CONSUMER COMPETITION
Terms and Conditions
1. The Promoter
CW Media PTY LTD ACN 606 548 298, ABN 43 913 252 975, 6 Albert Street Preston, VIC 3072, on behalf of the Chemist Warehouse and e-Pharmacy group.
2. Terms of Entry
(a) Competition entries can be made from 00.01am AEST on Thursday 3 October 2024 until 11.59pm AEDT on Wednesday 16 October 2024
(‘Competition Period’) through either of the following Promoter’s websites:

(“Websites”)
(b) Entries received outside the Competition Period will not be eligible or accepted.
(c) Entries that are incomplete, illegible or indecipherable will not be valid and will be deemed void.
(d) Entry is conditional upon spending $20 or more on any Garnier product(s) in one transaction in-store or online at Chemist Warehouse or My
Chemist and entering via the applicable URL (based on where the qualifying purchase is made) by providing the requested personal details and purchase
receipt number for the qualifying purchase.
(e) The Promoter takes no responsibility for entries that are lost, stolen, illegible, misdirected or damaged however caused.
(f) Submitting an entry constitutes acceptance of these Terms and Conditions.
(g) Multiple entries by eligible entrants are accepted, subject to entrants holding multiple proofs of purchase with different valid purchase
receipt numbers, subject to the following: a) there is a limit of one (1) entry allowed per person per day during the Competition Period; and b) there
is a maximum of one (1) entry permitted per qualifying transaction.
3. Who May Enter
(a) The Competition is open to Australian permanent residents 18 years of age and over.
(b) The Competition is not open to:
(i) Employees of the Promoter or L’Oreal Pty Ltd;
(ii) Parties to whom the Promoter has contracted work in relation to this Competition;
(iii) Parties who are otherwise directly involved with this Competition; and
(iv) Any immediate family members of any of the above mentioned parties. "Immediate family member" means any of the following: spouse,
ex-spouse, de-facto spouse, child or stepchild (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt,
niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
4. Prize
4 winners will receive 1 x $5,000 AUD VISA Gift Card. This will be facilitated and distributed by L’Oreal Australia Pty Ltd.
Total prize value is $20,000 AUD.

Prize Conditions: Any ancillary costs associated with redeeming a voucher are not included. Any unused balance of a voucher will not be awarded as
cash. Redemption of a voucher is subject to any terms and conditions of the issuer including those specified on the voucher.
Selecting the Winner
(a) The Competition winner will be selected at 3.00pm AEDT on Thursday 17 October 2024.
(b) The Competition winner will be randomly selected using automated online software by the Promoter’s digital team. The draw will be
conducted at 6 Albert Street, Preston VIC 3072.
(c) The first valid entry drawn will win the prize outlined above.
(d) The draw conductor may draw additional reserve entries in case an invalid entry or entrant is drawn.
(e) The Competition winner will be notified by SMS and/or email by 5.00pm AEDT Thursday 17 October 2024. Whilst the Promoter will use its
best endeavours to contact the winner within the abovementioned time, the decision not to award an entrant who cannot be contacted a prize is at the
sole and absolute discretion of the Promoter and can be made at any time after the Competition winner has been selected.
(f) A person purporting to be a prize winner may be required to provide proof of identity and to verify any other eligibility requirements.
(g) Subject to the unclaimed prize draw clause (outlined below), if for any reason the winner does not take/redeem the prize (or an element
of the prize) within a reasonable time at/by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
5. Publication of winner’s details
(a) The Promoter will publish the Competition winners details (last name, first initial and postcode) on the Websites (defined above) on
Thursday 17 October 2024 and that information shall remain posted there for at least 28 days.
6. Unclaimed Prizes:
If within one (1) month after the draw, the prize has not been claimed by the winner, the Promoter will conduct a re draw for the prize on Monday 18
November 2024 at 10.00am AEST at 6 Albert Street, Preston VIC, 3072. The redraw winner will be published on the Websites (defined above) and will be
contacted in writing on Monday 18 November 2024 by 5.00pm AEST.
Privacy and use of personal information
(a) In accordance with the Privacy Act (1988) (Cth), the Promoter notifies entrants that entry to the Competition involves the collection of
personal information about entrants, such as their name, address, mobile phone number and email address. This is collected for the purpose of
establishing eligibility, carrying out the Competition and notifying the winner. If the information is not provided, the entrant may not participate
in the Competition. Entrants’ personal information may be disclosed to State Lottery agencies and winner’s name published as required under the
relevant lottery legislation.
(b) Each entrant consents to the Promoter using their personal information provided in connection with their entry, for the purposes of
undertaking any investigation in connection with verifying the identity of an entry or any suspected tampering.
