Terms and conditions of the YourTradingEdge readership survey 2008.

1.Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms & Conditions.
2.Entry is open to all residents of Australia.
3.Employees of the Promoter (promoter means YTE and any officers, employees and agents, Bell Direct and their officers, employees and agents) and their immediate families and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, stepparent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, stepbrother, stepsister or 1st cousin.
4.Incomplete entries will be deemed invalid.
5.Multiple entries by a single individual are not permitted.
6.The promotion commences 27/10/08 and closes at 11:59pm AEDST on 23/02/09. The prize will be awarded to the respondent with the most comprehensive answers to the questions; this will be judged by a panel comprising of Bell Direct and YourTradingEdge experts and as such is not a competition based on luck but knowledge and skill.
7.The respondent with the most comprehensive answers who is judged to be the winner will receive an Apple iPhone valued at AUD$750, a AUD$1,000 trading account with Bell Direct with their first five trades free (valued at AUD$75) and a 24 month/12 issue subscription to YourTradingEdge valued at AUD$96.70. Total value of the prize is AUD$1921.70.
8.The winner will be decided at the Promoter's office on 24th February 2009 at 12pm AEDST. The winner will be notified by telephone and mail, with their name to be published in the May/Jun 2009 issue of YTE and on the YTE website www.yte.com.au on the 24/02/09.
9.Promoter's decision is final and no correspondence will be entered into.
10.The second, third, fourth and fifth place getters as deemed by the panel of judges, will receive a 12 month (6 issue) subscription to YourTradingEdge valued at AUD$51.20.
11.All prizewinners must be over the age of 18.
12.Prize is not transferable or exchangeable and cannot be taken as cash.
13.If the prizewinner is a current YTE subscriber, their subscription will be extended for the appropriate period.
14.Subject to the prize being unclaimed, the original winner will forfeit their position and the prize will be given to the second best answer to the qualifying question (as above)
15.Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorized access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; and/or (f) use of or redemption of the prize.
16. In the event of unforeseen circumstances, the promoter reserves the right to offer an alternative prize of equal or greater value.
17.In the event of war, terrorism, state of emergency or disaster (including natural disaster), the Promoter reserves the right to cancel, terminate, modify or suspend the promotion, as appropriate.
18.If the required information requested is not provided, the entrant may not participate in the promotion. By entering the promotion, each entrant agrees that the Promoter may disclose entrants' personal information to third parties, including but not limited to agents, prize suppliers and, as required, the Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. By entering this promotion, all entrants will be deemed to have accepted these Terms and Conditions.
19.Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration, for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
20.If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
21.Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
22.The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
23.The Promoter reserves the right to verify the validity of all entries (including an entrant's identity, age and place of residence) and to disqualify any entrant who tampers with the entry process, or who submits an entry that is not in accordance with these Terms and Conditions. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
24.All entries become property of the Promoter, the collection, use and disclosure of all personal information collected in connection with this promotion are governed by the Promoters’ Privacy Notice.
25.By entering the promotion, unless otherwise advised by the entrant, each entrant consents to the information they submit being entered into a database and the Promoter may, for an indefinite period, unless otherwise advised, use this information in any media for future promotional, marketing and publicity purposes, including sending electronic messages or telephoning the entrant. Without any further reference or payment or other compensation to the entrant.
26.As a condition of accepting the prize, the winner must sign any legal documentation required by the Promoter and/or prize suppliers, including but not limited to a legal release and indemnity form.
