Terms and Conditions
1. Information on how to enter forms part of the terms of entry. Entry into the competition is deemed acceptance of these terms and conditions.
2. Entry is open only to “Eligible Entrants”. An “Eligible Entrant” (i) is a current subscriber to a service offered by a subscription television
provider licensed to carry TV1 (a “Subscriber”) and who (ii) is not (a) an employee of, or contractor to, the Promoter or any of its related
companies, or the Promoter’s distributors, external auditors and platforms including Beinteractive Pty Ltd and their associated agencies and any other
agencies or companies associated or connected with 30 ROCK, or (b) a member of the immediate family of any such employee or contractor. "Immediate
family" means spouse, defacto spouse, parent, natural or adopted child, and sibling (whether natural, or adopted by a parent), whether or not they
live in the same household as the employee/contractor.
3. The competition commences on Wednesday 15 July 2009 at 12:01am (AEST) and concludes on Sunday 2 August 2009 at 11:59pm (AEST). However, there will
be 2 separate entry periods. The eligibility period for each entry period is set out in the table below.

4. To enter the Instant Win Prize draw, participants must register to receive reminders to tune into each episode of 30
ROCK on TV1 by sending an SMS message containing their name and address to 1977 6666 during the Instant Win entry period outlined in the table
in Clause 3. SMS entrants will receive a reply message to confirm their registration. Once registered, entrants will also be sent a reminder message
each day that a new episode of 30 Rock airs on TV1. Registered entrants will have the opportunity to opt-out of these reminder messages at anytime by
replying STOP.
5. To enter the Major Prize draw, participants must send an SMS message containing the advertised Code Word to 1977 6666 during the Major Draw entry
period outlined in the table in Clause 3. There will be a unique Code Word aired during each episode of 30 Rock. Entries to the SMS number must
include their full name and the advertised Code Word to be eligible. SMS entrants will receive a reply message to confirm their entry.
6. Each Episode of 30 Rock aired on TV1 or TV1+2 will broadcast a unique Code Word. Entrants are permitted to enter multiple times. However, the
correct code word must be included in the message to be eligible for the Major Prize draw. Each Code Word will only be valid on the day it is
broadcast.
7. The SMS entry mechanic is only open to consumers with a SMS compatible mobile phone connected to a service provider which permits text messaging to
the promotional SMS number. It is recommended that entrants check with their individual service provider in this regard.
8. INSTANT WINS: 200 x Instant winner prizes will be available to random valid entrants. Participants will be notified in their reply SMS if they are
an instant winner. Instant winners will be issued a 6 digit unique Prize Claim Number as determined by the Beinteractive Pty Ltd Instant Win system.
The unique 6 digit Prize Claim Number will need to be recorded by the participant for prize verification purposes. In the event of any dispute with
the Promoter, or at the Prompter’s request, Instant Winners will be required to correctly quote their unique Prize Claim Number to be awarded their
prize. The Promoter reserves the right to withhold the awarding of an instant prize to a participant who cannot provide a valid, unique Prize Claim
Number or do not meet the entry requirements.
9. Entrants under the age of 18 must obtain the prior permission of a parent or guardian over the age of 18 to enter.
10. Incomplete and incomprehensible entries will be deemed invalid.
11. INSTANT WIN: Only one prize per person will be awarded (SA residents are entitled to win more than one prize). In the event that an entrant wins
more than one instant prize, the first instant prize won will be awarded and the remaining prizes will be drawn.
12. The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and
proof of entry validity including valid subscriber details and mobile phone bill in order to claim a prize. Proof of identification, residency and
entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner
will forfeit the prize in whole and no substitute will be offered.
13. The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of Promoter, includes
objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry
process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in
conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion
and/or Promoter. The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner’s entry is of a
type described in this clause.
14. Each 30 Rock episode will air a unique Code Word. Entries with each episode’s unique Code Word must be received by 11:59pm (AEST) on the same day
it is broadcast during the competition period and final entries received by 11:59pm (AEST) on Sunday 2 August 2009. The time of entry will in each
case be the time the SMS message is received by the Beinteractive Pty Ltd database. The Promoter accepts no responsibility for any late, lost or
misdirected entries including SMS messages not received by the Promoter or delays in the delivery of the SMS message due to technical disruptions,
network congestion or for any other reason. SMS entries via the internet or computer generation and not attributable to a valid mobile phone account
is invalid and will not be accepted.
15. SMS cost is $0.55 (including GST).
16. INSTANT WIN: There are 200 instant win prizes available to entrants. The Instant Win Prizes consist of 150 x Series 1 30 ROCK DVDs valued at
$34.95 and 50 x 30 ROCK Merchandise Packs including 30 ROCK Pen, Notepad, Bag and Cap valued at $50.00 per pack. The total maximum instant win prize
pool is valued at a maximum of $7,742.50.
17. MAJOR PRIZE: There is 1 major prize available to entrants who enter the Major Prize draw. The winner will win a trip for two (2) people to New
York, USA valued at up to AU$10,000 depending on date and point of departure including return economy airfares from winner's nearest capital city,
five (5) nights twin share accommodation in a first class hotel with daily breakfast, return private airport transfers, exclusive VIP guided tour of
NBC Studios at 30 Rockefeller Centre in New York, two (2) tickets for the On Locations bus tour – The New York TV and Movie sites tour, and two (2)
tickets to the Late Night with Jimmy Fallon Show (or similar).
