USERS - GENERAL TERMS AND CONDITIONS APPLYING TO USE OF THE WEBSITE AND CASTING OF VOTES IN THE COMPETITIONS ("USER TERMS")
1 Introduction
1.1 The internet site http://www.uncharted.com.au (the "Website") and the mobile internet site, [http://uncharted.mobi] (the "WAP Site") are owned and operated by Lion
Nathan Australia Pty Limited (ABN 13 008 596 370) of Level 7, 68 York Street Sydney NSW 2000 ("LNA", "us" or "our" or any other grammatical form of
those words). Use of the Website or WAP Site and sending SMS messages to 199 88 500 is subject to these Terms and Conditions, which are accepted by
using the Website or WAP Site or by sending SMS messages to us. These Terms and Conditions may be updated by LNA from time to time and at any time
without notice to Users
1.2 Parts of the Website and WAP Site are accessible to all persons ("you" or "Users" or any other grammatical form of those words) and other parts
of the Website and WAP Site are restricted to Users who have registered with LNA through the Website, WAP Site or by SMS ("Registered Users"). For
clarity, the term ‘User’ includes Registered Users. Unless otherwise stated, these User Terms apply to all Users. LNA may, in its sole discretion,
decline to register anyone as a Registered User without giving any reasons.
1.3 Unless otherwise stated, all capitalised terms in these User Terms have the same meaning as in the Competition Terms.
2 The Website is owned by LNA
2.1 All rights (including, without limitation, intellectual property rights) in and to the Website and WAP Site are owned by or licensed to LNA.
Users may not use, copy, adapt, modify, sell, license, distribute, transmit, display, publish or create works derived from the Website and WAP Site
except as provided for in these User Terms.
2.2 The Website and WAP Site contains trade marks, names and logos which belong to LNA and others. Users do not have any licence or right to use any
of them.
3 Voting in the Competitions
3.1 Registered Users must be over the age of 18.
3.2 To register, Users must record their details on the Website, the WAP Site or via SMS. Where Users are registering via the Website, LNA will send
an SMS to the mobile phone number provided on the registration form completed via the Website, containing a unique identification code ("Code"). Where
a User becomes a Registered User via the Website, the User must enter a Code where prompted on the Website to activate their account. Users who
register to vote by SMS or via theWAP Site]will not be eligible to participate in any trade promotion conducted by LNA (or its Representatives) in
connection with the Competition unless they subsequently update their details on the Website by completing the online registration form
3.3 Registered Users can cast their votes as follows:
(a) online via the Website;
(b) by mobile phone via the WAP Site (subject to individual User mobile functionality, User carrier charges will apply); and
(c) by mobile phone via SMS to 199 88 500 (SMS voting is available to all Registered Users with a mobile plan allowing access to Premium SMS
services on the ‘19X’ telephone prefix. SMS costs will not exceed 55 cents (including GST). Prepaid mobile users must have sufficient credit available
to cover the cost of the SMS message otherwise their SMS vote will not be registered. Only fully paid SMS votes will be counted toward the final
tally. Registered Users are responsible to ensure they dial the correct number and provide the correct information to register a valid SMS vote).
Registered Users registering multiple mobile phone numbers and/or multiple email addresses will be disqualified from participating in the Competition.
3.4 Subject to clause 9, Registered Users may cast one vote per hour of the Nominations Stage, Semi Final Stage and Grand Final Stage ("Public
Voting Stages"). For clarity, a Registered User may only cast one vote in any hour of the Public Voting Stages, commencing on the hour and concluding
60 minutes later (for example, between 1:00pm and 2:00pm). If a Registered User does not cast a vote during one or more hours of the Public Voting
Stages, they will not be entitled to cast additional ‘make-up’ votes in subsequent hours.
3.5 Except as otherwise provided for in these User Terms, a vote submitted by a Registered User which complies with the requirements of these User
Terms, will be included in the tally used to determine the winner(s) of the relevant stage of the Competition.
