The Promotion is run by National Basketball League Pty Ltd (ABN 65 164 187 937) of Level 6,10 Queens Road, Melbourne VIC 3004 (Promoter). The Promoter has the permission of Coca-Cola Europacific Partners Australia Pty Limited (ABN 68 076 594 119) of Level 13, 40 Mount Street, North Sydney NSW 2060 (Business) to promote their business in this competition.

2. Information on how to enter, and the prize details, form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

3. If you are an eligible person and satisfy all entry requirements as set out below, then subject to these Terms and Conditions, you will be entered into the competition draw to win a prize (Promotion). Entries into the Promotion open at 10.00am 25th July 2024 and close at 11.59pm 7th November 2024 (Promotional Period).

Entrant requirements

4. Entry to the Promotion is open to all Australian Residents who are at least eighteen (18) years old at the time of entry and have a valid email address, who comply with the ‘Entry’ provisions set out below. An ‘Australian Resident’ means a person who resides in Australia at the start of the Promotional Period and who holds Australian citizenship or holds an Australian permanent residency visa.

5. Employees, contractors, directors and officers, and their immediate family and respective household members, of:

a. the Promoter;

b. the Business;

c. the related bodies corporate of the Promoter and the Business;

d. any advertising or promotion agencies of the Promotor and the Business; and

e. any Participating Venue as defined in paragraph 7 below,

are not eligible to enter. ‘Immediate family’ means any of the following: spouse, ex-spouse, de-facto spouse, child or stepchild (whether natural or by adoption), parent, stepparent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, stepbrother, stepsister or first cousin.

6. No separate entry fee applies to the Promotion, subject to the entry requirements.

Entry into the Promotion

7. To enter the Promotion and be eligible for the Prize Draw, entrants must, during the Promotional Period:

a. add one (1) Eligible Coca-Cola Variety Drink (subject to availbilty) to your meal from any Participating Venue OR purchase two (2) Eligible Coca-Cola Variety Drinks (subject to availability) in one (1) transaction from a Participating Venue (each such purchase being a Qualifying Transaction); and

b. following such purchase, scan the QR code available at the Participating Venue and follow the prompts to the Promotion entry page to input the requested details (including full name, email address, telephone number, post code, the Participating Venue your Qualifying Transaction was made at and confirmation as to the entrant’s availability to attend the prize weekend in San Francisco, USA during the window 14th February 2025 to 16th February 2025).

For the purposes of these Terms and Conditions:

Eligible Coca-Cola Variety Drink means each of the following, solely to the extent purchased in 600mL, 750mL, 500mL (bottle or can) or 32oz (cup) pack varieties: Coca-Cola Zero, Coca-Cola Classic, Coca-Cola Vanilla, Coca-Cola Vanilla Zero Sugar, Coca-Cola Raspberry Zero Sugar, Coca-Cola Lime Zero, Coca-Cola Lime, Coca-Cola Diet, Coca-Cola Zero Caffeine Zero, Sprite, Sprite Zero, Sprite Lemon Plus, Fanta, Fanta Zero, Powerade Mountain Blast, Powerade Berry Ice, Powerade Blackcurrant, Powerade Gold Rush, Powerade Lemon Lime, Powerade Zero Sugar variants, Powerade Active Water variants, Pump, Pump flavour variants.

Participating Venue means any store in Australia displaying, at the time of purchase, physical in-store advertising for this Promotion.

8. Multiple entries are only permitted subject to the following restrictions:

a. each Qualifying Transaction will entitle an entrant to a total of one (1) entry;

b. a maximum of three (3) entries is permitted per person per day; and

c. each entry must be submitted separately and in accordance with the entry instructions above.

9. The use of automatic entry software, mechanical or electronic devices that allow an individual to automatically enter the Promotion is prohibited and may render any entries submitted by that individual invalid.

