TERMS AND CONDITIONS

By entering The Daily Telegraph Sydney Swans Season Launch Promotion you are agreeing to the following terms and conditions:

1. STANDARD TERMS
1.1 Information on how to enter forms part of the terms of entry. Entry into the promotion is deemed acceptance of these conditions of entry.

2. WHO CAN ENTER
2.1 Subject to clause 2.2 entry is open to all residents of New South Wales.
2.2 Directors, Management, Employees and their immediate families of Nationwide News, Sydney Swans and their associated agencies and companies are not eligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether by natural or adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.

3. HOW TO ENTER
3.1 The competition commences on Saturday 28 March 2009 at 00:01 (AEDT) and concludes on Wednesday 1 April 2009 at 23:59 (AEDT) (‘the Competition Period’).
3.2 In order to enter the competition, entrants must log on to dailytelegraph.com.au during the competition period, locate the promotion link for the competition and tell us in 50 words or less what you are prepared to do to be the greatest Sydney Swans supporter.
3.3 Entrants (including winners) in the competition may enter as many times as they like, however only one prize per person is permitted. Prizes are non-transferable.
3.4 The time of entry will, in each case, be the time that the email entry is received by the Nationwide News servers.
3.5 The Promoter, its agents, affiliates or representatives will not be liable for any lost, late or misdirected entries.
3.6 Entrants under the age of 18 years must obtain the prior permission of a parent or guardian over the age of 18 years before entering the competition.

4. PRIZES
4.1 The major prize winner will receive two (2) adult silver memberships (valued at a total of $600) and the following throughout the 2009 AFL season at the proposed rounds:
(a) Round 2 (4 April): Sydney Swans merchandise pack for two. Valued at $400
(b) Round 4 (18 April): Access to an 8-seat Corporate Box for one match (un-catered). Valued at $2000
(c) Round 6 (3 May): Access to the Sydney Swans after match function (for 2 people that must be over the age of 18). Valued at $200
(d) Round 8 (16 May): A tour of ANZ Stadium (for 2 people; tour to take place pre-match). Valued at $57
(e) Round 9 (24 May): Opportunity to nominate a Sydney Swans Mascot for the Day (must be aged 6 – 12 years). Valued at $150 (cost of football outfit) + money cant buy (experience)
(f) Round 12 (20 June): Sydney Swans change room visit post match (for 2 people). Valued at “money cant buy”
(g) Round 14 (5 July): Opportunity to hold the windbreak at quarter breaks on field (for 2 people). Valued at “money cant buy”
(h) Round 15 (11 July): Opportunity to hold the banner with the Cheer Squad as players run onto field (for 2 people). Valued at “money cant buy”
(i) Round 18 (1 August): A Sydney Swans guernsey signed by the 2009 team presented at a match by a Sydney Swans injured player. Valued at $109 plus money cant buy
(j) Round 20 (15 August): A tour of the Sydney Swans offices (mid week) (for up to 4 people). Valued at money cant buy
(k) Round 21 (29 August): Red Zone guest passes for 10 friends. Valued at $390
The proposed rounds for prize redemption is subject to change by the Sydney Swans throughout the 2009 Season.
TOTAL MAJOR PRIZE VALUE: $3906, plus money can’t buy elements.
4.3 The major prize winner and their guests are responsible for all other expenses including but not limited to catering, transport, spending money. All other ancillary and travel costs are the major prize winner’s responsibility.
4.4 It is a condition of accepting the prizes that the winners must comply with the conditions of use of the prize and the prize supplier’s requirements.
4.5 Prizes cannot be transferred, exchanged or redeemed for cash. In the event that the winner does not take the prizes in the time stipulated, then the prize will be forfeited by the winner and cash will not be awarded in lieu of the prize. Prizes must be taken as offered and cannot be varied. Any unused portion of the prize is not-transferable, non-refundable and non-redeemable for other goods or services and cannot be taken as cash.
4.6 The prizes must be taken as stated and no compensation will be payable is a winner is unable to use the prize as stated. If a winner is unable to satisfy these terms and conditions or a prize is not utilised or able to be taken, then the prize will be forfeited by the winner and cash will not be awarded in lieu.
4.7 The prizes cannot be transferred, exchanged or redeemed for cash.
4.8 The winners must, on the request of the Promoter, be able to provide evidence which, to the reasonable satisfaction of the Promoter, demonstrates that the winner is an eligible entrant (as per clause 2.1 and 2.2) and has complied with these terms and conditions.
4.9 The Promoter accepts no responsibility for any variations in the value of the prizes as quoted in the terms and conditions.
4.10 In participating in the prizes, the winners agree to participate and co-operate as required in all editorial activities relating to this promotion, including but not limited to being interviewed and photographed. The winners grant the Promoter a perpetual and non-exclusive licence to use such footage and photographs in all media world wide and the winners will not be entitled to any fee for such use.
4.11 The winners agree that they will not sell or otherwise provide their story and / or photographs to any media or other organisation.

