Information on how to enter and prizes form part of these Conditions of Entry. Entry in the Promotion does not constitute entry into any other promotion, contest or draws. By participating in the Promotion, each entrant unconditionally accepts and agrees to comply with and abide by these Conditions of Entry and the decisions of M•A•C Cosmetics ("Promoter"), which shall be final and binding in all respects.
ELIGIBILITY: Entry is only open to Australian resident individuals aged 18 years or over as at the start of the promotion. Employees, officers and directors of M•A•C Cosmetics, Sanrio Inc., and RealTime Media, Inc. (collectively, “Promotion Entities”), their respective parents, affiliates, subsidiaries, divisions, advertising, promotional, fulfilment and marketing agencies, their immediate families (parent, child, sibling & spouse) and persons living in the same households as such individuals (whether related or not) are not eligible to participate in the promotion. Void where prohibited by law, rule or regulation. All federal, state and local laws and regulations apply.
Promotion commences 4am AEDT on 19 February 2009. Entries close and must be received by 2:59:59am AEDT on 1 April 2009 (“Promotional Period”). The draw will take place at 5th Finger, Level 7, Tower Building Australia Square, 264 George Street, Sydney NSW 2000 on 6 April 2009 at 11am AEST. Winners’ will be notified personally and in writing and winner’s names will be published in The Australian newspaper on 9 April 2009.
HOW TO ENTER THE DRAW: To enter the Promotion, eligible entrants must, during the Promotional Period: (a) visit http://www.maccosmetics.au//hellokitty, Facebook.com or participating social networking sites or blogs; (b) follow the prompts to the competition page where entrants will be invited to select their “feelings” about the MAC fans via an interactive poll module; (c) answer the poll questions and select one of nine potential pre-determined “feelings”; (d) after engaging with the poll, near real-time results will be revealed and the entrant will advance to an entry form where entrants must follow the prompts to complete the entry form in full; and (e) submit the completed entry form. Entrants who complete the entry form with their true and correct information in all required fields and click the ”Submit” button will be entered into the draw.
There is a limit of one (1) entry per person and per email address per day permitted. Draw entries on the same day from the same person or email address will be disqualified. Any attempt by an entrant to enter the draw more than once in the same day and/or with multiple email accounts may result in disqualification at the discretion of the Promoter upon prize verification. For the purposes of the Promotion, a day shall mean a 24-hour period, as follows: (a) for entries submitted on or before 5:59:59pm AEDT on 8 March 2009-beginning 4am AEDT and ending at 3:59:59am AEDT the following day; and (b) for entries submitted on or after 6pm AEDT on 8 March 2009- beginning 3am AEDT and ending 2:59:59am AEDT on the following day. To enter the draw again entrants can register again by simply filling in their information and clicking the “submit” button.
Tell-A-Friend Referral Link: After submitting an entry into the draw in accordance with clause 4, entrants will be directed to the “Thank You/Tell-A-Friend” page where entrants can earn additional entries into the draw. For each friend who is referred and who subsequently enters into the draw via the Tell-A-Friend referral link, the referring entrant will receive 1 additional entry into the draw (“Additional Entry”). Only 5 Additional Entries are permitted per entrant and per day for the duration of the Promotion. If the same person is referred as a friend by more than one entrant, a maximum of one additional entry will be awarded and it will be awarded to the entrant who first referred that person.
Entries will be deemed made by the authorized account holder of the email address submitted at time of entry. The authorized account holder is defined as the natural person who is assigned an email address by an Internet access provider, online service provider or other organization that is responsible for assigning email addresses or the domain associated with the submitted email address. A winner must, at the request of the Promoter, provide the Promoter with satisfactory proof that he/she is the authorized account holder of the email address associated with the winning entry.
Entries generated by a script, macro or other automated means are prohibited. Entries that are incomplete, illegible or corrupted are void and will not be accepted. Any incorrect details submitted may render the corresponding entry invalid.
The Promoter reserves the right to verify the validity of entries and entrants (including an entrant’s identity and age) and to disqualify any entrant who submits an entry that is not in accordance with these Conditions of Entry or who tampers with the entry process (including but not limited to tampering by way of use of automated entry software). Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
There will be 1 x Grand Prize winner and 2 x First Place winners.
The first valid entry drawn will win the Grand Prize valued at RRP AUD586.00. Grand Prize is a Hello Kitty Koutore Collection consisting of: (a) 2 x Hello Kitty Kouture Dazzlegass (RRP AUD68.00 each); and (b) 3 x Hello Kitty Kouture Sheer Myst. Powder (RRP AUD150.00 each). If a prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with an alternative prize to the equal value and/or specification, unless to do so would be prohibited by law and subject to any written directions from a regulatory authority.

