When will the offer start and end?
The offer starts at 12.01am (AEST) on 05/07/21 and ends at 11.59pm (AEST) on 02/08/21 or when allocation of prizes has been exhausted,
whichever is first to occur (the Offer Period).
Who can claim?
Only Australian residents aged 13 or over can claim. If you are under 18, you must get approval from your parent/guardian before you claim.
Do I need to buy anything to claim?
Yes. You need to buy any two Bega products (from the list below) in one transaction from a retailer in Australia (Qualifying Purchase) (includes
online purchases).

For the avoidance of doubt, Qualifying Purchase products do not need to be specially marked.
Claim instructions
After you have made a Qualifying Purchase, you must be one of the first 400 people per day to lodge a valid claim during the Offer Period, on
begacreatorsclub.net.au (Website). When you are on the Website, follow the links to fill out and submit the online claim form, including by providing
the last four digits of the Qualifying Purchase product barcodes and all other requested information and make an online payment of $5.00 for postage
and handling.
Prize allocation
There are up to 400 prizes available per day (200 of each prize) of the Offer Period, with up to 11,600 prizes available in total throughout the
Offer Period.
If you have submitted one of the first 400 valid claims received by the Promoter (including having paid for the postage and handling) on each day of
the Offer Period, you will receive a prize.
If the daily prize allocation has been exhausted at the time you submit your claim, the Website will prompt you to return on the next day of the Offer
Period for another opportunity to claim a prize, in accordance with the "Claim instructions" above. If fewer than 400 prizes are successfully claimed
on any day during the Offer Period, the Promoter may award any remaining prize/s to qualifying claims at another time during the Offer Period in
accordance with these Terms and Conditions and subject to demand.
Prizes
Each prize is a child's lunch bag with a customisable front panel valued at $15 or a child’s drink bottle with a customisable front panel valued at
$20.
There is a total of 5,800 lunch bags and 5,800 drink bottles available throughout the Offer Period.
At the time of submitting a claim, you will be able to choose between a lunch bag or drink bottle (subject to availability). After making your
selection, you must follow the instructions to customise the front panel of the lunch bag or drink bottle or to select one of the prepared front panel
options (which are subject to change). You are responsible for carefully checking your lunch bag or drink bottle customisation before submitting your
claim. The Promoter is not responsible for claimant error in this regard. See paragraphs 3 and 4 for further conditions and details regarding
customising your lunch bag or drink bottle.
Total prize pool
The total value of the prize pool is up to $203,000.
How many prizes can I claim?
Over the entire Offer Period, you can submit a total of up to 4 prize claims per household. Each claim must be based on a separate Qualifying
Purchase, a separate claim form and a separate $5.00 postage and handling payment.
How and when will the successful claimants be informed?
If you are a successful claimant, you will be informed in writing on screen at the time of submitting your claim form.
Must I keep anything to verify my claim?
You must keep your original purchase receipt(s) and Qualifying Purchase product(s) barcodes for all claims as proof of purchase. If you don't produce
the proof of purchase for all claims when asked the Promoter may disqualify all of your claims and you will lose any right to a prize. Purchase
receipt(s) must clearly identify the product(s) purchased (which must comprise a Qualifying Purchase), and must correspond to the Qualifying Purchase
products used to submit your claim. If, in the Promoter's opinion, you have shared any receipt(s) or packaging with another person, your claims will
be invalid and you will lose any right to a prize.

Your claim
2) Your valid claim and payment for postage and handling must be received during the Offer Period. Your claim is deemed to be received only when
received by the Promoter’s database. If you return a product comprising a Qualifying Purchase your claim may be deemed invalid at the Promoter's
discretion (unless product is defective, excluding claimant errors). You will receive a return online message confirming your claim. The Promoter is
not liable for any problems with communications networks. You are responsible for your own costs associated with claiming. If you claim using
automatically generated claims or multiple aliases you may be disqualified.
Prize customisation
3) The Promoter may review the customised design on your lunch bag or drink bottle, and may at its discretion, edit or reject any designs for any
reason, or no reason. The Promoter may use (or allow others to use) your lunch bag or drink bottle and any rights in relation to your lunch bag or
drink bottle, to publicise this offer or for any other purpose. These rights are perpetual, royalty free, world-wide, irrevocable and transferable.
For example, the Promoter may publish an image of all or any part of your customised lunch bag or drink bottle or any amended versions of it.