10. Each entry must be made in accordance with these Terms and Conditions. By entering the Promotion, each entrant agrees to be bound by these Terms and Conditions. The Promoter may in its discretion refuse to award any prize to any entrant who fails to comply with these Terms and Conditions.

Prize Draw

11. The total maximum value of the Promotion prize pool is AU$10,000 (excluding GST) (as at May 2024).

12. There will be one (1) winner randomly selected who will receive a trip for two (2) people (the winner and a companion) to the USA which includes (collectively, the Prize Pool):

13. The time, location and duration of the trip, including the choice of airline, hotel and the basketball event will be decided in the sole discretion of the Promoter.

14. In order to be eligible for the Prize Pool, the winner must hold a valid passport and a valid U.S. Electronic System for Travel Authorization (ESTA) and be available to attend the weekend in San Francisco, USA during the window of 13th February 2025 to 17th February 2025.

15. The following is not included in the Prize Pool:

a. transfers;

b. meals;

c. taxes including any tax liability incurred by the winner or entrant;

d. insurance (excluding airline and airport taxes);

e. passports;

f. visas;

g. vaccinations;

h. transport to and from departure point;

i. transfers;

j. items of a personal nature;

k. in-room charges; and

l. all other costs not expressly itemised as part of the Prize Pool.

16. There will be one (1) draw conducted for the Promotion. The draw will be conducted using an electronic system to generate a random winner by Anisimoff Legal, an independent third party, located at 3 Amy Close, Wyong, NSW 2259 at 10:00am AEDT on Monday 11th November 2024. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn or the winner is unable to attend the USA weekend. In the event of war, terrorism, pandemic, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend or modify a prize, subject to any requirements of a relevant regulatory authority.

17. The winner and their companion must depart from and return to the same departure point and travel together. The itinerary, including the basketball event, will be determined by the Promoter in its absolute discretion. The Prize Pool is subject to the standard terms and conditions of each individual prize and the relevant service providers. If applicable, the winner may be required to present their credit card at time of accommodation check in.

18. As a precondition of being eligible to accept the Prize Pool, the winner and their companion must (if requested by the Promoter):

a. sign all reasonably required legal documentation in the form required by the Promoter in their absolute discretion, including, but not limited to, a media consent form, legal release and indemnity form; and

b. take out travel insurance to the Promotor’s satisfaction at their own expense (which may include comprehensive travel insurance covering property loss and damage and full medical cover). The winner and their companion must provide evidence of valid travel insurance to the Promotor in order to receive the Prize Pool.

19. As a precondition of being able to participate in the Promotion and without limiting any paragraph of these Terms and Conditions, the winner and their companion must consent to the Promoter and/or the Business recording their image and/or voice, photograph or capture their likeness in any media and grant an irrevocable license to use those recordings in any way which the Promoter and/or Business (as relevant) may use in any manner it wishes including to distribute, broadcast use either nationally or globally without remuneration. This includes granting the right to edit such media, the right to use the media along or together with other information and the rights to allow other parties to use and / or disseminate the media.

20. No component of the prize can be transferred or redeemed for cash or any other service provided by the Promoter.

21. In the event that any of the prizes become unavailable, or the basketball event is not available to form part of the Prize Pool, the Promoter reserves the right to provide a similar product or event to the same or greater value as the original prize, or pay to the winner the cash value of the basketball event that makes up the Prize Pool, subject to any applicable laws or written directions of a relevant regulatory authority.

22. Decisions of the Promoter are final and will be binding on each person who enters the Promotion, and no correspondence will be entered into.

Prize Awarding

23. The winner will be notified in writing by direct email message through the email supplied when entering the Promotion and their last name, first initial and post code published within 30 days following the draw at www.nbl.com.au/competitions.

24. The winner must respond to the Promoter’s notification message and provide prize delivery details in order to claim their prize. Each prize must be claimed within 7 days after the relevant notification date. Any unclaimed prize will be forfeited by the winner.

