The Promoter is Haven Licensing Pty Ltd of 26 Hutchinson Street, Surry Hills NSW 2010, ABN 82 008 490 159.
All relevant instructions on the Roary the Racing Car (TV show) website (www.roarytheracingcar.com) (the Roary Website) form part of these Terms and Conditions.
This competition is open to Australian residents between the ages of 1 and 80 only. Haven Licensing employees and their immediate families and any organisation or individual associated with the provision of the prize/s are ineligible to enter.
By entering the competition, each entrant agrees to be bound by these Terms and Conditions.
The competition commences on Monday, November 3rd 2008 at 9am AEST and closes Friday, January 30th 2009 at 6pm AEST. Entries received after the closing date and time will be deemed invalid. No responsibility is accepted for last, lost, delayed or misdirected entries.
Roary the Racing Car merchandise needs to be purchased (to any value) from any retailer in Australia to enter the competition. Entrants must retain proof of purchase for entry into the Promotion. , entrants must write in 25 words or less on the official entry form [available from the Roary Website and entry-pads in-store] why they would like to meet Roary the Racing Car and Big Chris at the 2009 FORMULA 1TM ING Australian Grand Prix (the Event), along with attaching a copy of the receipt for their Roary the Racing Car merchandise they have purchased. Entries over 25 words will not be valid. Entrants must also fill in their name, address and contact telephone (e-mail address if possible), then post it to Haven Licensing by pre-paid post to: Roary the Racing Car Grand Prix 09 Competition, 26 Hutchinson Street, Surry Hills NSW 2010. All entries become and remain the property of the Promoter. and the Australian Grand Prix Corporation (AGPC).
Multiple entries are permitted providing that each entry is associated with a separate purchase of Roary merchandise and includes a separate receipt as proof of purchase.
Children are eligible to enter the competition only with the consent of their parent/guardian which must be indicated by the parent/guardian signing the entry form.
Five (5) winners will each receive a family holiday to the 2009 FORMULA 1TM ING Australian Grand Prix which includes return economy class Qantas airfares from each winner’s nearest capital city to Melbourne (excluding Victorian residents) for two (2) adults and two (2) children (aged 12 and under) up to the value of $3,300.00; four (4) nights’ accommodation in a 3-star hotel including breakfast up to the value of $2500.00; all travel related sales taxes and service tax (subject to availability and permissions); tickets to the 2009 FORMULA 1TM ING Australian Grand Prix and seating in the Fangio Grandstand for four days for two (2) adults and two (2) children (aged 12 and under) valued at $1076.00 a special tour of Pit Lane for two (2) adults and two (2) children (aged 12 and under) valued at approximately $1,000.00 a merchandise pack including RC Roary valued at $59.99, a book pack valued at $46.94, a Roary DVD valued at $19.95 and 2009 FORMULA 1TM ING Australian Grand Prix merchandise to the value of $250. The total value of the merchandise pack is $376.88.
Also included is a meet and greet with Roary the Racing Car & Big Chris at the 2009 FORMULA 1TM ING Australian Grand Prix. Total prize based on two (2) adults and two (2) children (aged 12 and under) valued up to approximately AUD $8252.88 inc GST. Frequent flyer points do not form part of this prize. If the winner is under the age of 18 years, the prize will be awarded to the winner's parent/guardian on their behalf.
Ten (10) runners up will each receive a Mega Roary Pack including a RC Roary valued at $59.99, a book pack valued at $46.94 and a Roary DVD valued at $19.95. The total value of the Mega Roary pack is $126.88.
No component of the prize can be transferred or redeemed for cash. All prizes are subject to availability. The Promoter and AGPC accept no responsibility for any variation in the prize value.
Flights and accommodation are subject to availability at the time of booking. Additional spending money, meals, taxes, transport to and from departure point, additional transfers, insurance and all other ancillary costs are the responsibility of the winner. It is a condition of accepting the prize that all components of the prize must be taken during the trip and all persons taking the trip depart from and return to the winner's nearest capital city (excluding Victorian residents) at the same time unless otherwise agreed by the Promoter. All persons taking the trip sign a waiver of liability and an indemnity in a form determined by the Promoter and AGPC in their absolute discretion.
Trip prize must be taken on Wednesday, 25th March 2009 and trip bookings must be confirmed by Tuesday, 3rd March 2009.
This is a game of skill. Chance plays no part in determining the winner. Entries will be individually judged and assessed by the Promoter’s panel of judges for their quality and creativity. Judging of the entries will take place at the Promoters premises between Monday February 2nd, 2008 and Friday February 6th, 2008. The five (5) entries judged the most original and creative nation wide will win the five (5) major prizes, and a further ten (10) entries will be chosen from the remaining entries for the Mega Roary Pack. The Judges’ decision is final and no correspondence will be entered into.
Where possible the winners will be notified within five (5) working days and no more than seven (7) working days of the judges’ decision. Winners will be notified by telephone or mail and their names will be published on the internet at www.roarytheracingcar.com on February 10, 2009.
If the winners of the Mega Roary Pack prizes do not claim their prizes within two (2) months of being notified, further judging of the remaining entries will be conducted. The drawn result is final and no correspondence will be entered into. Where possible the winners will be notified within five (5) working days and no more than seven (7) working days of the judges’ decision. Winners will be notified by telephone or mail . Further judging of the remaining entries relate only to the Mega Roary Pack and not to the major prizes.