4) You warrant that your lunch bag or drink bottle customisation does not breach any third party rights (for example, intellectual property rights)
and its use by the Promoter or any other person will not breach such rights nor otherwise breach any law (for example, it is not defamatory, in
contempt of court or in breach of any privacy law). Your lunch bag or drink bottle customisation must not be obscene, offensive, malicious,
discriminatory, indecent or (in the Promoter's opinion) otherwise objectionable or inappropriate (for example it must not include language the
Promoter deems offensive).
General
5) If you are a successful claimant, you must take part in all publicity, photography and other promotional activity as the Promoter requires,
without any compensation. You consent to the Promoter using your name, lunch bag or drink bottle and image in any promotional or advertising
activity.
6) If you or your claim are deemed by the Promoter to breach these Terms and Conditions, your claim (or at the Promoter's discretion, all of your
claims) may be discarded. The Promoter may, at any time, require you to produce documentation to establish to the Promoter's satisfaction the
validity of your claims (including documentation establishing your identity, age and place of residence). Failure by the Promoter to enforce any of
its rights at any stage does not waive those rights.
7) You must not:
(a) tamper with the claim process;
(b) engage in any conduct that may jeopardise the fair and proper conduct of the offer;
(c) act in a disruptive, annoying, threatening, abusive or harassing manner;
(d) do anything that may diminish the good name or reputation of the Promoter or any of its related entities or of the agencies or companies
associated with this offer;
(e) breach any law; or
(f) behave in a way that is otherwise inappropriate.
8) The Promoter is not liable for claims or correspondence that are misplaced, misdirected, delayed, lost, incomplete, illegible or incorrectly
submitted.
9) The Promoter’s decision in connection with all aspects of this offer is final.
10) Prizes cannot be transferred or exchanged nor redeemed for cash. The prize values are correct as at the date of preparing these Terms and
Conditions and include any applicable GST. The Promoter is not responsible for any change in prize value. You agree that if a prize (or element of a
prize) is unavailable for any reason the Promoter may provide another item of equal or higher value, subject to any necessary approval by the
state/territory gaming authorities.
11) If this offer cannot run as planned for any reason beyond the Promoter's control, for example due to software, hardware or communications issues,
unauthorised intervention, tampering, fraud or technical failure, the Promoter may end, change, suspend or cancel the offer or disqualify affected
claims/entrants, subject to any necessary approval by the state/territory gaming authorities.
12) The Promoter is not responsible for any tax implications arising from you claiming a prize. You should seek independent financial advice. If for
GST purposes this offer results in any supply being made for non-monetary consideration, you must follow the Australian Taxation Office’s stated view
that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.
Liability
13) Nothing in these Terms and Conditions restricts, excludes or modifies any consumer rights under any statute including the Competition and
Consumer Act 2010 (Cth).
14) Subject to the previous paragraph, the Promoter and the agencies and companies associated with this offer are not liable (including in
negligence) for any loss (including indirect, special or consequential loss or loss of profits), expense, damage, personal injury, illness or death
suffered in connection with this offer or any prize, except for any liability which under statute cannot be excluded (in which case that liability is
limited to the greatest extent allowed by law).
15) Without limiting the previous paragraph, the Promoter and the agencies and companies associated with this offer are not liable for any loss of,
damage to or delay in delivery of prizes. Prizes will only be delivered to addresses in Australia.
16) The Promoter may communicate or advertise this offer using Facebook or Instagram. However, the offer is in no way sponsored, endorsed or
administered by, or associated with, Facebook or Instagram. You provide your information to the Promoter and not to Facebook or Instagram. You
completely release Facebook and Instagram from any and all liability.
Collection and use of your personal information
17) The Promoter may collect your personal information directly or through its agents or contractors. The Promoter will use your personal information
to conduct the offer. The Promoter may disclose your personal information to its related companies, agents and contractors to assist in conducting
this offer, communicating with you or storing data. This may include disclosures to organisations outside Australia. If you have marked the “opt-in”
box on the claim form, you consent to the Promoter keeping your personal information on its database to use for future marketing purposes, including
contacting you by electronic messaging. The Promoter’s Privacy Policy (see http://www.bega.net.au/privacy-policy) includes information about :
(i) how to seek access to the personal information the Promoter holds about you and seek correction of the information; and
(ii) how to complain about a privacy breach and how the Promoter will deal with such a complaint. |
