3-second winning moment competition
TERMS AND CONDITIONS
Information on how to enter and the prize(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these
Terms and Conditions.
The promoter is Lactalis Australia Pty Ltd (ABN 56 072 928 879) of 35 Boundary St South Brisbane, QLD 4101 telephone 1800 676 961 (“Promoter”).
Entry is only open to Australian residents.
Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to
these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor
entering this promotion.
Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means
any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent,
step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st
Entries into the promotion open on 02/08/21 and close at 11:59pm AEDT on 10/10/21 (“Promotional Period”).
To be eligible to enter, individuals must purchase any specially marked 900g tub or 4x150g pack of Vaalia products (each an “Eligible Product”) from
any retailer nationally during the Promotional Period (“Qualifying Transaction”).
To enter, individuals must then visit www.vaalia.com.au or scan the QR code on the back of the Eligible Product purchased in their Qualifying Transaction, follow the prompts to the
promotion entry page, input the requested details and enter the 8-character unique code found inside the Eligible Product, then submit the fully
completed online entry form, during the Promotional Period. Each entrant will be notified instantly online whether or not they are an instant winner.
Multiple entries are permitted, subject to the following:
(a) only one (1) entry permitted per Eligible Product;
(b) each entry must be submitted separately and in accordance with entry requirements; and
(c) only one (1) unique code per entry is permitted, the same unique code cannot be used more than once and unrecognised codes will be deemed invalid.
Entrants must retain a copy of their receipt for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when
requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a
prize. Purchase receipt(s) must clearly specify the store of the Qualifying Transaction and that the Qualifying Transaction was made during the
Promotional Period but prior to entry.
Entries must be received by the Promoter during the Promotional Period. Entries are deemed to have been received at the time of receipt into the
promotion database and not at the time of transmission by the entrant.
The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is
prohibited and will render all entries submitted by that entrant invalid.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of
residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of
these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and
proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its
rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an
offender are reserved.
Incomplete or indecipherable entries will be deemed invalid.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the
entrant.
There are up to 2,300,000 unique codes that will be issued on the inside of Eligible Products for this promotion, however winners will be selected by
a computerised random system based on pre-determined times. A three-second winning moment will be randomly selected every 60 minutes throughout the
Promotional Period and one (1) prize will be available to be won for each winning moment within each 60 minute period. The first valid entry received
during that winning moment, will be the instant winner. If no valid entry is received during that winning moment, no prize will be awarded in respect
of that 60 minute period of the Promotional Period. There are a total of 1,680 winning moments during the Promotional Period and accordingly, there
are up to 1,680 prizes to be won.
Each instant winner will win one (1) GARMIN Venu Sq – Music Edition Smartwatch, valued at $429.00 (“Smartwatch”). The Promoter may, in its absolute
discretion, accommodate the winner’s colour preference, subject to availability. A prize of a colour selected by the winner cannot be exchanged for a
different coloured prize once the prize has been delivered to the winner.
The total prize pool value is up to $720,720.00.
Entries will be received at Pilgrim Communications, 51A / 23 Norton Street, Leichhardt NSW 2040 and instant winners will be notified instantly upon
entry submission and by email within two (2) business days of their winning entry. In the event of any ACT winners or SA winners of a prize valued at
$250 or more, their names will be announced online on a weekly basis at vaalia.com.au starting on 09/08/21.
The Promoter’s decision is final and no correspondence will be entered into.
The Smartwatch prize is a smartwatch only. Winners will be responsible for making all arrangements for connection with a service provider and payment
of all associated connection, access and applicable charges.
If a winner of any prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian on the winner’s behalf.
Subject to the unclaimed prize draw clause, if for any reason a winner does not take the prize at/by the time stipulated by the Promoter, then the
prize will be forfeited.
If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or
specification, subject to any written directions from a regulatory authority.
Prizes are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
A draw for any unclaimed prizes may take place on 10/01/22 at Pilgrim Communications, 51A / 23 Norton Street, Leichhardt NSW 2040 at 10am AEST, in the
presence of an independent scrutineer (if required), subject to any directions from a regulatory authority. Winners, if any, will be notified in
writing by email. In the event of any ACT winners or SA winners of a prize valued at $250 or more, their names will be announced online at www.vaalia.com.au on 12/01/22.
Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or
recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome),
and promoting any products manufactured, distributed and/or supplied by the Promoter.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable
control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in
its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory
authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
Printing and other quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under
these Terms and Conditions, all prize claims in excess of the advertised prize pool will be honoured. Any instant win prizes that are part of the
advertised total prize pool will be awarded in the unclaimed prize draw. Instant win game materials void if stolen, forged, mutilated or tampered
with in any way.
The Promoter assumes no responsibility for:
(a) any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any entrant
whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier
network or otherwise;
(b) any theft, destruction or unauthorised access to, or alteration of such communications;
(c) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the promotion;
(d) any incorrect or incomplete information which may be communicated in the course of the administering this promotion (whether as a result of one of
the foregoing causes or otherwise); or
(e) any delay in delivery (when not directly caused by the Promoter or its supplier), or failure of safe delivery of a prize.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as
provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the
States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the
Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for
any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out
of the promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers,
employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage
(including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of:
(a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
(b) any theft, unauthorised access or third party interference;
(c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any
reason beyond the reasonable control of the Promoter;
(d) any variation in prize value to that stated in these Terms and Conditions;
(e) any tax liability incurred by a winner or entrant; or
(f) use of/taking of a prize.
The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties,
including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is
conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at www.Lactalis.com.au/privacy-policy/. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an
indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending
electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct
their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be
dealt with. All entries become the property of the Promoter. The Promoter will not disclose entrant’s PI to any entity outside of Australia.

The way I understand it, for this comp there is a 3 second window allocated every 60 minutes. Enter in that 3 seconds and you win. Enter in any of the
other 3597 seconds and you lose |

In one hour there are 60 minutes.
In one minute there are 60 seconds.
Therefore, there are 3,600 seconds per hour.
For only 3 seconds in those 3,600 you will have a chance to win if you enter and press submit at some stage during those 3 seconds.

I am so tired of 'winning moment' comps.
I'll give Vaalia credit for one thing, admitting that their winning moment is just 3 seconds long.
I've lost count of how many promoters I've contacted to find out how long their winning moment is, only to get no response from every single one of
them. |

understand the chances of winning are almost zero. |

I think this is a great idea. If we all keep hounding them every time they run a 'winning moments' competitions they might start to think about
whether it's worth the bad publicity. If anyone could be bothered contacting them it's the perfect fill in story for one of the tv shows like
current affairs. |

Is it really so different to being drawn from thousands of entries at the end of a comp? Virtual 'and' in the virtual 'barrel'. Draws a winner. 3
secs. Same with winning CODES like Gippsland and Weetbix. They are already predetermined.
It's just that in these we know we have lost a lot earlier. We do like that period of 'hope' between entry and winner announcement.
