CANADIAN CLUB BAD SWEATER ON PACK OFFER TERMS AND CONDITIONS
Instructions on how to claim the Bad Sweater (defined in clause 8) form part of these Terms and Conditions. Participation in this offer is deemed
acceptance of these Terms and Conditions. Offer not valid in conjunction with any other offer.
The promoter of this offer is Beam Suntory Australia Pty Ltd (ABN 85 003 953 357) of Level 18, 100 Pacific Highway, North Sydney, 2060 (“Promoter”).
Offer is only open to Australian residents aged 18 years or over. Employees (and their immediate families) of the Promoter, participating stores, and
agencies associated with this offer are ineligible to participate. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse,
child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister,
step-brother, step-sister or 1st cousin.
Offer commences on 01/06/2021 and ends at 11.59pm AEST 30/09/2021 or when three thousand (3,000) valid claims are received online, whichever is first
to occur (“Offer Period’).
For the purposes of this promotion an “Eligible Product” is
a specially-marked 24 pack of Canadian Club & Dry.
To be eligible to claim a Bad Sweater as part of this offer, individuals must complete the following steps during the Offer Period:
Purchase an Eligible Product from a participating store. All Eligible Products will feature a special code (“Special Code”) and instructions regarding
how to claim; and then
visit https://ccbadsweater.com (“Offer Website”) and complete the following steps:
follow the prompts to the claim page;
input the requested details (including the Special Code);
pay $19.95 in postage & handling fees, via PayPal OR Visa, MasterCard & American Express via PayPal. Payment will be processed at the time of
submission of the claim form;
agree to the Terms and Conditions of the offer and the Promoter’s Privacy Policy by ticking the relevant tick-box; and then
submit the fully completed claim form so it is received no later than 11.59pm AEST 30/09/2021, or before stocks of Bad Sweaters are exhausted,
whichever is first to occur (“Claim”). Once a Claim has been successfully submitted, participants will receive a confirmation email to the email
address specified on their form.
A participating store is any off-premise retailer in Australia that stocks an Eligible Product.
Once stocks of the Bad Sweaters are exhausted, they will no longer be available at the Offer Website for claiming. Offer is strictly limited to the
first three thousand (3,000) Claims received via the Offer Website.
The first three thousand (3,000) valid Claims received online will each receive a Canadian Club bad sweater valued at RRP$89.95 (“Bad Sweater”).
Bad Sweaters will only be available in two (2) sizes: small/medium (1,050 available) and large/x-large (1,950 available). Each individual will be able
to choose their preferred size at the time of Claim submission, subject to size availability (once a particular size runs out, it will no longer be
available for selection on the Offer Website). Only three thousand (3,000) Bad Sweaters are available overall and the offer is strictly limited to the
first three thousand (3,000) Claims received via the Offer Website.
Successful participants will be notified via email. The Bad Sweater will be delivered to the address specified on the Claim form within four (4)
weeks.
Total value of the offer is $269,850.
Incomplete or indecipherable Claims will be deemed invalid.
Multiple Claims permitted, subject to the following: (a) only one (1) Claim permitted per Eligible Product product purchased; (b) each Claim must be
submitted separately and in accordance with offer requirements; (c) only one (1) Special Code per Claim is permitted; (d) the same Special Code cannot
be used more than once; (e) unrecognised codes will be deemed invalid; (f) a maximum of one (1) Claim per day is permitted for NSW residents and a
maximum of two (2) Claims per day are permitted for residents of all other States and Territories. Offer is strictly limited to the first three
thousand (3,000) Claims received via the Offer Website.
Participants must retain the portion of the specially marked packaging showing the Special Code for all Claims as proof of purchase. Failure to
produce the proof of purchase when requested will, in the absolute discretion of the Promoter, result in invalidation of a participant’s Claim and
forfeiture of any right to a Personalised Sweater. Purchase receipt(s) must clearly specify the store of purchase and that the purchase was made
during the Offer Period but prior to Claim submission.
The Promoter reserves the right, at any time, to verify the validity of Claims and participants (including a participant’s identity, age and place of
residence), and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of
these Terms and Conditions, tampered with the Claim process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and
proper conduct of the offer. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights
at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender
are reserved.
If there is a dispute as to the identity of a participant, the Promoter reserves the right, in its sole discretion, to determine the identity of the
participant.
The Promoter’s decision in all matters regarding the offer is final and no correspondence will be entered into.
If any advertised Bad Sweater is unavailable, the Promoter, in its sole discretion, reserves the right to substitute the Bad Sweater with an item to
the equal value and/or specification.
Bad Sweaters are not transferable or exchangeable and their value cannot be taken as cash.
Successful participants consent to the Promoter using their name, likeness, image and/or voice (including photograph, film and/or recording of the
same) in any media for an unlimited period without remuneration for the purpose of promoting this offer (including any outcome), and promoting any
products manufactured, distributed and/or supplied by the Promoter.
If this offer is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable
control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in
its sole discretion, to the fullest extent permitted by law (a) to disqualify any participant; or (b) to modify, suspend, terminate or cancel the
offer, as appropriate.
Any cost associated with accessing the Offer Website is the participant’s responsibility and is dependent on the Internet service provider used.
The Promoter encourages consumers to enjoy alcohol responsibly. Legal aged consumers are advised to consider the safe drinking levels recommended in
the National Health & Medical Research Council Australian Alcohol Guidelines that are available at www.nhmrc.gov.au. Entry and continued participation in this promotion is subject to the licensee’s liquor serving policy.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as
provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the
States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the
Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for
any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out
of the offer.
Except for any liability that cannot by law be excluded, restricted or modified, including the Non-Excludable Guarantees, the Promoter (including its
respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any
loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical
difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference;
(c) any Claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the
reasonable control of the Promoter; (d) any variation in the value of the Personalised Sweater to that stated in these Terms and Conditions; (e) any
tax liability incurred by a participant; and (f) taking and/or use of the Personalised Sweater.
The Promoter collects personal information ("PI") in order to conduct the offer and may, for this purpose, disclose such PI to third parties,
including but not limited to agents, contractors, service providers and suppliers. Participation is conditional on providing this PI. The Promoter
will also use and handle PI as set out in its Privacy Policy, which can be viewed at http://www.beamsuntory.com/privacy-policy. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an
indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending
electronic messages or telephoning the participant. The Privacy Policy also contains information about how participants may opt out, access, update or
correct their PI, how participants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those
complaints will be dealt with. All Claims become the property of the Promoter. Unless otherwise indicated by the Promoter, the Promoter may disclose
PI to entities outside of Australia (see the Promoter’s Privacy Policy for details).
