1. Information regarding prizes and how to enter forms part of these conditions. By entering, entrants accept these conditions.
2. Entry is open only to residents of Australia aged 18 or over except directors, management and employees (and the immediate families of
directors, management and employees) of the Promoter, participating stores, or of the agencies or companies associated with this competition.
3. The competition begins at 9:00am (AEST) on 17 August 2009 and closes at 11:59pm (AEST) on 30 September 2009 (Competition Period).
4. To enter, consumers must:
(a) purchase a W Series Walkman® MP3 Player (model number NWZ-W202MP3) from any participating store throughout Australia during the Competition
Period; and
(b) register the purchase within 14 days of purchase by logging on to www.sony.com.au and following the prompts. Entrants will be required to enter their first name, surname, age, gender, postal address, email
address, telephone number, model purchased, store purchased from, date of purchase and receipt number.
5. Payment for the product must be made in full. Lay-Bys and pre-orders will not be considered eligible purchases. Multiple entries will be
permitted, but each entry must be based on a separate qualifying purchase and must fully comply with these Conditions of Entry. Entrants must retain
their original receipt to verify each entry and to be able to claim a prize. Failure to provide this/these to the Promoter upon request may, at the
Promoter’s discretion, result in an invalid entry (and, at the Promoter’s discretion, in all of the entrant’s entries being invalid).
6. Entries must be received by the Promoter during the Competition Period. Entries will be deemed to be received at the time of receipt in the
Promoter’s database and not at the time of transmission by the entrant. The Promoter accepts no responsibility for any late, lost, incomplete,
misdirected, incorrectly submitted, delayed or illegible entries, claims or correspondence whether due to error, omission, alteration, tampering,
theft, destruction or otherwise.
7. The Promoter has no control over mobile telephone communications, internet communications, networks or lines and accepts no responsibility for
any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any
consequences of user error including (without limitation) costs incurred.
8. The draw will be conducted at 3.00pm (AEST) on 2 October 2009 at Greeneagle Distribution at Unit 10, 20 Ricketty Street, Mascot, NSW 2020. The
first valid entry randomly drawn will win the prize described below.
9. The prize is a trip for the winner and three friends to Hawaii to attend the Pipeline Masters, including:
(a) return economy airfares for 4 adults to Hawaii departing from Sydney (for winners and/or their companions residing outside New South Wales,
the Promoter will also arrange flights to Sydney from the winner’s nearest capital city in Australia at no expense) valued at up to $11,000 (including
GST), depending on the departure point;
(b) twin share accommodation for 4 people for 6 nights in Waikiki valued at $5,998 (including GST);
(c) 2 days car hire valued at approximately $300 (including GST), subject to the winner meeting the supplier’s requirements (eg. current valid
driving licence);
(d) return airport transfers valued at up to $600 (including GST)
(e) all main meals valued at up to $2,400 (including GST);
(f) 4 x $500 Billabong clothing packs, together valued at $2,000 (including GST);
(g) a day at the Billabong House on the North Shore to watch the Pipeline Masters event; and
(h) a surf lesson for four people with a Billabong Pro Rider.
10. Prize must be taken by the winner and his or her travelling companions between 15 and 23 December 2009. The Promoter is not obliged to supply
substitute prizes where the winner does not satisfy the conditions of use for any element of the prize, or does not accept any element of the prize.
The prize package is valued at up to $22,298 depending on the point of departure (including GST). The winner’s travelling companions must be aged 18
years or over. Flights and accommodation are subject to booking and availability. All other costs associated with the prize, including but not limited
to any additional transfer costs, taxes, insurance and other ancillary costs are the responsibility of the winner and travelling companions. The
winner and travelling companions are responsible for ensuring that they have all necessary documents to travel to Hawaii (including a current passport
and any visas that may be required).
11. Entrants acknowledge that there are inherent risks in some aspects of the prize and that using the prize involves participating in dangerous
activities. By entering this competition and accepting the prize, entrants accept that risk.
