CONDITIONS OF ENTRY
Information on how to enter and about prizes form part of these Conditions of Entry. Participating in this promotion is deemed acceptance of these
Conditions of Entry.
Entry is only open to residents of Australia who are aged 18 years or over. Employees and their immediate families of the Promoter and their agencies
associated with this promotion are ineligible to enter.
The promotion commences at 10am on the 15 October 2008 and closes at 11:59pm on the 29th December 2008 (“Promotion Period”). All times indicated are
either AEST or AEDST as applicable.
To be eligible to enter the promotion, consumers must purchase a specially marked 6 pack of SLATE 375ml RTD cans, specially marked 4 pack of SLATE
330ml RTD bottles or specially marked SLATE 700ml full strength bottled spirit or specially marked SLATE 18 pack of 375ml RTD cans from a
participating venue during the Promotion Period.
There are 2 components to this promotion namely the Major prize draw and the Instant Win component. Each valid entry received will be entered into the
Major Prize draw, and will have the chance to Win Instantly.

Instant Win Component
There are 75 Big Day Out Double Passes to be won instantly. (15 each for the GOLD COAST, SYDNEY, MELBOURNE, ADELAIDE and PERTH) Festival tickets won
will be for the winners nearest Big Day Out Music Festival, based on information submitted upon entry, as determined by the Promoter in its sole
discretion. The Promoter reserves the right to substitute another festival for any reason in its sole discretion. RRP $132.00 each. Total Big Day Out
Tickets Giveaway prize pool is $19,800.
Instant prizewinners will be notified instantly either by return email or SMS (depending on method of entry) and winners or prizes valued in
excess of $100 will have their names published in The Australian on 15th January 2009 and will be provided with details on how to redeem their prize.
Major Prize
The first 3 valid entries drawn from all entries received during the Promotion Period will each receive a European holiday for 2 to the value of
$15,000. Trip must be booked through the Promoter’s nominated travel agent, and may include airfares, accommodation, transfers or other transport, as
arranged through the travel agent. Destination will be the winner’s choice of European city. Where possible, the promoter and their travel agent
will endeavor to provide the winners with 2 tickets to a local music festival (if any) in the winner’s destination city. Festival tickets are subject
to availability and the Promoter will not be responsible if festival tickets to the winner’s preferred festival are not available. If the promoter is
able to provide Festival tickets, the ticket cost will be included in the $15,000 max prize total.
All major prize draws will take place at 11am on the 12th January 2009 at Communicator Interactive, Level 8, 9-13 Young Street Sydney NSW 2000.
The Promoter reserves the right, at any time during or after the closing date of the promotion to verify the validity of entries and to disqualify any
entrant who tampers with the entry process or who submits an entry that is not in accordance with these Conditions of Entry. Failure of the Promoter
to enforce any of its rights at any stage does not constitute a waiver of those rights.
Multiple entries permitted, subject to the following: (a) unique code valid for only one entry; (b) unrecognized codes will be deemed invalid; and (c)
each entry must be submitted separately and in accordance with the entry requirements. Limit of 2 entries per person per day.
Entrants must retain original specially marked pack(s) or bottle necktag(s) (as the case may be) clearly showing the unique code/s used to enter for
each entry made as proof of purchase. Failure to produce the original specially marked pack(s) for all entries upon request may, in the absolute
discretion of the Promoter, result in invalidation of all of an entrant’s entries and forfeiture of any right to a prize.
All winners will be notified by either SMS or email (depending on method of entry) and winners of prizes valued at in excess of $100 will have their
names published in The Australian on 15th January 2009. The Promoter’s decision is final and no correspondence will be entered into.
No responsibility accepted for late or misdirected entries. Incomplete or indecipherable entries will be deemed invalid. Entries are deemed to be
received at the time of receipt in the SLATE European Tour & Big Day Out Promotion database and NOT at the time of transmission by the entrant
SMS entries are charged at no more than 55 cents (including GST per entry). Entrants must have premium service access to enter by SMS. Entrants should
check with their individual provider. SMS winners will be contacted by SMS and/or phone and the Promoter will record their address details so that the
prize may be awarded. Service Provider is Communicator Interactive, Level 8, 9-13 Young Street, Sydney.
Major Prize (including flights and accommodation) must be taken on dates as specified by the promoter. All travel must be booked by 12th May 2009 and
must be completed by 15th September 2009, and is subject to, blackout dates, booking and flight availability. Blackout dates are 13th January 2009 to
15th May 2009; during this time no travel will be permitted. Total prize, all-inclusive, must not exceed the value of $15,000. The Promoter is not
responsible for any delays or cancellations of flights nor the malfunction of any ground services provided to the prizewinner and their guest.