Unless expressly stated within these Conditions of Entry regarding all prizes, all other expenses become the responsibility of the winner. The Promoter accepts no responsibility for any tax liability incurred as a result of an entrant participating in the Competition. Entrants should obtain independent tax and financial advice.

If for any reason whatsoever beyond the reasonable control of the Promoter, the promotion is not capable of being conducted as reasonably anticipated, the Promoter reserves the right, in its sole discretion, unless to do so would be prohibited by law, to (a) disqualify any entrant; and/or (b) subject to any written directions from a regulatory authority, to cancel, suspend, modify, terminate or cancel the promotion.

If any prize is not claimed by a winner within 3 months of the draw, the prize will be awarded to another eligible entrant in a redraw on 6 July 2009 at the same time and place as the original draw, subject to any directions from a regulatory authority. If there is a redraw, the name of any winners’ in the redraw will be published in The Australian on 16 July 2009.

Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (incl. photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
Any costs associated with accessing the promotional website are the entrant’s responsibility and are dependent on the Internet service provider used.
Except for any implied condition or warranty the exclusion of which from these Conditions of Entry would contravene any statute or cause any part of these Conditions of Entry to be void (“Non Excludable Condition”), the Promoter excludes from these Conditions of Entry all conditions, warranties and terms implied by statute, general law or custom. Except for liability in relation to a Non Excludable Condition, the Promoter and Promotion Entities, their respective parents, affiliates, subsidiaries, divisions, retailers, agencies and their respective officers, directors, employees and agents, excludes all liability whether arising in tort (including without limitation negligence), contract or otherwise for any personal injury or any other loss or damage (including without limitation loss of opportunity or loss of profits) whether direct, indirect, special or consequential, arising in any way out of the promotion, including, without limitation, the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Conditions of Entry; (e) any tax implications; and/or (f) a prize or use of a prize.
The Promoter is not responsible for technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware, software or web site. The Promoter is not responsible for lost, interrupted or unavailable network server or other connections, miscommunications, failed telephone or computer or telephone transmissions or technical failure, jumbled, scrambled or misdirected transmissions, for incorrect or inaccurate entry information, howsoever caused, or other error of any kind whether human, mechanical or electronic. Entrants found tampering with or abusing any aspect of this Promotion, as solely determined by the Promoter, will be disqualified. If disqualified for any of the above abuses, the Promoter reserves the right to terminate the entrant's eligibility to participate in the Promotion. Any attempt by any entrant to deliberately undermine the legitimate operation of the promotion may be in violation of criminal and civil law, and, should such an attempt be made, the Promoter reserves the right to seek damages from any such person to the fullest extent permitted by law. The Promoter’s failure to enforce any term of these Conditions of Entry shall not constitute a waiver of that provision. Promoter reserves the right to terminate, cancel, suspend and/or modify the Promotion if any fraud, virus or other technical problem corrupts the administration, security, or proper play of the Promotion, as determined by Promoter in its sole discretion. In such event, the Promoter reserves the right to award the prizes at random from among the eligible entries received up to the time of the impairment. Only the stated number of prizes will be awarded. If for any reason more entrants receive a winner notice than the number of prizes stated herein, Promoter reserves the right to award only the number of prizes stated in the Conditions of Entry for that category. In no event will more prizes be awarded than those listed in clause 11.
The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and for any purpose required under Australian lottery legislation or any other regulatory authority. Entry is conditional on providing this information. Unless otherwise advised, the Promoter may also use the information for promotional, marketing and publicity purposes. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