18. Total prize pool is valued up to = $17,742.50 (including GST)
19. Prizes are not transferable and cannot be redeemed for cash.
20. The major winner (and their companion) are responsible for all other expenses including spending money, meals (unless specified), drinks,
transfers (unless specified), laundry charges, activities (unless specified), incidentals, taxes (including departure taxes), energy surcharges,
gratuities, services charges, passports, visas, travel insurance, additional transfers, items of a personal nature, in-room charges and all other
ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances.
21. The winner and travelling companion must travel at the same time, must depart from the same capital city and are responsible for transport from
their residence to their nearest capital city for flight departure (Sydney, Melbourne, Brisbane, Adelaide or Perth).
22. Government taxes are an additional cost to the winners and their travelling companions and are required prior to ticketing.
23. If the winner is under the age of 18 as at the date of the draw, an adult must accompany the minor in the participation of the prize.
24. The prize is valid for 12 months and must be taken by 2 August 2010 and is subject to hotel and flight availability. The prize is not available
during peak times such as public holidays, school holidays and peak periods and cannot be changed once the booking has been made.
25. Air tickets are available on the regular scheduled services of each airline and are subject to seasonal embargos. Flight itinerary may have to be
adjusted depending on the airlines departure city and their current flight schedule. Frequent Flyer points are not available from any airline.
26. A credit card imprint or cash deposit may be required from the winner at check-in to the hotel, for all incidental charges. Once accommodation
vouchers are issued they are non-changeable.
27. It is the traveller’s personal responsibility to ensure that they have valid documentation, including but not limited to valid passports and
visas, which meet the requirements of immigration and other government authorities at every destination. Any fines, penalties, payments or
expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the
travellers.
28. TV1 and Beinteractive Pty Ltd make no representation as to the safety, conditions or other issues that may exist at any destination. International
travel advice can be obtained from various sources, including government, local consular offices and the web site of the Australian Department of
Foreign Affairs and Trade.
29. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value,
subject to State Regulation.
30. The promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the promoter determines, in their
absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize. It is a
condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute
discretion.
31. Once prizes have left the Promoter’s premises, the Promoter takes no responsibility for prizes damaged, delayed or lost in transit.
32. By accepting the prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to
the prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of the prize.
33. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that
element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
34. Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.
35. Programming and other quality control errors will not invalidate an otherwise valid prize claim.
36. Unless otherwise due to fraud or ineligibility under these conditions of entry, all existing claims for prizes and entitlements to claims will be
met notwithstanding the advertised prize pool has been exceeded.
37. Printing errors or other quality control matters will not be used as a reason for refusing payment of prizes.
38. MAJOR PRIZE DRAW: Each valid entrant who has entered the competition for the Major Prize draw over the duration of the promotional period will be
entered into the draw. 1 valid entrant will be drawn at random to become the Major winner. The draw will take place at Beinteractive Pty Ltd, Level
9, 155 George Street, Sydney NSW 2000, on Monday 3 August 2009 at 11am (AEST).
39. INSTANT WIN: At the conclusion of the competition all entrants excluding Instant Winning entries will be entered into a draw to win any un-won
prizes. The draw will take place at Beinteractive Pty Ltd, Level 9, 155 George St, Sydney NSW 2000 on Monday 3 August 2009 at 11.30am (AEST).
40. The Major winner will be notified by telephone within 2 days of the draw and all winners (Major and Instant) will also be sent a letter advising
them of their prize. The Major Prize Winner will be published in the Public Notices section of The Australian newspaper on Monday 17 August 2009 and
on the TV1 website at www.tv1.com.au.
41. Prizes will only be awarded to the entrant whose name appears in the SMS entry. However, in a dispute, will be awarded to the account holder of
the subscription television account.
42. Should an entrant’s contact details change during the promotional period, it is the entrant's responsibility to notify the Promoter. A request to
access or modify any information provided in an entry should be directed to Promoter.
43. Subject to State Regulation, an unclaimed prize draw will take place at Beinteractive Pty Ltd, Level 9, 155 George Street, Sydney NSW 2000 on
Tuesday 3 November 2009 at 11:00am (AEDT) and any winners will have their details published in the Public Notices section of the Australian on Tuesday
17 November 2009.
44. The promoter’s decision is final and the promoter will not enter into correspondence regarding the Competition result.
45. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s
requirements.
46. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its
absolute discretion.
47. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with
the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures,
tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the
competition and recommence it from the start on the same conditions, subject to any written directions given under State Regulation.
48. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss)
or for any personal injury suffered or sustained in connection with any prizes except for any liability which cannot be excluded by law. The Promoter
is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated
with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of
this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile
or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
49. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of
these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The
Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
50. TV1, Beinteractive Pty Ltd and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion,
defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and
reserves the right to take any action that may be available.
51. If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering,
unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration,
security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any
individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition,
subject to any written direction given under State Regulation.
52. All entries become the property of the Promoter. The Promoter collects personal information about you to enable you to participate in this
promotion but no further use of this information will be made without prior consent. By entering, an entrant consents to the Promoter’s privacy
policy, which can be found at: http://www.tv1.com.au/Legal/PrivacyPolicy.asp.
53. Beinteractive Pty Ltd, on behalf of TV1, is collecting the entrant's personal information for the purpose of conducting and promoting this
competition (including but not limited to determining and notifying winner). The entrant's personal information may be disclosed to Beinteractive Pty
Ltd for this purpose. If you are not willing for this to occur you cannot participate in the Promotion.
54. Entrants’ personal information may be disclosed to State and Territory lottery departments and winners’ names published as required under the
relevant lottery legislation. A request to access, update or correct any information should be directed to the Promoter.