The prize does not (except as expressly stated) include: (i) transfers; (ii) other transport or accommodation; (iii) meals or beverages; (iv) airport
taxes or arrival or departure taxes; (v) incidental hotel charges (such as mini-bar charges, telephone calls, in house movies, food and beverages);
(vi) spending money; (vii) insurance (such as travel or health cover); (viii) vaccinations or other medical or health related services; (ix) any other
ancillary costs which may be incurred by the winner or their guest in relation to the prize trip. Visas, passports, and all entry, exit, health or
other documents required by law, regulations, orders, demands or requirements of the countries visited or transited are the responsibility of the
winner.
The Promoter will not be responsible for the cancellation or delay of The Big Day Out Music Festival in any state or any part thereof, or the
non-appearance by any one or more of the scheduled performers.
There will be a total of 3 Major Prizes to be won and 75 instant winners. Total prize pool for the promotion has a maximum value of $64,800. Total
max potential winners per state: NSW/ACT: 18, VIC/TAS: 18, SA: 18,, QLD: 18, and WA: 18. Total max prize pool per state is as follows: NSW/ACT:
$48,960, VIC/TAS: $48,960, SA: $48,960, QLD: $48,960, and WA: $48,960, The Promoter accepts no responsibility for any variation in the prize value.
Prizes, including any unused portion, are not transferable or exchangeable or redeemable for cash or other goods or services and cannot be taken as
cash. Prizes cannot be transferred to any other person, unless agreed to by the Promoter.
Entries via SMS will only be accepted from mobile phones. SMS entries via the Internet are ineligible. The use of any automated entry software or any
other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted
invalid.
If for any reason this competition is not capable of running as planned including (but not limited to) infection by computer virus, bugs, tampering,
unauthorised intervention, fraud, technical failures, war, terrorism or any other causes beyond the control of the Promoter which corrupts or affect
the administration security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to
disqualify any entrant who tampers with the entry process, and to cancel, terminate, modify or suspend the promotion subject to state regulations.
The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or website user or for any of the
equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the
course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission,
communications line or telephone, mobile or satellite network failure, technical problems or traffic congestion on the Internet or website, software
failure, theft or destruction or unauthorised access to or alteration of entries and any injury or damage to participants or any other person’s
computer related to or resulting from participation in or down-loading any materials in this competition.
All Major Prizes must be claimed by 12th April 2009 and if the major prize remains unclaimed by such date, the Promoter may conduct such further draws
at the same place as the original draw as are necessary after 11am on 13th April 2009 in order to distribute any unclaimed major prizes, or if no
longer available a prize of equivalent value, subject however to any written directions given under all State Regulations. Unclaimed prize draw
winners will be notified by either SMS or email (depending on method of entry) and winners of prizes valued at in excess of $100 will have their names
published in The Australian on 16th April 2009.
All Instant Win Prizes must be claimed by 5th January 2009, (unless the winner is a resident of SA) and if the prize remains unclaimed by such date,
the Promoter may conduct such further draws at the same place as the original draw as are necessary after 10am on the 6th January 2009 in order to
distribute any unclaimed major prizes, or if no longer available a prize of equivalent value, subject however to any written directions given under
all state regulations. Unclaimed prize draw winners will be notified by either SMS or email (depending on method of entry) and winners of prizes
valued in excess of $100 will have their names published in The Australian on 15th January 2009.
If for any reason a major prizewinner cannot take a prize or any part of a prize in accordance to these terms and conditions, including at the time
specified by the Promoter, the prize will be forfeited and will not be redeemable for cash.
If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the
prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
It is a condition of accepting the prize that winners and their nominated companion to take the prize will, upon request by the Promoter, be required
to sign a legal release and indemnity in a form to be determined by the Promoter. The prize winner and their guest(s) (where applicable) must each be
18 years or age or older and will, upon request by the Promoter, be required to provide identification satisfactory to the Promoter to verify same.
Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including
negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential,
arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or
equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or
prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the
reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the event is cancelled for
any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) use of a prize.
The Promoter may photograph, video and/or film the winners of the SLATE European Tour & Big Day Out Promotion or any other activity in connection
with the prize. Winners acknowledge that the Promoter has the right to use such publicity photos, videos and/or films in any medium and in any
reasonable manner it sees fit without further permission from or payment to winners.
The Promoter encourages consumers to enjoy drinking SLATE responsibly. Legal aged consumers are advised to consider the safe drinking levels
recommended in the National Health & Medical Research Council Australian Alcohol Guidelines that are: Know your drink, drink responsibly.
All entries remain the property of the Promoter. The Promoter collects entrants’ personal information in order to conduct the promotion. If the
information requested is not provided, the entrant may not participate in the promotion. By entering the promotion, unless otherwise advised, each
entrant also agrees that the Promoter may use this information, or disclose it to other organisations that may use it, in any media for future
promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant. Entrants’ personal
information may be disclosed to State and Territory lottery departments and winners’ names published as required under the relevant lottery
legislation. A request to access, update or correct any information should be directed to the Promoter at their address set out below.
Entrants grant the Promoter permission to communicate with them by email and/or SMS in order to provide details of the prize and/or instructions as to
how the winner is to claim the prize and establish his/her entitlement to it.