3.6 LNA does not warrant that access to voting via the Website, WAP Site or by SMS will be available, uninterrupted, free from delay or error-free
or that any defects will be corrected.
3.7 It is each Registered User's responsibility to ensure that they follow the steps necessary, as outlined on the Website and WAP Site, in order
register a valid vote.
3.8 The voting service on the Website, WAP Site or by SMS for each Competition will be available commencing at a date and time of LNA’s choosing and
will continue until the date and time notified to Users on the Website and WAP Site. Registered Users will be charged for each SMS vote submitted
(including any SMS vote submitted after the closing date for votes) regardless of whether the SMS vote is deemed valid or invalid in accordance with
these User Terms or the Competition Terms.
3.9 LNA reserves the right to keep all voting tallies confidential. No results other than those published on the Website and WAP Site will be
released to the public. LNA’s decision in all matters relating to voting in the Competitions is final and binding, and no correspondence will be
entered into.
3.10 LNA will disqualify and disregard any votes (however cast) which LNA considers (in its absolute discretion):
(a) tamper with, or attempt to tamper with the voting process or a Competition;
(b) corrupt or affect (or attempt to corrupt or affect) the administration, security, fairness or integrity or proper conduct of a vote, the
voting process or a Competition; or
(c) are manipulative, unrepresentative, incomprehensible, incomplete or disproportionate.
3.11 All parts of the Website and WAP Site intended for use in voting in the Competitions are provided "as is" and without warranties of any kind,
either express or implied. The voting system via the Website, WAP Site and SMS is not a guaranteed delivery or communication system. LNA and its
officers, directors, employees, agents and contractors ("Representatives") will not accept responsibility for any vote not received or for any delay
in the delivery of any vote due to technical disruptions, network congestion, network failures or for any other reason.
4 Content of Website and WAP Site
4.1 Users are advised that the Website and WAP Site may contain material, uploaded by Competitors in each of the Competitions in accordance with the
Competition Terms (the "Uploaded Material") or Registered Users participating in any interactive facility available on the Website or WAP Site (e.g.
forums, blogs or chat rooms) ("Interactive Content"), which could be considered offensive to some people.
4.2 LNA does not necessarily endorse the Uploaded Material or Interactive Content. LNA and its Representatives accept no liability for Uploaded
Material or Interactive Content.
5 Interactive Content
5.1 Registered Users are legally responsible for the Interactive Content they submit on the Website or WAP Site.
5.2 Registered Users must not post Interactive Content that (in the sole opinion of LNA):
(a) is defamatory;
(b) violates laws regarding harassment, discrimination, privacy or contempt;
(c) is intentionally false or misleading;
(d) infringes third party intellectual property rights including copyright;
(e) is abusive or offensive, including obscenity, blasphemy and racial vilification;
(f) is of nuisance value, inappropriate, off topic or vexatious;
(g) compromises the privacy of any Competitor or other person by containing inappropriate personal information;
(h) seeks to endorse third party commercial products or activities or to advertise or solicit business of any third party;
(i) deliberately provokes a section of the community; or
(j) encourages persons to misuse drugs or alcohol or engage in any illegal acts.
Any such Interactive Content will be removed from the Website and WAP Site and may result in a Registered User being banned from submitting
Interactive Content.
5.3 Registered Users acknowledge and agree that LNA may at any time at its discretion remove or edit Interactive Content.
5.4 Notwithstanding its right to supervise or actual supervision of Interactive Content, LNA has no obligation to monitor Interactive Content and
accepts no responsibility or liability for Interactive Content including, but not limited to, any defamatory material or for any errors or omissions
in any Interactive Content or for any loss or damage of any kind incurred as a result of the use of any Interactive Content posted or transmitted via
the Website or WAP Site.
5.5 Registered Users warrant they own, or are licensed to use, all intellectual property rights in, and that no third party intellectual property
rights will be infringed by, any Interactive Content.