5. HOW TO WIN
5.1 One (1) major prize winner will be judged from all valid entries received. The winning entry will be the entry that judges deem to be unique, entertaining and engaging. The selection will take place at Nationwide News, Level 4, 2 Holt Street, Surry Hills NSW 2010 Thursday, 2 April at 10:00 (AEDT).
5.2 The prize winner will be notified by mail and their name will be published in The Daily Telegraph Public Notices on Saturday, 4 April 2009.
5.3 The Promoter’s decision is final and the Promoter will not enter into the correspondence regarding the result.
5.4 It is a condition of accepting the prize that the winners may be required to sign a legal release, in a form determined by the Promoter in its absolute discretion.
5.5 Subject to any written directions given under regulation 37 of the Lottery and Gaming Regulation 1993 (SA), an unclaimed prize draw will take place at Dialect Interactive, Level 17, 100 Arthur Street, North Sydney NSW 2060 on Friday, 3 April 2009 at 10:00 (AEST) and the winners will be published in the Public Notices section of The Daily Telegraph on Saturday, 4 April 2009.

6. NO LIABILITY
6.1 In case of intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, ware, acts of terrorism, the Promoter may, in its absolute discretion, cancel the competition and recommence it from the start on the same conditions, subject to State Legislation
6.2 Nationwide News, Sydney Swans and their associated agencies and companies will take no responsibility for prizes damaged or lost in transit, or late or misdirected mail. Once prizes have left the Promoter’s premises, the Promoter will not be responsible for any delay in delivery, or failure of safe delivery of prizes.
6.3 The winners participate in the prizes entirely at their own risk and acknowledge that Nationwide News, Sydney Swans and their associated agencies and companies will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur:
a) during the draw;
b) whilst undertaking any travel won or connected with their entry into the draw;
c) in participation in any prize;
d) as a consequence or late, lost or misdirected entries;
e) due to the broadcast of any program relating to the competition or the publication of any material, including statements made by any compere, staff member, journalist, other entrants or any other person;
f) in relation to failure of an email entry message to be received by the Promoter on account of technical problems of traffic decongestion;
g) arising from, or related to, an problem or technical malfunction of any telephone network or lines of mobile communication related to, or resulting from, participating in this promotion;
h) due to circumstances outside the Promoter’s reasonable control.
6.4 Nationwide News and Sydney Swans are not responsible for any problems or technical malfunctions of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, technical problems or traffic congestion of the Internet or at a web site, or any combination thereof, including but not limited to any injury or damage to the Eligible Entrants’ or any other person’s computer related to, or resulting from participating in, or downloading materials in this promotion. Neither is the Promoter responsible for any incorrect or inaccurate information, either caused by the phone user or ** any of the equipment or programming associated with, or utilised in this competition, including any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction of unauthorised access to, or alteration of, entries and reserves the right to take any action that may be available.
6.5 If for any reason, this competition is not capable of running as planned, due to causes including but not limited to tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition. The Promoter reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, take any action that may be available and to cancel, terminate, modify or suspend the competition.

7. PRIVACY CONSENT
7.1 To provide you with this promotion, the Promoter needs to collect personal information about each Eligible Entrant. If the Eligible Entrant does not provide the information requested, the Promoter may not be able to provide the Eligible Entrant with the promotion entry.
7.2 Each Eligible Entrant agrees that, subject to the Privacy Act, the Promoter or its agents may do the following:
a) transfer personal information confidentially to the Promoter or other organisations that provide services in relation to this promotion.
b) disclose Eligible Entrants’ personal information to State and Territory lottery departments.
c) and use prize winners’ personal information in any media for publicity purposes associated with the promotion, without any further payment or other compensation, unless the prize winner notifies the Promoter at the time of accepting the prize.

8.2 The Sponsor of this promotion is Sydney Swans.
8.3 Entry details remain the property of Nationwide News and its related entities. Collection of the Entrant’s personal information is for the purpose of conducting this competition (including but not limited to determining and notifying winners). The entrant’s personal information may be disclosed to Sydney Swans for this purpose. The entrant may request access to his or her personal information by contacting the Privacy Officer on (02) 9288 3213.
