General
1. Participation in the ‘THE GREAT ORANGE GIVEAWAY PROMOTION (the “Competition”) is deemed acceptance of these Terms and Conditions.
The Promoter is Fizzy Mates Pty Ltd (ABN 79 639 187 849) t/as “Hard Fizz” of 16 Hibiscus Haven, Gold Coast, in the State of Queensland, telephone 1300
209 546 (Australia) (‘Promoter’).
Promotion
2. The Promotion is the ‘THE GREAT ORANGE GIVEAWAY PROMOTION’ (‘Promotion’).
3. The Promotion commences at 12:01 am on 9 August 2024 and ends at 11:59 pm (AEST) on 6 September 2024 (“Promotion Period”).
4. All entries must be submitted and received by the Promoter on or before 6 September 2024 at 11:59 pm (AEST).
Eligibility
5. Entry is only open to Australian residents over eighteen (18) years of age (“Eligible Entrants”). Employees, directors, and management of the
Promoter, their immediate families, and its agencies associated with the Competition are ineligible.
Entry into Competition (“Competition”)
6. There will be one (1) potential winner.
7. To enter the Competition, Eligible Entrants must, during the Promotion Period:
(a) Buy any 4 pack of Orange extra strength Hard Fizz from participating BWS and Dan Murphy’s bottle shops (and retain a copy of the receipt of
purchase);
(b) Visit the provided Google link to access the electronic entry form, follow the prompts, and enter the following details:
i. Input the requested details by completing all the fields within the electronic entry form
including but not limited to full name, email address, and postcode;
ii. Accept the Terms and Conditions; and
iii. Accept the Privacy Policy;
(c) Upload a copy of your receipt of purchase; and
(d) Submit the fully completed online entry form prior to 6 September 2024.
8. Entry is conditional on the provision of the personal information as requested.
9. Eligible Entrants shall receive an additional ‘bonus’ entry in the event that they share the Promotion to their Instagram story, and tag
@hard_fizz (“Bonus Entry”).
10. The Prize will be drawn by Random Number Generator at 4:00 pm on 8 September 2024 at 16 Hibiscus Haven, Gold Coast, in the State of Queensland
(“Draw Date”).
11. The Prize winner will be notified by email and telephone within seven (7) business days after the Draw Date being 15 September 2024.
12. The results of the Competition will be published to the Promoter’s Instagram page (@hard_fizz) within seven (7) business days after the Draw Date
being 15 September 2024.
13. Only two (2) entries per verified Eligible Entrant per day during the Promotion Period will be accepted.
14. Incomplete, indecipherable, or illegible entries will be deemed invalid.
15. Any Bonus Entry will be subject to verification of the Eligible Entrant's Instagram account via @hard_fizz tag.
The Prize
16. The one (1) winner of the Competition shall win, at the winner’s choice, either (i) a pallet of Orange Fizz; or (ii) $5,000.00 cash (valued at
Five Thousand dollars ($5,000.00)) (‘Prize’).
17. In the event that a winner is unable to satisfy these Terms and Conditions, forfeits, or does not claim or accept the Prize from the Promoter
within fourteen (14) days after being notified by the Promoter that they are the winner being no later than 15 September 2024, the winner agrees and
acknowledges that they forfeit their entitlement to claim the Prize.
18. In the event of any non-compliance, including but not limited to fraudulent activity, misrepresentation, criminal activity, and/or any
non-compliance of the Promoter’s Terms and Conditions, by a winner, an alternative winner may be selected by the Promoter at the Promoter’s sole
discretion. Any person attempting to defraud or in any way tamper with this Competition will be ineligible for Prizes and may be prosecuted to the
full extent of the law.
19. If there is a dispute as to the identity of an Eligible Entrant, the Promoter’s determination on who to award the Prize to is final.
20. The total Prize pool value is five thousand dollars ($5,000.00).
21. The Prize, or any unused portion of the Prize, is not transferable or exchangeable and cannot be taken as cash. The Prize is not redeemable for
cash or other goods and services.
