General
1. These terms and conditions of entry, including information on how to enter and prize details ("Terms and Conditions"), apply to this promotion
("Promotion").
2. Entry into this Promotion is deemed to be acceptance of these Terms and Conditions.
3. To the extent of any inconsistency between these Terms and Conditions and any other advertisements or reference to this Promotion, these Terms and
Conditions prevail.
4. The promoter is Lindt & Sprungli (Australia) Pty Ltd (ACN 079 224 892) of 16 Hollinsworth Road, Marsden Park NSW 2765 ("Promoter").
Dates of Promotion
5. The Promotion opens at 9am [Australian Eastern Standard Time ("AEST")] on April 16th 2024 and closes at 11:59pm [AEST] on [June 17th 2024 ]
("Promotion Period").
Entry Requirements
6. Entry is open to all Australian residents aged 18 years or over, except employees of the Promoter and their immediate family members, companies and
agencies associated with this Promotion and related companies thereof ("Eligible Entrants"). Immediate family means any of the following: spouse,
ex-spouse, de facto spouse, child or step child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt,
niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
How to Enter
7. To enter the Promotion, a customer must complete the following steps during the Promotion Period:
a. visit any Lindt Chocolate Shop in Australia (including the Lindt Factory Outlet) or Lindt's Australian online store, accessible through the
website lindt.com.au, and spend a minimum of AU$25 (including GST). Entrants must retain copies of all purchase receipts;
b. complete an entry form online, available at the URL lindt.com.au. The information that must be completed as part of the entry form includes:
name, email address, purchased store, receipt number and date of birth. Entrants may only enter in their own name; and
c. opt-in to the Promoter's database by confirming their email address. Shortly after the entry form has been completed, an email will be sent to
the email address nominated in the entry form with instructions to opt in.
8. Multiple entries are permitted, however one entry is permitted per transaction and per email address.
Prize Draw Details
9. This Promotion is a game of chance. A representative of the Promoter will input all eligible entries (Eligible Entry) into a draw to be randomly
selected via a random number generator (Draw). The Draw will take place at the promoter’s premises Lindt & Sprungli, 16 Hollinsworth Road,
Marsden Park, at 10am [AEST] on July 1st, 2024
10. The first Eligible Entry to be randomly selected in the Draw will win the major prize on offer ("Major Prize").
11. The next fifty Eligible Entries, excluding any entries which have already been drawn, to be randomly selected in the Draw will each win the minor
prize on offer ("Minor Prize").
12. The total prize pool is valued at approximately AU$19,500 (including GST).
13. The winners of the Major Prize and Minor Prize ("Prize Winners") will be notified via email on July 5th and announced by the Promoter on the
Promoter's Facebook and Instagram within 30 days of the Draw.
14. The Promoter will use reasonable efforts to contact the Prize Winners. It is the responsibility of the entrants to check junk/spam mailboxes to
ensure that they receive any communications relating to the Promotion.
15. If a Prize Winner cannot be contacted, is unavailable or is otherwise unable to redeem the prize within one month of the Draw, the Promoter will
select another winner for the prize at the Promoter's premises at 10am [AEST] on August 5th 2024 ("Re-Draw"). The winner of the Re-Draw will be
notified via email within 5 business days of the Re-Draw and announced by the Promoter on the Promoter’s Facebook and Instagram. If the winner of the
Re-Draw is unable to be contacted despite the Promoter's reasonable efforts, subsequent re-draws will take place in the same manner until the prize is
claimed by the winner of the latest re-draw.
Description of Major Prize
16. The Major Prize is valued at approximately AU$15,000 (including GST) and comprises:
a. two (2) return economy flights (including applicable airport/airline taxes) from the Major Prize winner's nearest capital city in Australia to
Zurich, Switzerland;
b. four (4) nights stay in a four (4) star accommodation (twin share) in Zurich, Switzerland for two (2) adults ("Hotel");
c. attendance at a “Meet and Greet with Roger Federer” event (details TBC, subject to Roger Federer’s availability);
d. participation in a Lindt chocolate workshop at the Lindt head office in Kilchberg taking place during the visit;
e. transfers to and from airport in Zurich to the Hotel; and
f. a Swiss dinner experience.
17. The Major Prize excludes:
a. spending money, additional meals, additional taxes, insurance, passports, visas, vaccinations, transport to and from departure point, items of
a personal nature, in-room charges and all other ancillary costs.
18. The Major Prize must be accepted as awarded, and cannot be transferred, assigned or exchanged for cash.
19. All components of the Major Prize must be taken together in a single trip and cannot be redeemed separately. Any part of the Major Prize that is
not taken for any reason is forfeited. The Major Prize cannot be exchanged for other travel, flights or accommodation at other destinations.
