Promoter
Treasury Wine Estates Australia Limited (ABN 78 145 321 320), Level 8, 161 Collins Street, Melbourne VIC 3000.
Competition Period
10am (AEDT) on 01/03/2021 to 11.59pm (AEST) on 30/04/2021
Winning Caps must be received at the specified Reply Paid address by last mail received on 14/05/2021.
Who can enter?
Only Australian residents who are aged 18 or over.
Who can't enter?
Directors, officers, management and employees (and their immediate families) of:
(a) the Promoter; and
(b) the agencies, companies or participating premises associated with this competition.
Where will the competition run?
This competition will run in all Australian liquor licensed outlets (e.g. bottle shops), including online retailers (Outlets) which are stocking
Qualifying Purchase products.

Qualifying Purchase
A 750ml bottle of 19 Crimes, excluding Magistrate, Cali Red, Blanc de Blanc, Sangiovese and Tempranillo varietals from an Outlet for off premise
consumption.
For the avoidance of doubt, Qualifying Purchase products do not need to be specially marked.
Entry instructions
During the Competition Period after making a Qualifying Purchase and collecting your itemised purchase receipt and wine bottle cap, you must look
under the cap of the Qualifying Purchase product to see if one of the 19 Crimes is printed inside the cap, as well as 'Crime #19' printed on the top
underside of the cap and, if so, this is a Winning Cap.
If your Qualifying Purchase has a Winning Cap, you must:
(c) during the Competition Period, visit the Website, locate the claim page and fill out and submit the online claim form, including by uploading an
image of the Qualifying Purchase receipt, and providing all other requested information, to receive your claim number; and
(d) send your name, phone number, claim number and original Winning Cap via post to the Reply Paid address provided on the Website, to be received by
last mail received on 14/05/2021.
Your purchase receipt must clearly identify where the Qualifying Purchase was made, the product/s purchased (which must be a Qualifying Purchase) and
the date of purchase (which must be during the Competition Period before you submitted your claim).
The Promoter is not responsible if your mobile device/desktop is not sufficiently capable for the purpose of submitting a claim, including having the
requisite photograph capability.
All claims will be verified by the Promoter (Verification). In order to be considered for Verification, claims must be received in full in accordance
with both (a) and (b) above. If a claim is partially submitted in accordance with either (a) or (b) above, that claim will be deemed invalid.
There will be a total of 19 Winning Caps distributed in respect of this competition.
If your Qualifying Purchase does not have a Winning Cap, you can enter the second chance draw (subject to the second chance draw entry limits below)
by, during the Competition Period, visiting the Website, locate the second chance draw entry page and fill out and submit the entry form in accordance
with the instructions provided, including by uploading an image of the Qualifying Purchase receipt and providing all other requested information.
How many winners will there be?
There will be up to 19 winners in this competition.
What can I win?
There are up to 19 prizes available.
Each prize is a $1,000 Visa card.
There is a limit of one prize per person (except for SA residents).
Total prize pool
The total prize pool is up to $19,000.
How many times can I enter?
Instant win
You can claim once per day, provided you only enter once per Qualifying Purchase receipt and per Winning Cap. Each claim must be submitted separately
in accordance with these Terms and Conditions.
Second chance draw
There is a limit of 1 second chance draw entries household as determined by residential address.
How and when will the winners be informed?
Instant winners will be notified in writing by email within two business days of Verification and their prize will be sent via email within 28
business days of Verification.
Instant winners will have their name and state/territory of residence published on the Website on 10/06/2021.
Proof of purchase
In addition to keeping the Winning Cap and sending it to the Promoter in accordance with the Entry instructions above, you must keep original itemised
purchase receipt(s) as proof of purchase for all claims.
You must also keep original itemised purchase receipt(s) as proof of purchase for any second chance draw entries.
If you don't produce the above proof of purchase for all claims/entries when asked the Promoter may disqualify all of your claims/entries and you will
lose any right to a prize.
Proof of purchase must be identical to that provided by you with your claim/entry.
If, in the Promoter's opinion, you have shared any proof of purchase with another person, your claims/entries will be invalid and you will lose any
right to a prize.
Second Chance draw
If any instant win prize is un-won or not claimed by 24/06/21, a second chance draw will be held at 12.00pm (AEST) on 25/06/21 at Treasury Wine
Estates, Level 8, 161 Collins Street, Melbourne VIC 3000 . Each un-won or unclaimed prize will be distributed to the next valid second chance draw
entry randomly drawn until all un-won and unclaimed prizes are awarded.
Any winner/s in this draw will be informed in writing by email within two days of determination. Winner/s will have their name and state/territory
published on the Website on 28/06/21.
If any prize remains un-won at the end of this promotion, or if a prize winner cannot be found, that information will be published on the Website on
28/07/21.
Collection and use of your personal information
If you are a winner, you must take part in all publicity, photography and other promotional activity as the Promoter requires, without any
compensation. You consent to the Promoter using your name/s and image/s in any promotional or advertising activity.
The information you provide will be used by the Promoter for the purpose of conducting this competition and fulfilling the prize. The Promoter may
collect your personal information (including through its contractors or agents) and disclose your personal information to its contractors and agents
to assist in conducting this competition or communicating with you. If you have marked the “opt-in” box on the entry form, you consent to the
Promoter keeping your personal information on its database to use for future marketing purposes, including contacting you by electronic messaging.
The Promoter is bound by the Privacy Principles in the Privacy Act 1988. You can request access to the personal information the Promoter holds about
you by contacting the Promoter at the address stated in the Promoter section of these conditions. The Promoter’s Privacy Policy, located at https://www.tweglobal.com/privacy, contains information about :