5.6 Registered Users grant to LNA a perpetual, royalty-free, non-exclusive, unrestricted world-wide licence to use, copy, sub-license,
re-distribute, adapt, transmit, publish and/or broadcast, publicly perform and display any Interactive Content.
6 Use of Uploaded Material and Interactive Content
6.1 Uploaded Material and Interactive Content may be protected by copyright and other laws. Nothing in these Terms and Conditions will transfer any
right, title or interest in any Uploaded Material or Interactive Content to Users.
6.2 Users may only view or listen to Uploaded Material or Interactive Content from the Website or WAP Site for the purposes of the Competitions and
must not otherwise copy, reproduce, publish, communicate, play in public, distribute, publicly perform, publicly display or adapt the Uploaded
Material or Interactive Content, or otherwise engage in any act comprised in the copyright applying to the Uploaded Material or Interactive Content,
unless authorised by the copyright owner.
7 LNA is not liable
7.1 The Website, WAP Site and SMS facility are made available by LNA without warranty of any kind, whether express or implied, to the fullest extent
permissible under applicable law.
7.2 LNA makes no representation or warranty that the Website or WAP Site or their content is accurate, up-to-date or complete or that any
expressions of opinion or statements of intention are reasonable or honest.
7.3 LNA makes no warranty that the Website , WAP Site or SMS facility (or the server that makes any of them available) will be:
(a) timely or available on an uninterrupted basis;
(b)error-free or that defects will be corrected; or
(c)free of viruses or other harmful material.
7.4 LNA and its Representatives are not liable for any loss, cost or damage of any kind which any User may suffer when using the Website, WAP Site
or SMS facility, or attempting to use them, and by accessing the Website or WAP Site or using the SMS facility, each User releases LNA and its
Representatives from all such liability.
7.5 Under no circumstances will LNA or its Representatives be liable to Users for any claims, liability, direct or indirect loss, cost or damage
(including loss of profits, indirect, incidental, special or consequential loss or damages (whether in contract, tort or otherwise)) that the User may
suffer in connection with use of, or gaining access to (as applicable), the Website, WAP Site or SMS facility, and by using or accessing the Website,
WAP Site or SMS facility each User releases LNA and its Representatives from any liability for such damages.
8 The information you provide
8.1 In consideration of your use of the Website or WAP Site, you agree to:
(a) provide true, accurate, current and complete information about yourself when prompted by our registration form or any other form we ask
you to complete at any time; and
(b) maintain and update promptly any personal information which you are able to update on the Website or WAP Site so as to keep it true,
accurate, current and complete.
8.2 During the registration process, or at any subsequent time, when you answer questions on the Website or WAP Site or when cookies are used, LNA
may collect, process, use and disclose the personal information you have provided in accordance with our Privacy Policy, which is located at http://www.uncharted.com.au/home/privacy.do ("LNA’s Privacy Policy").
9 Termination
9.1 LNA may terminate or suspend the registration or permissions of any Registered User (including voting rights), at will and without notice, in
whole or part at any time.
10 Links
10.1 LNA may provide links to other web sites from the Website or WAP Site. If a User accesses these links, they will leave the Website or WAP Site.
10.2 LNA has not reviewed any of these other web sites and does not control and is not responsible for any of them or their content.
10.3 LNA does not endorse or make any representations about external web sites, or any information or product or materials a User may find there. If
a User decides to access any site linked to the Website or WAP Site, the User does so entirely at their own risk.
11 Cookies
The Website and WAP Site use "cookie" information collection technology. If a User does not wish to receive cookies, it is the User’s responsibility
to use a browser which does not (or is configured not to) accept cookies (which may then limit the functionality of the Website or the WAP Site).
12 Jurisdiction
These Terms and Conditions and any claim relating to the use of the Website are governed by the law as it applies in New South Wales, Australia, and
Users consent to the exclusive jurisdiction of the courts of New South Wales, Australia in relation to any dispute. |