20. The Promoter requires the Major Prize winner and his/her travelling companion cover themselves with full travel insurance valid for international
travel. Receipt of insurance for each person travelling must be supplied to the Promoter prior to travel. Should the Major Prize winner and his/her
travelling companion fail to take out travel insurance, the Promoter will require them to sign a waiver prior to travel.
21. The Major Prize winner and his/her travel companion must be available to travel to Switzerland during August – November 2024, with the exact
travel dates to be determined and confirmed by the Promoter closer to the actual travel dates and subject to booking and flight availability. The
itinerary shall be determined by the Promoter in consultation with the Major Prize winner but in the event that agreement cannot be reached, the
Promoter reserves the right to determine the itinerary of the Major Prize in its sole discretion.
22. The Major Prize winner acknowledges and agrees that the "Meet and Greet with Roger Federer" component of the Major Prize is subject to Roger
Federer's availability, which is outside the Promoter's control. In the event that the meet and greet is cancelled, the Promoter may reschedule the
Major Prize to take place at another time.
23. The Major Prize winner and his/her travel companion are solely responsible for obtaining valid passports and any other documents necessary for
international travel. They are also responsible for any travel and accommodation required to transfer to the Australian city of departure.
24. Once the tickets are issued, the names of the travelers cannot be changed.
25. The Promoter is not responsible for, and no refund or compensation will be made in the event of the cancellation or delay of any flight.
26. If for any reason the Major Prize winner and/or his/her travel companion do not comply with these Terms and Conditions, the Major Prize winner
acknowledges and agrees that they may be required to forfeit the Major Prize.
Description of Minor Prize
27. The Minor Prize is a Lindor Hamper valued at AU$90 (including GST) and includes delivery to the address nominated by the Minor Prize winner, as
specified in the Promotion entry form. There are 50 Minor Prizes on offer.
28. The Minor Prize must be accepted as awarded, and cannot be transferred, assigned or exchanged for cash.
29. A valid Australian street residential address must be provided by the Minor Prize winners. The Promoter will make all reasonable efforts to
deliver the Minor Prizes to the addresses provided by the Minor Prize winners within 28 days.
30. Due to the perishable nature of the Minor Prize, the Promoter recommends that the Minor Prize winners are present at their nominated residential
addresses to ensure the Minor Prize is properly received and stored. The Promoter takes no responsibility for any damage or deterioration in the
Minor Prizes post-transit. Any Minor Prize which is damaged, or deteriorates, post-transit will not be substituted or replaced by the Promoter.
Further Terms and Conditions
31. The Promoter reserves the right to amend, cancel or suspend the Promotion if an event beyond the control of the Promoter affects the
administration, security, fairness, integrity or proper conduct of the Promotion. The Promoter will disqualify any individual who has tampered with
the entry process or any other aspect of this Promotion.
32. If for any reason the Promotion is not capable of running as planned, including but not limited to, infection by computer virus, bugs, tampering,
unauthorised intervention, fraud, technical failures or any causes beyond the control of Lindt, which corrupt or affect the administration, security,
fairness or integrity or proper conduct of this Promotion, Lindt reserves the right in its sole discretion to take any action that may be available,
or to cancel, terminate, modify or suspend the Promotion subject to any direction given under applicable Australian law.
33. The Promoter and its related entities and associates shall not be liable for any issues or technical malfunctions which may affect any person
entering the Promotion or the judging of the Promotion.
34. Any entrant found to be entering incorrect details or engaging in fraudulent behaviour shall be immediately disqualified. If such an entrant is
awarded a prize then the Promoter, in its sole discretion, may remove that entrant as a winner.
35. The Promoter reserves the right to request a winner sign a deed of release or any other relevant forms or agreements that the Promoter deems
necessary, including to provide proof of identity in order to claim a prize. In the event that the winner cannot provide suitable proof the winner
will forfeit the prize and no substitute will be offered.
36. The Promoter’s decision in relation to all aspects of the Promotion is final and binding, and no correspondence shall be entered into. No
responsibility is accepted for late, lost or misdirected entries.
37. All entries and any copyright subsisting in the entries becomes and remains the property of the Promoter who may publish any of the entries
received. The Promoter and its related entities is collecting the entrant's personal information for the purpose of conducting and promoting this
Promotion, including the purpose of notifying the winners. The Promoter will handle all personal information in accordance with its internal privacy
