Terms & Conditions
1 Information regarding prizes and how to enter forms part of these conditions. By entering, entrants accept these conditions.
2 Entry is open only to Australian residents aged 18 or over except directors, officers, management and employees (and the immediate families of
directors, officers, management and employees) of the Promoter, or of the agencies, participating outlets or companies associated with this
competition.
3 The competition begins at 12.01am (AEDST) on 29/03/09 and closes at 11.59pm (AEST) on 29/04/09 (Competition Period).
4 To enter, consumers must, during the Competition Period:
(a) purchase a carton of Stella Artois (Eligible Purchase) from a participating liquor outlet (Outlet) for off premise consumption to receive a game
card (Game Card), subject to Game Card stocks remaining in that Outlet; and
(b) open their Game Card to reveal an 8 digit unique code and submit their entry by one of the following methods:
(A) send an SMS (maximum cost 55 cents (inc GST)) from their mobile phone to 1999 5225 stating in one message, and in the following
order, their 8 digit unique code, their full name and their post code; OR
(B) log on to www.bottlemart.com.au, follow the links to the online entry form and fully complete the entry form, including their full name, address
and 8 digit unique code and any additional information as required by the Promoter. Consumers are responsible for their own costs associated with
accessing the Internet.
5 Each successful entrant will receive a return SMS or online notification (depending on their entry method) confirming their successful entry into
the competition. Computer generated entries will not be accepted. Entries are deemed to be received at the time of receipt into the Promoter’s
database, not the time of transmission by the entrant. Entrants who enter using multiple phone numbers or email addresses will be disqualified. In the
event of a dispute regarding a prize awarded to an SMS entry, the prize will be awarded to the owner of the relevant mobile phone. SMS entry is only
open to consumers with an SMS compatible mobile phone connected to a service provider which permits text messaging to the promotional SMS number.
Consumers should check with their network service provider to see if their mobile phone is able to send an SMS to the promotional number.
6 Consumers may enter this promotion up to 5 times per person per day, provided that each entry is based on a separate unique code
and a separate SMS or online entry in accordance with paragraph 4. Entrants must retain their original Game Card and purchase receipt to
verify each entry. Failure to provide these to the Promoter upon request may, at the Promoter’s discretion, result in an invalid entry (and,
at the Promoter’s discretion, in all of the entrant’s entries being invalid). The Promoter accepts no responsibility for any late, lost, incomplete,
incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration,
tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise. The Promoter has no control over telephone
communications, the Internet, networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic
congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs
incurred.
7 There will be 30 draws conducted with a draw taking place on each day between 01/04/09 and 30/04/09 (inclusive). All valid entries received during
the Competition Period will be entered into each subsequent draw. Each draw will take place at 10am (AEST/AEDST, as applicable) at Prime Focus, 104/55
Beach St, Port Melbourne VIC 3207. The first valid entry randomly selected in each draw from all entries received to date (excluding previous winning
entries) will win a prize.
8 Each prize is a Sony VAIO VGN-CR353 notebook computer including Microsoft Windows, Sony VAIO & Adobe Premiere video editing software valued at
$1,699 (inc GST). There are 30 prizes to be won. The total prize pool is valued at $50,970 (inc GST).
9 The winners will be notified in writing and by phone. Winners drawn between 01/04/09 and 15/04/09 (inclusive) will have their name and
state/territory of residence published in The Australian on 22/04/09. Winners drawn between 16/04/09 and 30/04/09 (inclusive) will have their name and
state/territory of residence published in The Australian on 07/05/09. By entering, each entrant requests that his or her full address not be
published.
10 The prize winners must, at the Promoter’s request, participate in all promotional activity (such as publicity and photography) surrounding the
winning of any prize, free of charge, and they consent to the Promoter using their name and image in promotional material.
11 The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or
consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any
person’s negligence) in connection with this competition or accepting or using any prize, except for any liability which cannot be excluded by law (in
which case that liability is limited to the minimum allowable by law).
12 Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for any damage in transit to
prizes.
13 The Promoter may require the winners to provide proof of age, proof of identity and proof of residency. Identification considered suitable for
verification is at the Promoter’s discretion.
14 If an entry is deemed not to comply with these conditions of entry, the Promoter reserves the right to discard that entry and a new winner of the
relevant prize will be determined by drawing a further valid entry, in accordance with paragraph 7. The judges’ decision is final and no
correspondence will be entered into.
15 The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by, any person who
tampers with or benefits from any tampering with the entry process or with the operation of the competition or acts in violation of these conditions,
acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person.
16 Prizes are not transferable or exchangeable and cannot be redeemed for cash. The Promoter accepts no responsibility for any variation in prize
value. If a winner does not take a prize at the time stipulated by the Promoter then that prize will be forfeited by that winner and cash will not be
supplied in lieu. Where a prize is unavailable for any reason the Promoter may substitute for that prize another item of equal or higher value as
determined by the Promoter, subject to the approval of the relevant gaming authorities, where required.
17 In the event of a prize not being accepted or claimed within 3 months of the relevant draw, the relevant winner’s entry will be deemed invalid and
the Promoter reserves the right to conduct such further draws at 12 noon (AEDST) on 31/07/09 at Prime Focus, 104/55 Beach St, Port Melbourne VIC 3207,
as are necessary to distribute the prize/s, subject to any written directions given by the relevant gaming authorities, where required. Any winner in
this draw will have their name and state/territory of residence published in The Australian on 07/08/09.
18 If for any reason any aspect of this competition is not capable of running as planned, including, but not limited to, by reason of tampering,
unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter which corrupts or affects the administration,
security, fairness, integrity or proper conduct of this competition, the Promoter may in its sole discretion cancel, terminate, modify or suspend the
competition, or invalidate any affected entries, subject to the approval of the relevant gaming authorities, where required.
19 There will be a total of 41,500 Game Cards printed. Game Cards from any other competition are not valid for this competition. Quality control
errors outside the Promoter’s control will not invalidate an otherwise valid prize claim. Every prize claim in excess of the advertised prize pool
will be honoured, unless such claim is rejected due to fraud or ineligibility under these conditions. Game Cards are void if stolen, forged, mutilated
or tampered with in any way.
20 The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be
sought. Where the operation of this competition results in, for GST purposes, supplies being made for non-monetary consideration, entrants agree to
follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST
inclusive market values.
21 The Promoter encourages consumers to enjoy alcohol responsibly. Legal aged consumers are advised to consider the safe drinking levels recommended
in the National Health and Medical Research Council Australian Alcohol Guidelines available at www.alcoholguidelines.gov.au. Entry and continued participation in this promotion is subject to each Outlet’s liquor serving policy.
22 All entries will be the property of the Promoter. The information entrants provide will be used by the Promoter for the purpose of conducting this
competition. The Promoter may disclose entrants’ personal information to its contractors and agents to assist in conducting this competition or
communicating with entrants. By entering this promotion, entrants consent to the storage of their personal information on the Promoter’s database and
the Promoter may use this information for future promotion and marketing purposes regarding its products, including contacting the entrant via
electronic messaging. By entering this competition, entrants consent to receiving SMS or email messages from the Promoter that do not contain any
functional unsubscribe facility. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988. Entrants can request access to the
personal information the Promoter holds about them by contacting the Promoter at the address below.
