Information on how to enter and prizes form part of these Terms and Conditions. Participation in the promotion is deemed acceptance of these Terms and Conditions

The promotion is only open to Australian residents who are current or new members of the Take 5 online Club at www.take5mag.com.au during the promotional period. Employees of the Promoter, their immediate families, authorised outlets and agencies associated with this promotion are ineligible to enter.

Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to all terms and conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to this promotion. If a prize winner is under the age of 18 years, the prize will be awarded to the winner’s nominated parent or guardian on the winner’s behalf.

The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who does not participate in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. Errors and omissions will be accepted at the Promoter’s discretion.

The entire promotional period commences on Thursday 24 March 2016 and closes on 11:59pm (AEDST) on Wednesday 15 December 2016. There will be a draw conducted every second Thursday from 7 April 2016 to 15 December 2016 inclusive, excluding NSW public holidays in which case the draw will take place the following business day. Entries into each draw will be the Take 5 Club Badge Numbers of new and current members that are registered as at 11:59pm AEST/AEDST (where applicable) the day prior to each draw. The closing date of each individual promotional period will be advertised on the Take 5 website (www.take5mag.com.au). Each draw will take place at 12:01am AEST/AEDST (where applicable) at the Bauer Media, 54 Park Street, Sydney NSW 2000.

For the removal of doubt One (1) Take 5 Club Badge Number will be drawn in each draw. All un-drawn Take 5 Club Badge Numbers in each draw will be carried over into the subsequent draws.

The Promoter reserves the right to draw additional reserve entries (and record them in order), in the event that an invalid entry is drawn or an entrant drawn is ineligible.

A Take 5 club member (except residents of SA) is limited to being drawn once during the entire promotional period.

To be eligible to enter, each entrant must be a current or new member of the Take 5 online Club and have a registered Take 5 online Club Badge Number as of 11:59pm AEST/AEDST (where applicable) each Wednesday (day prior to each individual promotional period as advertised on www.take5mag.com.au ). For the removal of doubt new members of Take 5 club who register after this time will be entered into subsequent draw periods.

Each eligible Take 5 member must log onto www.take5mag.com.au between Issue 14 (2016) on sale 24 March 2016 and Issue 51 (2016) 15 December 2016 and check to see if their Take 5 online Club Badge Number has been drawn for that issue. If the entrant’s Take 5 Club Badge Number has been featured on www.take5mag.com.au , that entrant is entitled to claim the prize available at that time.

To claim a prize: the valid drawn member must then visit www.take5club.com.au and follow the prompts to the Take 5 club badge claim form and confirm their details including name, mailing address and daytime telephone number. If a drawn member does not complete this requirement and claim the prize by the relevant close date, then their prize is forfeited by the member and the value of the prize available will be carried over to the next week’s prize pool as part of a jackpot for the next drawn member to redeem. For the avoidance of doubt, the final date for which the final prize may be claimed will be 11:59pm (AEDST) on 11/01/2017.

The member’s name and badge numbers of drawn members who successfully claim a prize will be published in the relevant Take 5 on sale Thursdays from 21 April 2016 to 5 January 2017. Each Member (winner) may be asked to present their Take 5 Club membership number and identification at the prize delivery address in order to receive their prize. The Promoter’s decision is final and no correspondence will be entered into.

In the event that Take 5 magazine printing is changed, delayed or cancelled, the winner announcements that were scheduled for that relevant Take 5 magazine issue will be carried out in the following available issue.

The Promoter reserves the right to request that winners provide proof of identity. Identification considered suitable for verification is at the discretion of the Promoter.

Prize:

The minimum prize pool to be won in each individual draw period is $1,000. Any monies that are not successfully claimed in accordance with Clause 9 and 10 will be added to the next draw’s prize pool. The maximum prize pool available to be won in an individual draw period is $19,000. For the removal of doubt, the maximum prize value would only be awarded if no drawn members successfully claimed a prize for Issue number 14/15 (2016) to issue number 50/51 (2016), or in the event of an unclaimed prize draw in which there had been no valid claims for prize money received during the entire promotional period.