policy and all relevant Australian Privacy Laws. By providing their personal information, entrants agree to the terms of this Promotion and the
Promoter’s privacy policy. In addition, by entering this Promotion, entrants consent to the Promoter and its related entities sending entrants
information regarding marketing services, programs and special offers. The Promoter shall always offer entrants the possibility of opting out of these
communications.
38. In participating in this Promotion, all entrants and winners agree to participate in all editorial and promotional activities relating to this
Promotion, including but not limited to being interviewed, photographed and recorded. All entrants and winners agree to grant the Promoter a perpetual
and non-exclusive licence to use such footage and photographs in all media worldwide, including all forms of online and social media. No entrant or
winner shall be granted a fee for such use.
Liability
39. To the maximum extent permitted by law, Lindt and any of its related companies or associated agencies excludes all liability to the Prize Winners
or anyone else for any injury, damages, expenses or loss whatsoever (including without limitation loss of profit, revenue or business and indirect,
consequential, special or incidental loss or damage), arising in any way out of or in connection with this Promotion, including the prizes offered as
part of this Promotion.
40. To the maximum extent permitted by law, Lindt excludes all guarantees, warranties, conditions, or other terms that apply under or are implied by
statute, common law or trade custom or usage.
41. Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as
provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the Australian Securities and Investment
Commission Act 2001 (Cth) or similar consumer protection laws in the States and Territories of Australia. If in the conduct of this Promotion Lindt
is liable for a breach of any guarantee, warranty, condition or other term that applies under the Australian Consumer Law or is implied by any other
Commonwealth, state or territory law that cannot be excluded, Lindt's liability under that legislation is limited, to the maximum extent permitted by
law, to: (a) if you are a Prize Winner, the cost of replacement of the Prize won; or (b) if you are not a Prize Winner, providing you with an
opportunity to participate in another like promotion by the Promoter.
Privacy
42. The Promoter collects personal information about you in order to enable it to conduct this Promotion, including to arrange the Major Prize, but no
further use of this information will be made without your prior consent. If you enter this Promotion, your personal information may be disclosed to
the relevant government department or otherwise published, as required by the applicable trade promotion laws in the States and Territories of
Australia or any other applicable law. Lindt otherwise will handle your personal information in accordance with our Privacy Policy available on our
website. Your use of our website may also be governed by our Cookies Notice, also available on our website. Please contact Lindt at the email address
listed in these Terms and Conditions if you have any queries or concerns. A request to access, update or correct any information should be directed to
the Lindt contact as set out below.
Disputes or complaints
43. If you have any dispute or complaint relating to the Promotion, please contact Lindt at our contact details below. Lindt will use its reasonable
endeavours to respond to you within [7] business days to discuss a resolution in good faith.
44. If Lindt has not resolved any dispute with you, you and Lindt agree to resolve such dispute through binding arbitration in accordance with, and
subject to, the Resolution Institute Arbitration Rules, with the arbitrator nominated by the Chair of the Resolution Institute unless agreed
otherwise.
45. You and Lindt agree that any dispute must be brought in your individual capacity and not as a plaintiff or class member in any purported class or
representative proceedings.

Yes I well remember a Woolies Lindt comp a few years ago which was a purchase and a WOL, yet was won by a creative mail in entry in the shape of a
tennis ball! |

Yep... I remember that too. I was still naive and had no idea about creatives... I lost many more prizes to creative entries, until I learned about
this sneaky angle. But these days, I alert promoters BEFORE the comp is over, so they can draw the winner, honestly, as per T&C's.

I wish we could purchase from our local supermarket. Unfortunately, I don't have an outlet anywhere near me.
I checked the online store and shipping was $15. That's a lot for a $25 spend.
You need to spend $100 to get free shipping. |

I ordered online and received an email confirming my order which stated I could enter the competition. I didn't receive a confirmation email after I
entered though.

According to terms
c. opt-in to the Promoter's database by confirming their email address. Shortly after the entry form has been completed, an email will be sent to the
email address nominated in the entry form with instructions to opt in.
I didn't get an email after entering so sent them an email to tell them.However yesterday I got an email from Lindt for advertising so I assume I'm on
their mailing list.(database)