(c) Each entrant consents to the Promoter and its authorised licensees using the entrant’s name, likeness, image and/or photograph and voice
in the event that they are the winner, in any media for an unlimited period of time, without remuneration or compensation, for the purposes of
promoting the outcome of this Competition.
(d) Entrants can request access to the personal information the Promoter holds about them by contacting the Promoter at the address stated in
the Promoter section of these conditions. The Promoter's Privacy Policy, located at https://www.chemistwarehouse.com.au/aboutus/privacy, contains information about : (a) how entrants can seek access to the personal information the
Promoter holds about them and seek the correction of such information; and (b) how entrants can complain about a privacy breach and how the Promoter
will deal with such a complaint.
7. Discontinuation of the Competition or Disqualification of an Entrant
(a) Subject to State or Territory legislation, if for any reason any aspect of this Competition is not capable of running as planned
including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any
cause beyond the control of the Promoter, the Promoter reserves the right to discontinue the Competition at any time and in its sole and absolute
discretion may cancel, terminate or modify the Competition and invalidate any affected entries, or suspend or modify a prize without the need to
provide compensation to entrants or attempted entrants.
(b) The Promoter reserves the right, in its sole and absolute discretion to verify the validity of entries and entrants and to disqualify any
entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with (or whom the Promoter reasonably suspects
has tampered with) the entry process or the winner selection process or who has otherwise been misleading or fraudulent in the course of the
Competition.
8. Exclusion of Liability
(a) The Promoter makes no representation nor provides any warranties as to the quality or suitability of the prizes offered.
(b) The Promoter is not responsible for any losses associated with any change to the value of any prizes.
(c) The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special
or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any
person's negligence or wilful misconduct) in connection with this Competition or accepting or using any prize (or recommendation). For the sake of
clarity, this clause shall not apply where the Promoter has contributed to or caused such loss, expense, damage, personal injury or death and shall
not apply to any liability which cannot be excluded by law (in each case the Promoter’s liability is limited to the minimum allowable by law).
(d) The Promoter’s decision on all matters relating to this Competition will be final.
(e) The Promoter is under no obligation to provide reasons for any of its decisions.
(f) The Promoter is under no obligation to engage in any form of correspondence whatsoever with entrants or purported entrants, or their
representatives, in any matters relating to the Competition.
(g) Entrants must keep their proof of purchase specified in the Terms of Entry section for each entry as proof of purchase ("Proof of
Purchase"). If an entrant fails to produce the Proof of Purchase for a specific entry or each entry, as and when requested by the Promoter, the
Promoter has the right to invalidate the entrant's respective entry/entries for which Proof of Purchase cannot be provided and/or all entries
submitted by that entrant and/or forfeit the entrant's right to a prize. Purchase receipt(s) must clearly specify: (a) the store of purchase as an
eligible store; (b) the required product/s or service/s to be purchased for entry; and (c) that the purchase was made during the Competition Period
and prior to entry.
(h) No part of a prize is exchangeable, redeemable for cash or any other prize or transferable, unless otherwise specified in writing by the
Promoter.
(i) If a prize (or portion of a prize) is unavailable the Promoter reserves the right to substitute the prize (or that portion of the
prize) to a prize of equal or greater value and specification, subject to any written directions of a regulatory authority.
(j) Each prize will be awarded to the person named in the entry and any entry that is made on behalf of an entrant or by a third party will
be invalid. If there is a dispute as to the identity of an entrant or winner, the Promoter reserves the right, in its sole discretion, to determine
the identity of the entrant or winner.
(k) For the purposes of public statements and advertisements, the Promoter may only publish the winner's surname, initial and
State/Territory or postcode of residence.
(l) It is a condition of accepting the prize that a winner and their travel companion (if applicable) may be required to sign a legal
release as determined by the Promoter in its absolute discretion, prior to receiving a prize.
(m) If a prize is provided to the Promoter by a third party, the prize is subject to the terms and conditions of the third party prize
supplier. The terms and conditions which apply to the prize at the time it is issued to the winner will prevail over these Conditions of Entry in the
event of any inconsistency. To the extent permitted by law the Promoter accepts no responsibility or liability for any delay or failure by the third
party to deliver the prize, any delay or failure relating to the prize itself or failure by the third party to meet any of its obligations in these
Conditions of Entry or otherwise.
(n) Any guarantee or warranty given is in addition to any relevant statutory guarantees and warranties and nothing in these Conditions of
Entry restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the
Competition and Consumer Act 2010 (Cth).
(o) L'Oreal is the prize supplier of this Competition only and takes no responsibility and accepts no liability for the conduct of the
Competition. Once the competition is drawn and the winner contacted, all further communication and prize facilitation is conducted by L’Oreal.