Entry
13 Your instant win claim must be received during the Competition Period and your Winning Cap must be received by last mail received on 14/05/2021,
and each will be deemed to be received only when received by the Promoter. Submitted Winning Caps are the Promoter's property. If you return a
Qualifying Purchase your claim may be deemed invalid at the Promoter's discretion (unless the product is defective). You will receive a return online
message confirming your claim. The Promoter is not liable for any problems with communications networks. You are responsible for your own costs
associated with entering. If you claim using automatically generated claims or multiple phone numbers/email addresses/addresses/aliases, you may be
disqualified.
Prizes
14 Prize/s and all elements of prize/s must be taken as and when offered or will be forfeited, and if forfeited, the Promoter will not be liable.
Prize/s are subject to any additional terms and conditions imposed by the relevant supplier or the Promoter, including, validity period/s.
15 The Promoter is not responsible for any dispute between you and any person with whom you choose to, or choose not to, share the prize.
General
16 Any failure by you to comply with the conditions imposed by the prize supplier(s) may result in the prize being cancelled or withdrawn without
liability for the Promoter or the prize supplier(s).
17 If you or your entry are deemed by the Promoter to breach these Terms and Conditions, your entry (or at the Promoter's discretion, all of your
entries) may be discarded. The Promoter may, at any time, require you to produce documentation to establish to the Promoter's satisfaction the
validity of your entries (including documentation establishing your identity, age, place of residence and place of employment). Failure by the
Promoter to enforce any of its rights at any stage does not waive those rights.
18 You must not:
(a) tamper with the entry process;
(b) engage in any conduct that may jeopardise the fair and proper conduct of the competition;
(c) act in a disruptive, annoying, threatening, abusive or harassing manner;
(d) do anything that may diminish the good name or reputation of the Promoter or any of its related entities or of the agencies or companies
associated with this competition;
(e) breach any law; or
(f) behave in a way that is otherwise inappropriate.
19 The Promoter is not liable for entries, prize claims or correspondence that are misplaced, misdirected, delayed, lost, incomplete, illegible or
incorrectly submitted.
110 If any dispute arises between you and the Promoter concerning the conduct of this promotion or claiming a prize, the Promoter will take reasonable
steps to consider your point of view, taking into account any facts or evidence you put forward, and to respond to it fairly within a reasonable time.
In all other respects, the Promoter’s decision in connection with all aspects of this competition is final.
111 Prizes cannot be transferred or exchanged nor (except where cash is specified) redeemed for cash. Without limiting any other term of these Terms
and Conditions, all prizes (and elements of prizes) must be taken as and when specified, or will be forfeited with no replacement. The prize values
are correct as at the date of preparing these Terms and Conditions and include any applicable GST. The Promoter is not responsible for any change in
prize value. You agree that if a prize (or element of a prize) is unavailable for any reason the Promoter may provide another item of equal or higher
value, subject to any necessary approval by the state/territory gaming authorities.
112 If publication will take place, by entering, you request that your full address not be published.
113 Printing and other quality control errors outside the Promoter’s control will not invalidate an otherwise valid prize claim. Every prize claim in
excess of the advertised prize pool will be honoured, unless the claim is rejected due to fraud or ineligibility under these Terms and Conditions.
114 If this competition cannot run as planned for any reason beyond the Promoter's control, for example due to software, hardware or communications
issues, unauthorised intervention, tampering, fraud or technical failure, the Promoter may end, change, suspend or cancel the competition or
disqualify affected entries/entrants, subject to any necessary approval by the state/territory gaming authorities.
115 The Promoter is not responsible for any tax implications arising from you winning a prize. You should seek independent financial advice. If for
GST purposes this competition results in any supply being made for non-monetary consideration, you must follow the Australian Taxation Office’s stated
view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.
Liability
116 Nothing in these Terms and Conditions restricts, excludes or modifies any consumer rights under any statute including the Competition and Consumer
Act 2010 (Cth).
117 Subject to the previous paragraph, the Promoter and the agencies and companies associated with this competition are not liable (including in
negligence) for any loss (including indirect, special or consequential loss or loss of profits), expense, damage, personal injury (including
allergies, skin conditions or other reactions, as relevant), illness or death suffered in connection with this competition or any prize, except for
any liability which under statute cannot be excluded (in which case that liability is limited to the greatest extent allowed by law).
118 Without limiting the previous paragraph, the Promoter and the agencies and companies associated with this competition are not liable for any loss
of, damage to or delay in delivery of prize/s, or for any damage that occurs to displayed prize/s (where relevant). Unless otherwise specified,
prize/s will only be delivered to addresses in Australia.
119 This competition is in no way sponsored, endorsed or administered by, or associated with any social media platform, including Facebook, Instagram
and Twitter. You provide your information to the Promoter and not to any social media platform. You completely release any relevant social media
platforms from any and all liability.

