words or less. Entrants must submit their answers on the form provided. Sponsor is not responsible for late, lost, incomplete, illegible or misdirected entries. Proof of posting online shall not constitute proof of delivery.</p>
<p>5. The entrant who submits the most creative and/or insightful response from all those received each month, as judged by the Promoter or its designee, will be deemed the winner. Prizes will be awarded and distributed as outlined below. By entering the competition, entrants agree to be bound by these terms and conditions and the decisions of the Promoter and/or its agents, including decisions regarding which entries are awarded prizes in this competition. Promoter’s decisions in relation to any aspect of this competition are final and binding.</p>
<p>6. Entrants must submit complete and accurate information about themselves. Any error in the information submitted by entrants could result in a voided submission make the entrant ineligible for prizes.</p>
<p>7. Winners will be announced as close to the first business day of each month as reasonably practicable.</p>
<p>8. Winners will be notified by e-mail and winners’ names will be published on the website, www.wdpromotions.com.au.</p>
<p>9. This competition is a game of skill. Each monthly prize has an estimated value of $500.00 AUD. Prizes are not transferable. No substitution of prizes is permitted, except at Sponsor’s option, including Sponsor’s right to substitute a prize of equal or greater value if the advertised prize is unavailable.</p>
<p>10. Winners will be notified using the contact details provided in the form the entrant submitted. If the Promoter receives no response from the winner within seven days of notification, the Promoter will select another winner from the entries submitted for that month. If the winner of a prize is under the age of 18 years, the prize will be awarded to the winner’s parent or guardian.</p>
<p>11. Promoter reserves the right to verify the validity of claims and entries and disqualify any entrant for tampering with the entry process, or for submitting a claim or entry that is not in accordance with these conditions. Promoter shall not be liable for, and takes no responsibility in relation to, any loss or damage whatsoever suffered (including but not limited to indirect or consequential loss), or for personal injury suffered or sustained, as a result of taking any prize, except for any liability which cannot be excluded by law.</p>
<p>12. The promoter reserves the right to cancel, terminate, modify or suspend the competition at any time.</p>
<p>13. By entering this competition, each entrant agrees that any information the entrant provides to Promoter may be used by Promoter, its agents or its affiliates, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant. Entrants also agree that entrants’ personal information may be disclosed to State and Territory lottery departments and winners’ names published as required under the relevant lottery legislation. All entries become the property of Promoter. All personal details of entrants will be stored at Promoter’s head office. A request to access, update, correct or remove any information should be directed to Promoter at the following address.</p>
<p>15. Insurance and warranty for any products awarded as prizes in this competition will be the responsibility of the vendor supplying the prize. Warranty details for each prize, or components of each prize, will be provided to winners with the prize.