12. It is the winner’s responsibility to ensure that they and their companions are sufficiently healthy and fit so as to safely take the trip and/or
undertake the activities awarded as part of the prize. The Promoter reserves the right to deem that the winner or their companions are not
sufficiently healthy or fit. The winner must comply with all requirements and directions of the people responsible for the conduct of the relevant
activity and must ensure that their companions also comply.
13. The winner and travelling companions must sign an indemnity and exclusion of liability release form (provided by the Promoter) in favour of all
parties involved in this competition and/or providing the prize prior to undertaking the activities included in the prize. If a winner or their
nominated companions do not sign the indemnity form provided by the Promoter within the time requested by the Promoter, the winner’s entry will be
deemed invalid.
14. The winner and their travelling companions must, at the Promoter’s request, participate in all promotional activity (such as publicity and
photography) surrounding the winning of the prize, without compensation.
15. Prize value is the recommended retail price as provided by the supplier(s).
16. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or
consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any
person’s negligence) in connection with this competition or accepting or using any prize, except for any liability which cannot be excluded by law (in
which case that liability is limited to the minimum allowable by law).
17. The winner will be notified by mail and telephone using the details provided in their entry form by 4 October 2009. The winner’s name and
state/territory of residence will be published in The Australian newspaper on 9 October 2009. By entering this competition, each entrant requests that
his or her full address not be published.
18. The Promoter may require the winner and/or their travelling companions to provide proof of identity, proof of relevant employment, proof of age
and proof of residency at the nominated prize delivery address. Identification considered suitable for verification is at the Promoter’s discretion.
19. If a winning entry is deemed not to comply with these conditions of entry, the entry will be discarded and a new winner of that prize will be
determined by drawing a further valid entry in accordance with paragraph 25. The Promoter’s decision is final and no correspondence will be entered
into.
20. The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by, any person who
tampers with or benefits from any tampering with the entry process or with the operation of the competition or acts in violation of these conditions,
acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person.
21. Prizes are not transferable or exchangeable and cannot be redeemed for cash. In the event for any reason a winner does not take an element of
the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be supplied in lieu
of that element of the prize. The Promoter accepts no responsibility for any variation in prize value. Where a prize is unavailable for any reason,
the Promoter may substitute for that prize another item of equal or higher value as determined by the Promoter, subject to the approval of the gaming
authorities in each state and territory, where required.
22. Where a prize involves the winner and his or her travelling companions: (a) attending an event, if any part of the event is abandoned, called
off, varied or postponed for any reason, then at the Promoter’s discretion, the winner (and their companions) forfeit all rights to attend the
relevant event and no cash or alternative tickets will be substituted for that element of the prize; and/or (b) meeting or attending a function with a
celebrity or other public figure, the Promoter will not be liable for the failure of the winner (and their companions) to meet that person or failure
of that person to attend the function, for whatever reason.
23. If for any reason any aspect of this competition is not capable of running as planned, including by reason of infection by computer virus,
mobile network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter which
corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition, the Promoter may in its sole discretion
cancel, terminate, modify or suspend the competition, or invalidate any affected entries, subject to the approval of the gaming authorities in each
state and territory, where required.
24. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be
sought. Where the operation of this competition results in, for GST purposes, supplies being made for non-monetary consideration, entrants agree to
follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST
inclusive market values.
25. In the event of the prize not being accepted or claimed by 6 November 2009, the relevant winner’s entry will be deemed invalid and the Promoter
reserves the right to conduct such further draws at 3.00pm (AEST) on 6 November 2009 at the same location as the original draw as are necessary to
distribute the prize, subject to any written directions given by any relevant authority. In the event of a winner, their name and state/territory of
residence will be published in The Australian newspaper on 9 November 2009.
26. The information entrants provide will be used by the Promoter for the purpose of conducting this competition. The Promoter may disclose
entrants’ personal information to its contractors and agents to assist in conducting this competition or communicating with entrants. The Promoter is
bound by the National Privacy Principles in the Privacy Act 1988. Entrants can request access to the personal information the Promoter holds about
them by contacting the Promoter at the address below. All personal information will be stored at the office of the Promoter. A copy of the Promoter’s
Privacy Policy in relation to the treatment of personal information collected may be obtained by contacting the Promoter.