25. If the winner is unable to attend the USA trip on the selected dates, they must notify the Promoter as soon as possible and at a minimum within 7 days after the notification date. If the winner does not satisfy these Terms and Conditions, is unable to attend the USA trip on the selected dates or cannot be contacted within a reasonable timeframe in accordance with all requirements of all regulatory authorities, the entry will be invalidated, and a further entry drawn at the same place as the original draw on 18th November 2024 in order to distribute the unclaimed prize. All non-winning entries from the original draw will be included in the unclaimed prize draw. Any winner of the unclaimed prize draw will be notified in writing (via the contact details supplied when entering the Promotion) and the winner’s last name, first initial and post code will be published on www.nbl.com.au/competitions within 30 days of the relevant re-draw. This will continue until a valid winning entry is drawn for each prize draw.

26. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law:

a. to disqualify any entrant; or

b. subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.

27. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct, calculated to jeopardise fair and proper conduct of the Promotion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

28. The Promoter accepts no responsibility for any tax implications that may arise from prize winnings. All taxes which may be payable as a consequence of receiving the prize are the sole responsibility of the winner. Any additional costs involved are at the winner’s expense. Independent financial advice should be sought.

Exclusion of liability

29. To the full extent permitted by the law, neither the Promoter nor the Business will be liable for any injury, damages, expenses, or loss whatsoever (whether director consequential) to persons or property as a result of any person entering into the Promotion or accepting or using any prize.

30. Neither the Promoter nor the Business is responsible for any incorrect or inaccurate information, or for any of the equipment or programming associated with or utilised in this Promotion, or for any technical error that may occur in the course of the administration of the Promotion.

31. Neither the Promoter nor the Business assumes responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries.

Data collection and privacy

32. The Promoter and the Business collect personal information (PI) in order to conduct the Promotion and may, for this purpose, disclose such PI to other third parties, including but not limited to, agents, contractors, service providers and prize suppliers as required in Australia. Entry is conditional on providing this PI. The Promoter and the Business will also use, and handle PI as set out in NBL’s Privacy Policy available at http://www.nbl.com.au/privacy-policy/ and the Business’ Privacy Policy available at https://www.cocacolaep.com/company/privacy-notice/.

33. In addition to any use that may be outlined in the Privacy Policies identified above, the Promoter and the Business may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policies also contain information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter and the Business. The Promoter and the Business may disclose entrant's PI to any entity outside of Australia in accordance with their respective Privacy Policies.

General

34. Entrants agree that they are fully responsible for any materials or responses they submit via the Promotion including but not limited to comments, recordings and images (Content). The Promoter and the Business shall not be liable in any way for such Content to the full extent permitted by law. The Promoter may remove or decline to publish any Content without notice for any reason whatsoever. Entries containing offensive or defamatory Content, or which breach any law or infringe any third party rights, including intellectual property rights, are not eligible to win.

35. As a condition of entering the Promotion, each entrant licenses and grants the Promoter, the Business and the Promoter and Business’ affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display their entry (which shall include Content) for any purpose, including but not limited to future promotional, marketing or publicity purposes, in any media, without compensation, restriction on use, attribution or liability.

36. Entrants consent to the Promoter and the Business using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for a reasonable period without remuneration for the purpose of promoting the Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter or the Business in connection with the Promotion.

37. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the Australian Securities and Investments Commission Act 2001 (Cth) or similar consumer protection laws in the States and Territories of Australia (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and the Business (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.

38. Except or any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and the Business (including their respective officers, employees and agents) are not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of:

a. any technical difficulties or equipment malfunction (whether or not under the Promoter’s or Business’s control);

b. any theft, unauthorised access or third-party interference;

c. any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter or the Business;

d. any variation in prize value to that stated in these Terms and Conditions;

e. any tax liability incurred by a winner or entrant; or

f. taking of the prize/attendance at the prize event.

39. The laws of Australia apply to this Promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Melbourne, Victoria Australia