I just had a whole bunch of automated spam calls which displayed very scammy looking phone numbers
And one 'missed call' from a number than looked 'real' but when I phoned it from the home phone I had a number not connected message and there were no
results on Who Called Me for it either |

The call came up as private number.
I have heaps of friends that will not answer the phone if it says private number. I think I entered twice?

I had a similar issue with a Visa gift card I won early in the year, it was 'used' by a scammer at a Target store in America
When I first contacted the Visa gift card people, they tried to blame me for checking my balance on a fake website. No, it was the real website I had
bookmarked and it had the 'padlock' in the URL field
I had to contact them three times from memory before they ended up agreeing to email me the form to dispute it (and I 'won' in the end)

So do I use the $175.17 on it before it gets used as well?

This happened to me when I won the $1000 visa from Woolworths. I had $500 left on it and when I went to use it the balance was zero. Heaps of $7
debits from Google Play in USA. I rang the number on the card and they were great, they emailed me out some forms to fill out. That was from
dispute.support@bhnetwork.com
Within a week they said they verified the debits were not me and they would send me a new card with the $500 on it. Still waiting to receive it
though... |

I had to put in a fraud report to cyber.gov.au because it is fraudulent use of my card overseas. They gave me a report number that
support@cometrue.com.au need to issue me a new card.
So looks like it is ok. |
