JUST-SHOP "Play It Your Way" Terms & Conditions
Information on how to enter forms part of these terms and conditions. Entry into the competition constitutes acceptance of these terms and conditions and an acknowledgement that this is part of the JUST-SHOP loyalty program; which is governed by the JUST-SHOP Membership Terms and Conditions (available at Participating Just Jeans Stores and at www.justjeans.com.au).
The promoter is Just Jeans Pty Ltd, 658 Church Street Richmond VIC 3121. ACN 72 004 890 057 (“Just Jeans”)
This promotion commences at 9.00am (AEST) Monday, 5th January 2009 and closes at 5.00pm (AEST) Sunday, 25th January 2009 ("Promotional Period")..
“Participating Just Jeans Stores” means all Just Jeans stores in Australia (excluding Just Jeans online and factory outlets).
To be eligible for entry a person must be a resident of Australia and a valid JUST-SHOP Cardholder. Employees of Just Jeans and/or their related entities are not eligible to enter this Competition (“Valid Members”).
All Valid Members who make a purchase at a Participating Just Jeans store during the Promotional Period and present their JUST-SHOP card at the time of making the purchase, will have the opportunity to enter the competition and will receive a Unique Entry Code with instructions on how to enter (“Eligible JUST-SHOP Members
7.1. 'Valid' JUST-SHOP members who make a Qualifying Purchase, will receive a voucher with a unique Competition Entry Code and instructions on how to enter. An Eligible JUST-SHOP Member can enter the Major Prize draw, by:
Providing their full name, unique Competition Entry Code, and JUST-SHOP membership card number (found on the front of their membership card) electronically via www.just-shop.com.au
7.2. All entries must be received by Just Jeans Pty Ltd before 11:59pm AEST on Tuesday 27h January 2009. One entry per Qualifying Purchase is permitted.
7.3. There is one Major Prize to be won of a trip for two to Mauritius, including:
Economy Class Return Airfares to Mauritius from the winners nearest capital city
Return airport transfers in Mauritius
Six (6) nights at the 4+ star Le Victoria Hotel in a Deluxe Room
Breakfast daily at the Resort
Selection of free water and land sports including waterskiing, sailing, wind-surfing, pedal boats, snorkelling, tennis, use of gymnasium
Nightly entertainment: resident band, live music, night club, sega show etc
7.4. The total value of the Major Prize is up to $9,000 depending on the winner’s state of residence.
7.5. The winner must book their holiday within six weeks of being notified of their win. The prizewinner must take the prize during the dates stipulated by the Promoter. Travel must take place between 01 February and 08 April, 2009 or 15 April and 30 September, 2009, subject to availability. Travel outside of these dates is not permitted.
7.6. Both air and land must be booked simultaneously and directly with Beachcomber Tours on Telephone: 1800 624 268. Dinner Package can be pre-purchased when booking trip, or paid direct on an individual basis at the hotel. All-in-One (all inclusive) package can be purchased only at the time of booking. Travel and inclusions are subject to the terms and conditions of the current Beachcomber Tours Mauritius brochure. 7.7. Additional spending money, meals, insurance, taxes, passports, visas, local payment, items of a personal nature, inoculations, travel to and from departure point, and all other ancillary costs are the responsibility of the winner. Unless expressly stated all other expenses become the responsibility of the winner.
7.8. The winner of the prize (and their travel companions) will not accrue any frequent flyer points from taking the prize.
7.9. Any requested changes made after the initial booking is confirmed will incur a ‘Change Fee.’
7.10. Travel Insurance is not included. It is the traveller’s personal responsibility to ensure that they have valid documentation, including but not limited to valid passports, visas, and health requirements, which meet the requirements of immigration and other government authorities at every destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the traveller/s.
7.11. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize. The prize is non-transferable and non-redeemable for cash and non-upgradeable. Any attempt to resell or auction all or any part of this prize will result in an immediate cancellation of the prize. The Prize cannot be exchanged for another tour.
7.12. The prize elements may be terminated without notice if these terms and conditions are not complied with subject to written instruction from state regulatory bodies.
7.13. The Major Prize draw will take place at 9.00am AEST on Wednesday 28th January 2009, at Visible Results, Unit 1, 10-20 McEvoy Street, Waterloo, New South Wales. There will be one winner, who will be notified by telephone and mail, and his or her name will be published in The Australian newspaper on Friday 30th January 2009.
7.14. If the Major Prize is unclaimed or a winning entrant is unable to satisfy these terms and conditions by 3:00pm AEST on Wednesday 25th April 2009, then a draw will take place at 2.00pm AEST on Friday 27th April 2009 at Visible Results, Unit A, 10-20 McEvoy Street, Waterloo, New South Wales, subject to permission from Department of Gaming and Racing (NSW). All valid Eligible Persons who made purchases as set out in clause 7 above during the Promotional Period will be in this draw. There will be one winner if an unclaimed prize draw is necessary who will be notified by telephone and mail and his or her name and suburb will be published in The Australian newspaper on Tuesday 1st May 2009.
7.15. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, including any injury or damage to participants or any other person’s computer related to or resulting from participation in or down-loading any materials in this promotion.
The total value of all prizes for JUST-SHOP ‘Play It Your Way’ Competition is up to $9,000.00.
Prize values are correct at the time of printing and are subject to change without notice. Just Jeans Pty Ltd accepts no responsibility for changes to prize values.
All prizes are not exchangeable, transferable or redeemable for cash or other goods or services.
Any tax implications for Eligible Persons, which may arise from this promotion are the responsibility of the Eligible Persons, and independent advice should be sought.
In conducting this promotion Just Jeans Pty Ltd:
will use your name and contact information collected from you for purposes relating to and arising from this promotion;
will publish all prize winner’s names and their suburb and the names of all winners and their suburb following any unclaimed prize draw;
may require the winner of the prize to provide proof of identity and age;
will not be liable for any loss or damage resulting from incorrect details being provided by entrants; and
may otherwise use and disclose the entrant’s personal contact information as required or authorised by law.
may publish the winner’s full name, suburb and state of residence on www.justjeans.com.au for a period of one month and on one JUST-SHOP e-newsletter to be sent to the entire JUST-SHOP email membership base.
Just Jeans and its respective related bodies corporate, officers, employees and agents will not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss), or for personal injury suffered or sustained in connection with this competition, the promotion of this competition or the use of the prize, except for any liability that cannot be excluded by law.
