Information on
how to enter and prizes form part of these conditions of entry. Entry into the promotion is deemed acceptance of these conditions of entry. Entry is
via email.
Entry is open to all Australian permanent residents 18 years or over. Employees and their immediate families of L’Oreal Luxury Australia (L’Oreal),
The VProject and printers, suppliers, providers and agencies associated with this promotion are ineligible to enter.
The promotion commences on 6th February 2008 at 10:00am (AEDST) and concludes on 6th April 2008 at 11:59pm (AEDST).
To enter the major prize element of this promotion, participants must, during the promotional period: a) receive an email from LANCOME/L’Oreal
inviting them to enter this competition; and b) follow the prompts to the online competition entry form and fully complete and submit the online entry
form, including by describing Lancôme Oscillation in 3 words.
Entrants will also be invited to refer one or more friends to enter this competition by providing their friends’ email addresses. Entrants must ensure
that they have obtained permission from their friends in order to provide their details to the Promoter and/or L’Oreal in relation to this
competition.
Entrants can only enter in their own name and use their own email address. The Promoter and/or L’Oreal reserve the right to request winners to provide
proof of age, identity, proof of residency at the nominated prize delivery address, and/or proof of entry validity. Proof of identification, residency
and entry considered suitable for verification is at the discretion of the Promoter and/or L’Oreal. The Promoter and/or L’Oreal reserve the right to
validate and check the authenticity of any prize claim or entry before awarding a prize.
Entries will be deemed to be accepted at the time of receipt and not at the time of transmission by the entrant. Incomplete or incomprehensible
entries will be deemed invalid. No responsibility will be taken for lost, late, incorrectly submitted, delayed, illegible, corrupted or misdirected
entries, claims or correspondence whether due to error, omission, alteration, tampering deletion, theft, destruction, transmission interruption,
communications failure or otherwise. Entries not fully complying with these Terms and Conditions may be deemed invalid at the Promoter and/or
L’Oreal’s discretion. The Promoter and L’Oreal are not responsible for any consequences of user error including (without limitation) costs incurred.
The major prize element of this competition is a game of skill. Chance plays no part in determining the major prize winners. Each valid major prize
entry will be individually judged (by representatives of L’Oreal) based on, among other things, literary and creative merit. The judges’ decisions are
final and no correspondence will be entered into. Each “3 words” statement must be the entrant’s original work. By entering this competition,
entrants:
consent to L’Oreal making copies of or publishing the whole or any part of their entry (including the “3 words” statement) and otherwise exploiting
the entry and any rights in relation to the entry, to publicise this competition or for any other purposes; and
undertake to L’Oreal that their entry is not, and its use by L’Oreal will not be, in breach of any third party intellectual property rights.
Major Prize: The best valid entry, as determined by the judges, will $1500 worth of Lancômeproducts and a complete makeover by a Lancômemake up
artist. Runner Up Prize: There are 2 runner up prizes to be won. The runner up winners will receive $1000 worth of Lancômeproducts and a complete
makeover by a Lancôme make up artist.
All winners will be notified in writing by email.
Prizes are not transferable or exchangeable and cannot be redeemed for cash. If any of the prizes, or element of the prizes, are unavailable, for
whatever reason, the Promoter and/or L’Oreal reserve the right to substitute that prize, or element of a prize, for an item of equal or greater value
as determined by the Promoter and/or L’Oreal, subject to state regulation and subsequent approval.
Programming and other quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under
these conditions of entry, all valid prize claims in excess of the advertised prize pool will be honoured.
In the event that (for any reason whatsoever) a winner does not take a prize, or an element of a prize, at the time stipulated by the Promoter and/or
L’Oreal, then that prize, or element of that prize, will be forfeited by that winner and cash will not be awarded in lieu.
14. In the event of a prize not being accepted or claimed within 3 months of the minor draw, the relevant prize winner’s entry will be deemed invalid
and L’Oreal reserves the right to conduct such further draws at 10am AEST on 6th June 2009 at The VProject, Suite 101/54 Foveaux Street, Surry Hills
NSW 2010 to distribute any unclaimed minor prizes (subject to any directions given under applicable law).
The prizes must be taken as offered and cannot be varied. Prize values are GST inclusive and are in Australian dollars and are the recommended retail
value as provided by the supplier and are correct at time of printing. The Promoter and L’Oreal accept no responsibility for any variation in prize
value.
The Promoter and/or L’Oreal’s decision in relation to any aspects of the competition is final and binding on every person who enters and no
correspondence will be entered into.
Prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to the
acceptance of the prize. The Promoter and L’Oreal accept no responsibility for any tax implications that may arise from the prize winnings.
The Promoter and/or L’Oreal will not be responsible for any delay in delivery, or failure of safe delivery, of any prize. The Promoter and/or L’Oreal
and their associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or
loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in
connection with this competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that
liability is limited to the minimum allowable by law).
Without limiting the previous paragraph, the Promoter, L’Oreal and their associated agencies and companies associated with this promotion will take no
responsibility for prizes damaged or lost in transit.
The Promoter and/or L’Oreal are not responsible for any of the equipment or programming associated with or utilised in this competition, or for any
technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission,
interruption, deletion, defect, delay in operation or transmission, communications line, Internet, telephone, mobile or satellite network failure
(including due to traffic congestion, technical malfunction or otherwise), theft or destruction or unauthorised access to or alteration of entries.
The Promoter and/or L’Oreal reserve the right, in their sole discretion, to disqualify any individual who the Promoter or L’Oreal has reason to
believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper
conduct of the promotion. The Promoter and L’Oreal’s legal rights to recover damages or other compensation from such an offender are reserved.
All entries become the property of L’Oreal. The information entrants provide will be used by the Promoter and L’Oreal for the purpose of conducting
this competition. L’Oreal may disclose entrants’ personal information to its contractors and agents to assist in conducting this competition or
communicating with entrants. By entering this competition, entrants consent to the storage of their personal information on L’Oreal’s database and
understand that this information may be used for future promotional and marketing purposes regarding L’Oreal’s products. The Promoter and L’Oreal are
bound by the National Privacy Principles in the Privacy Act 1988. Entrants can request access to the personal information L’Oreal holds about them by
contacting L’Oreal at 564 St Kilda Rd, Melbourne 3004. Entrants can request access to the personal information the Promoter holds about them by
contacting the Promoter at the address below. Any request to update, modify or delete the entrant’s details should be directed to the Promoter and/or
L’Oreal as applicable.
If for any reason any aspect of this promotion is not capable of running as planned, including due to infection by computer virus, network failure,
bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter or L’Oreal which corrupts
or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter and/or L’Oreal reserve the right in its
sole discretion to disqualify any individual who tampers with the entry process or acts with the intent to annoy, abuse, threaten or harass any other
person and, subject to any written directions given by the various Lottery Departments, to cancel, terminate, modify or suspend the promotion.
In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders its determination, including
but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; the Promoter and/or L’Oreal may in
their absolute discretion cancel the event and recommence it from the start on the same conditions subject to State Regulation.
