Cricket Bat Promotion
Terms and Conditions
1.Information on how to enter and the prizes of the Bupa Family Challenge – Cricket Bat Promotion (“promotion”) form part of these Terms and
Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2.Entry is only open to Australian residents who are over the age of 18 who have registered their interest for their family to participate in 2012
Bupa Family Challenge (“Entrants”). Employees (and their immediate families) of the Promoter, Bupa, Life Education and agencies associated with this
promotion are ineligible to enter.
3.The promotion commences at 9.00am on 24/01/2012 and ends at 11.59pm AEST on 05/02/2012 (“Promotional Period”). Only one (1) entry per Entrant is
permitted.
4.To be eligible to enter, Entrants must complete an entry form, explaining in 25 words or less “What is your family’s favourite healthy activity?”
5.The Promoter reserves the right, at any time, to verify the validity of entries and Entrants (including an Entrant’s identity, age and place of
residence) and to disqualify any Entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry
process. Incomplete, indecipherable, or illegible entries will be deemed invalid. The Promoter may, however, accept entries containing errors and
omissions at its Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those
rights.
6.This is a game of skill and chance plays no part in determining the winner. The Promoter will, in its sole discretion, judge each entry according to
its creative merit. The Promoter’s decision is final and no correspondence will be entered into.
7.There will be one (1) winner only, whom the Promoter will select following the Promotional Period. The winner will be notified by email and announced on the Bupa Family Challenge website on
10/02/2012.
8.The best valid entry, as determined by the Promoter, will win the prize of a cricket bat signed by multiple current Cricket Australia contracted
players. The value of the prize is inestimable.
9.The prize, including any portion, is not transferable or exchangeable and cannot be taken as cash, unless stipulated otherwise. If due to reasons
beyond the Promoter’s control the prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with another
prize.
10.All entries submitted become the property of Bupa Australia Pty Ltd (“Bupa”). Entries will not be returned to any Entrant. As a condition of
entering into this promotion, each Entrant grants to Bupa a perpetual, unlimited license to: (a) use their entry in any way they see fit, including
but not limited to publishing or displaying it in any media for any promotional, marketing or publicity purposes; and (b) granting the right to the
Promoter doing any of these things.
11.Entrants consent to Bupa and, acting in accordance with Bupa’s instructions, the Promoter using the Entrant’s name, likeness, image and/or voice in
the event they are the winner (including a photograph, film and/or recording of the same) in any media for an unlimited period without remuneration
for the purpose of promoting this promotion (including any outcome of the promotion) and/or promoting any products manufactured, distributed and/or
supplied by Bupa.
12.If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the
reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law, to: (a)
disqualify any Entrant; or (b) modify, suspend, terminate or cancel the promotion, as appropriate.
13.Except for any liability that cannot be excluded by law, the Promoter, Life Education and Bupa (including their respective officers, employees and
agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct,
indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a)
any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party
interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter)
due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e)
any tax liability incurred by a winner or Entrant or prize taker; or (f) use of the prize. It is a condition of accepting the prize, that the winner
may be required to sign a legal release in a form determined by the Promoter.
14.The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to Bupa and other
third parties, including but not limited to agents, contractors and prize suppliers. Entry is conditional on providing this information. Bupa may, for
an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including
sending electronic messages or telephoning the Entrant. The Promoter’s use of personal information is strictly limited to occasions related to the
Bupa Family Challenge and/or this promotion and all uses are subject to the approval of Bupa. Entrants should direct any request to access, update or
correct information to the Promoter.