The total maximum prize pool available is $19,000 (including GST). Prizes will be awarded in the form of a cheque made in favour of the winner. Any ancillary costs associated with redeeming the prize are not included. These are the responsibility of the winner.

In the event that as at 11/01/2017 there is still unclaimed prize money, all undrawn entries will be entered into the unclaimed prize draw, to be conducted at 11:00am (AEDST) on 15/03/2017 at the Bauer Media, 54 Park Street, Sydney NSW 2000. The first valid entry drawn will be awarded any unclaimed prize money. For the avoidance of doubt, this will be a minimum prize pool of $1,000 and a maximum prize pool of $19,000. The winner, if any, will be notified in writing within seven (7) days of the draw and their name will be published on www.take5mag.com.au on 20/01/2017.

Prize must be taken as offered. The prize, or any unused portion of the prize, is not exchangeable. The prize cannot be used in conjunction with any other special offer. The prize is valued in Australian dollars. The Promoter accepts no responsibility for any variation in the prize value. Prize winner is advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize.

If the winner is under the age of 18 years, the prize will be awarded to the winner’s parent or legal guardian on behalf of the winner. It is the responsibility of the winner’s parent/legal guardian to prove their parental status/ legal guardianship at the time of winner notification. In the event that for any reason whatsoever a person/s mistakenly represents themselves to be a winners parent and/or legal guardian, then that person will be liable for all costs associated with relocating and/or re-awarding the prize (including but not limited to and administrative fees incurred by the Promoter). Where relevant., the Promoter is only responsible for ensuring that the prize is awarded to a person who is either a parent or legal guardian of the winner. The Promoter is not responsible for determining any other delivery details or taking direction that relates to any ongoing family law negotiations and/or determinations. These are the responsibility of the winner and their respective parent/s and/or legal guardian/s.

The prize will be delivered to the nominated address of the Prize winner. Delivery of the Prize is valid to any state and/or city in Australia.

In the event that for any reason whatsoever the Winner does not take the prize at the time stipulated by the Promoter, then the prize will be forfeited by the Winner and cash will not be awarded in lieu of the prize.

In the event that a prize, or part of a prize, is unavailable, the Promoter reserves the right to substitute the prize or part of the prize in its discretion with an alternative prize or part of the prize to the same and equal recommended retail value and/or specification subject to any written directions from the various Lottery Departments.

Unless otherwise due to fraud or ineligibility under these terms and conditions, all valid prize claims in excess of the advertised prize pool will be honoured. All advertised instant prizes will be awarded.

Printing and other quality control errors will not invalidate an otherwise valid prize claim. In the event of a query as to the validity of an entry, the judges will determine whether or not the entry is to be deemed valid, taking into consideration all mitigating circumstances and knowledge available to them at the time of the judging. No correspondence will be entered into.

The promoter is neither responsible nor liable for any late lost or misdirected mail (including but not limited to prizes).

The Promoter is not responsible nor liable for any prize damaged in transit in the delivery of their prize.

Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

In the event of unforeseen circumstances, war, terrorism, state of emergency or disaster (including but not limited to natural disaster)the Promoter reserves the right to subject to reference to all relevant state and territory rules and regulations, to cancel, terminate, modify or suspend the promotion.

If a medical circumstance in some way restricts your ability to enter the competition through the required mechanic, you are still eligible to enter however you must briefly state your circumstances upon entry.

If your entry is selected as a winning entry, validation of your circumstances/ the validity of your entry will be undertaken by the Promoter. Method of validation (without limitation) will be determined by the Promoter in its complete discretion. If the winning entry is deemed to be a winner, the winner will be notified as per the terms and conditions herein. In the event that the Promoter requests the entrant to sign any legal documents relating to the verification of their medical circumstance, the legal documents will take the form determined by the Promoter. It is a condition of accepting the prize the winner sign any such legal documentation.

Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.

If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

Privacy: The Promoter collects personal information (“PI”) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its privacy policy, which can be accessed by visiting http://www.bauer-media.com.au/privacy.htm. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may also, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct PI to the Promoter and direct any complaints regarding treatment of their PI according to the Privacy Policy. All entries become the property of the Promoter.