If there is any event that prevents or hinders the Promoter’s conduct of this competition or the Promoter’s or AGPC’s ability to deliver the prize(s) to the winner(s) of this competition, the Promoter may, at its absolute discretion, offer another prize of similar value to the winner or cancel this competition and recommence it at another time under the same conditions or select another winner.
Neither the Promoter nor AGPC shall be liable for any loss or damage whatsoever (including but not limited to indirect or consequential loss, including loss of profits or loss of earnings) or personal injury suffered or sustained arising from or in connection with the competition, any omission to enter a person into the draw, acceptance of the prize or the prize itself, except for liability which cannot be excluded by law. Both the Promoter and AGPC accept no responsibility in the event that the Event is cancelled, or the Event dates are re-scheduled for any reason beyond the control of AGPC. By entering this Promotion, each entrant who wins a prize that includes entry to the 2009 FORMULA 1™ ING Australian Grand Prix, and any other person who shares the prize with the winning entrant (Winning Entrant) (whom the Winning Entrant must make aware of these Conditions), must comply with the Conditions of Entry and Conditions of Sale to the 2009 FORMULA 1™ ING Australian Grand Prix (posted at the entry to the Grand Prix circuit and also available at www.grandprix.com.au or by calling AGPC on 03 9258 7100) and reproduced below.
ENTRANTS ARE REMINDED AND AGREE, ACCEPT AND ACKNOWLEDGE THAT MOTOR RACING, THE EVENT AND CERTAIN ACTIVITIES ASSOCIATED THEREWITH (INCLUDING, WITHOUT LIMITATION, PARTICIPATION IN THE PRIZE) ARE DANGEROUS AND ACCIDENTS CAN HAPPEN.
Entrants are warned that there is a possibility of an accident causing injury, death or property damage or loss and attendance at the Event and participation in the prize is at entrants’ own risk. Entrants acknowledge that the risks associated with attending the Event and participating in the prize include but are not limited to the risk of suffering harm as a result of cars (or parts of them) colliding with other cars, persons or property. Entrants acknowledge that entry to and remaining at the Event and participating in the prize has a degree of danger and, to the extent permitted by law (in particular sections 32J and 32JA of the Fair Trading Act 1999 (Vic) and section 74 of the Trade Practices Act 1974 (Cth)), hereby exclude, release and forever discharge the Promoter, AGPC the Crown in right of the State of Victoria, the Minister administering the Australian Grands Prix Act 1994 (Vic), the Minister administering the Crown Land (Reserves) Act 1978 (Vic), Fédération Internationale de l'Automobile, Formula One Administration Limited, Formula One Management Limited, Confederation of Australian Motor Sport Limited, Parks Victoria, the State Sports Centres Trust, Kellogg Brown & Root Pty Ltd, Event sponsors and all other persons involved in the organisation, conduct and promotion of the Event or the prize (Associated Entities) from all liability for claims, loss, damage, costs or expenses arising from any personal injury or death (whether arising from negligence (but excluding gross negligence) or otherwise), arising from or connected with participation in Recreational Services (as defined below) at the Event (including the prize) including but not limited to: any technical difficulties or equipment malfunction (whether or not under the Promoter’s or AGPC’s control); any theft, unauthorised access or third party interference; any entry or prize claim that is late, lost, altered, damaged or misdirected due to any reason beyond the reasonable control of the Promoter or AGPC; any variation in prize value to that stated in these Conditions; or any tax liability incurred by a winner or entrant. Each Winning Entrant must, on request of AGPC, execute any and all documentation (if any) necessary to give effect to this clause.
To the extent permitted by law (in particular sections 32J and 32JA of the Fair Trading Act 1999 (Vic) and section 74 of the Trade Practices Act 1974 (Cth)), entrants acknowledge that, to the extent to which they participate at the Event in:
- a sporting activity or similar leisure time pursuit; or
- an activity that:
- involves a significant degree of physical exertion or physical risk; and
- is undertaken for the purposes of recreation, enjoyment or leisure,
including, without limitation, participation in the prize, the Associated Entities do not make any warranty that the Recreational Services at the Event, including the prize, will be provided with due care and skill or that any materials provided in connection with the Recreational Services, including the prize, will be fit for the purposes for which they are supplied. Entrants acknowledge that, to the extent that any warranty is implied it is excluded to the full extent permitted by law.
WARNING: If you participate in these activities your rights to sue the supplier under the Fair Trading Act 1999 if you are killed or injured because the activities were not supplied with due care and skill or were not reasonably fit for their purpose, are excluded, restricted or modified in the way set out in this notice.
NOTE: The change to your rights as set out in this notice, does not apply if your death or injury is due to gross negligence on the supplier’s part. “Gross negligence” is defined in the Fair Trading (Recreational Services) Regulations 2004.
For the purpose of this Condition 21 “the supplier” shall mean and include the Associated Entities.
Without limiting any other release or limitation of liability contained in the Conditions, the Associated Entities will not be liable for any indirect or consequential loss suffered by any Entrant caused by any acts or omissions of the Associated Entities, their directors, employees, agents and contractors arising out of or in relation to the Event or the prize.
Nothing in this Condition 21 or these Conditions generally affects your rights under the Trade Practices Act 1974 (Cth), Fair Trading Act 1999 (Vic) or similar legislation regarding implied conditions and warranties to the extent that such implied conditions and warranties cannot be excluded by law.