22. The Promoter accepts no responsibility for any variation in the Prize values.
23. All taxes on any Prize won are the sole responsibility of the winner, including, without limitation, any federal or state taxes which may be
deemed applicable in such winner’s jurisdiction of residence. This Competition shall be governed by the laws of Australia. By participating in this
Competition, participants agree that the laws of Queensland, Australia, shall have jurisdiction over any dispute or litigation arising from or
relating to this Competition.
24. Prizes must be claimed from the Promoter within fourteen (14) days after being notified by the Promoter that they are the winner being no later
than 15 September 2024 at 5:00 pm (AEST). In the event of an unclaimed Prize, the Prize will be redrawn by Random Number Generator on 20 September
2024 at 9:00 am AEST at 16 Hibiscus Haven, Gold Coast, in the State of Queensland. The winners of the redraw will be notified by email within seven
(7) business days of the redraw. The results of the redraw will be published to the Promoter’s website (https://getfizzy.co) within seven (7) business days.
TERMS AND CONDITIONS
25. This is a game of chance, and skill plays no part in determining the winner.
26. Prize winners will be any eligible entrant who enters during the Competition Period and satisfies the eligibility requirements as set out
pursuant to these Terms and Conditions.
27. By entering this Competition, the Entrant agrees that the decisions of the Promoter in all matters regarding this Competition are final and
binding.
28. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is
prohibited and will render all entries submitted by that entrant invalid.
29. Except where legally prohibited, acceptance of the Prize constitutes permission for the Promoter to use the winner’s name, photograph, likeness,
voice, address (city and state only), testimonial, and the winning content, in printed, broadcast, or other media, whether now known or hereafter
developed, in perpetuity, in any manner it deems appropriate in connection with promoting this or any other contest of the Promoter and/or promotion
sponsored by it, without further compensation to the winner.
30. By participating and entering the Competition, the Eligible Entrant agrees that the Promoter collects participants’ personal information in order
to conduct the Competition. If the information requested is not provided, the participant may not participate in the promotion. A request to access,
update, or correct any information should be directed to the Promoter.
31. By participating and entering the Competition, the Eligible Entrant agrees that the Promoter and those involved in the development, production
(including Prize suppliers), implementation and distribution of this Competition and their respective parent companies, affiliates, subsidiaries,
service providers, and agencies, and their directors, officers, agents, employees, attorneys, and any other person or entity associated with such
entities and/or promotion (hereinafter collectively called "Promoters"), shall not be liable for any claims, damages, losses or injuries, including
any third party claims, arising from or relating to, in whole or in part, this Competition, including entry and participation in this Competition and
acceptance, possession, use or misuse of the Prize. All participants further agree that in the event of any third party claims, damages, losses or
injuries, arising from or relating to such participant’s participation in this Competition, such participant will indemnify and hold the Promoter and
the Promoters harmless from and against any and all such claims, including reasonable legal fees related thereto.
32. The Promoter reserves the right, in its sole discretion, to cancel or suspend this Competition should viruses, bugs or other causes beyond its
control corrupt the proper administration or security of the Competition.
Additionally, if for any reason any aspect of this Promotion is not capable of running as planned, including by reason of computer virus,
communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter,
the Promoter may in its sole discretion cancel, terminate, modify, or suspend the Promotion and invalidate any affected entries, or suspend or modify
a prize, subject to State or Territory regulation.
33. The Promoter reserves the right to modify the rules of the Competition in any way or at any time, as long as reasonable notice is given, and
subject to State regulatory approval if required.
34. To the extent that any term or condition of this Competition is void or prohibited by law, it shall be severable and the balance of Terms and
Conditions shall be subject to all relevant legislative requirements, including, without limitation, federal and state laws and regulations.
35. The Promoter does not warrant or guarantee the fitness for purpose, merchantability, functionality, or suitability of any Prize.
36. The Promoter reserves the right to disqualify, at its sole discretion, any entry where it reasonably suspects that such entry is prohibited by
these Terms and Conditions, any applicable law, or is otherwise deemed inappropriate.
37. The Promoter reserves the right to verify the validity of entries and Eligible Entrants (including the entrant’s age and identity) and reserves
the right to disqualify any Eligible Entrant for tampering or corrupting the entry process or for submitting an entry that is not (at the sole
discretion of the Promoter) in accordance with these Terms and Conditions. Any failure by the Promoter to enforce any of its rights at any stage does
not constitute a waiver of those rights.
38. The Promoter will not be held responsible or liable for entries that are delayed, lost, corrupted, misdirected, misdelivered, incorrect, or
incomplete, and such entries will not be eligible for this Competition.
39. The Promoter will not be held responsible or liable for any internet malfunction, interference or breakdown which prevents the participant from
entering, including but not limited to any technical malfunctions of any telephone network, computer on-line system, computer equipment or software;
program malfunctions or other failures; delayed computer transactions or network connections; any errors of any kind, whether human, mechanical or
electronic; or any combination thereof, including, without limitation, any injury or damage to the computer of any participant or any other person
related to or resulting from downloading any part of this Competition.
40. Nothing in these Terms and Conditions limits, excludes, modifies, or purports to limit, exclude, or modify the statutory consumer guarantees as
provided under the Competition and Consumer Act (Commonwealth of Australia) as well as any other implied warranties under the ASIC Act (Commonwealth
of Australia) or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability
that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents)
excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct,
indirect, special or consequential, arising in any way out of the promotion.
41. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective
officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or
damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties
or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry
or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the
reasonable control of the Promoter; (d) any variation in Prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a
winner or entrant; or (f) taking of or use of a Prize.
42. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties,
including but not limited to agents, contractors, service providers, Prize suppliers and, as required, to Australian regulatory authorities. Entry is
conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://getfizzy.co/pages/privacy-policy. The Privacy Policy also contains information about how entrants may access, update or correct their PI,
how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with.
All entries become the property of the Promoter.
43. As a condition of accepting the Prize, the winner must sign any legal documentation as, and in the form, reasonably required by the Promoter
and/or Prize suppliers.
44. The Promoter supports the responsible service of alcohol and promotes the responsible enjoyment and consumption of alcohol.
45. Entrants must retain their original follow and tags as proof of Entry and/or EDM entry receipt as applicable. Failure to produce the proof of
Entry for an Entry when requested may, in the absolute discretion of the Promoter, result in invalidation of an entrant’s entry and forfeiture of any
right to the Prize.
46. In the event that there is a dispute concerning the conduct of the Promotion or claiming a prize, the Promoter will resolve the dispute in direct
consultation with the complainant/entrant/winner. If the dispute cannot be resolved the Promoter’s decision will be final.
47. For event-based or travel prizes, the Prize winner and (if applicable) their companion(s) accept that some aspects of the prize may be inherently
risky and that the Prize may involve dangerous activities, for which the Promoter accepts no liability, and the winner undertakes at its own risk.
48. The Prize winner must, if required by the Promoter, sign reasonable disclaimer and release forms (as applicable) prior to receiving the Prize. If
the Prize winner or any companion(s) fail to sign disclaimer and release forms, the Prize winner’s entry may be deemed invalid and the Prize winner
may no longer be entitled to the Prize.
49. The Prize winner is responsible for companion(s) who participate in the Prize winner’s prize and the Promoter may disqualify all entries from,
and prohibit further participation in the Promoter’s competition and future competitions, should the Prize winner and/or its companion(s) breach these
terms and conditions, whether or not they are legally bound by them.
50. If the Prize winner (or its companion(s)), in the sole and absolute discretion of the Promoter (and/or a medical professional, as relevant to the
circumstances), is intoxicated, under the influence of alcohol or any other drug, behave aggressively or offensively, or behave in a manner which may
dimmish the good name or reputation of the Promoter or any of its related entities or the agencies or companies associated with this competition, is
contrary to law or is otherwise inappropriate, illegal, or dangerous, the Promoter may cancel the prize or restrict the Prize winner (and/or its
companion(s)) from participating in any elements of the prize.

The only way I could get it to work was on my phone and I had to go through it very slowly. It made me put in my personal details first and locked
the ability to upload the receipt and told me I had Zero entries.
Then I noticed that the upload receipt part was now unlocked and proceeded further to upload that and complete the entry.
