2. Terms of Entry
(a) Competition entries can be made from 00.01am AEST on Thursday 3 October 2024 until 11.59pm AEST on Wednesday 30 October 2024
(‘Competition Period’) through the Promoter’s website.
(b) Entries received outside the Competition Period will not be eligible or accepted.
(c) Entries that are incomplete, illegible or indecipherable will not be valid and will be deemed void.
(d) Entry is conditional upon purchasing any item from the Wanderlust range in-store or online at Chemist Warehouse and entering via the
above URL. You must be able to provide proof of such transactions in the form of a valid purchase receipt number.
(e) The Promoter takes no responsibility for entries that are lost, stolen, illegible, misdirected or damaged however caused.
(f) The Promoter is not responsible if your mobile device/desktop is not sufficiently capable for the purpose of submitting an entry.
(g) Submitting an entry constitutes acceptance of these terms and conditions.
(h) Multiple entries by eligible entrants are accepted, subject to entrants holding multiple proofs of purchase with different valid purchase
receipt numbers, subject to the following conditions:
(i) only one entry allowed per day during the Competition Period; and
3. Who May Enter
(a) The Competition is open to Australian permanent residents over 18 years of age.
(b) The Competition is not open to:
(i) Employees of the Promoter.
(ii) Parties to whom the Promoter has contracted work in relation to this Competition;
(iii) Parties who are otherwise directly involved with this Competition; and
(iv) Any immediate family members or any of the above mentioned parties.
4. Prize
All inclusive trip for 2 to Wanderlust’s most acclaimed boutique retreat in Playa del Carmen Mexico.
The Major Prize consists of;
· 2x international economy flights to Mexico from any major Australian airport
· 4 nights accommodation in Playa Del Carmen, Mexico at a 5-star accommodation at the retreat: Palmaia - The House of Aia
· 2x tickets to Wanderlust Palmaia retreat (inclusive of any meals eaten at the retreat)
· $1000 AUD spending money
5. Prize conditions:
a. Major Prize winner must be available to travel to Playa Del Carmen, Mexico between December 3 and December 9, 2024.
b. Additional spending money, additional meals, taxes(excluding airline and airport taxes), insurance, passports, visas, vaccinations, transport
to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included.
Total prize value: $15,000 AUD.
6. Selecting the Winner
a. The Competition winners will be selected by 3.00pm on Thursday 31 October 2024.
b. The Competition winners will be randomly selected by the digital team using random number generator software. The Competition will be drawn at
6 Albert Street, Preston VIC 3072 at 3:00pm.
c. The Competition winners will be notified by phone call and email by 5.00pm Thursday 31 October 2024. Whilst the Promoter will use its best
endeavours to contact the winner within one month, the decision not to award an entrant who cannot be contacted a prize is at the sole and absolute
discretion of the Promoter.
d. If within 14 days after the determination of the winners of the lottery, a prize (other than a prize consisting of perishable goods) has not
been claimed by the winners, the promoter must take all reasonable steps to deliver the prize to the prize winners.
e. If the prize is unclaimed, the Promoter will re draw on Thursday 14 November 2024 at 10.00am at 6 Albert Street, Preston VIC, 3072 and
publish these details on the below sites on Thursday 14 November 2024 by 5.00pm. The re drawn winners will be contacted in writing on Thursday 14
November 2024.
f. A person purporting to be the prize winners may be required to provide proof of identity and to verify any other eligibility requirements.
g. Subject to the unclaimed prize draw clause, if for any reason a winner does not take/redeem the prize (or an element of the prize) by November
22nd, then the prize (or that element of the prize) will be forfeited.
7. Publication of winner’s details
The Promoter will publish the major Competition winners on the following websites on Thursday 31 October and that information shall remain posted
there for at least 28 days.
Privacy and use of personal information
(a) In accordance with the Privacy Act (1988) (Cth), the Promoter notifies entrants that entry to the Competition involves the collection of
personal information about entrants, such as their name, address, mobile phone number and email address. This is collected for the purpose of
establishing eligibility, carrying out the Competition and notifying the winner. If the information is not provided, the entrant may not participate
in the Competition. Entrants’ personal information may be disclosed to State Lottery agencies and winner’ name published as required under the
relevant lottery legislation.
(b) Each entrant consents to the Promoter using their personal information provided in connection with their entry, for the purposes of
undertaking any investigation in connection with verifying the identity of an entry or any suspected tampering.
(c) Each entrant consents to the Promoter and its authorised licensees using the entrant’s name, likeness, image and/or photograph and voice
in the event that they are the winner, in any media for an unlimited period of time, without remuneration or compensation, for the purposes of
promoting the outcome of this Competition.
8. Discontinuation of the Competition or Disqualification of an Entrant
(a) Subject to State legislation; The Promoter reserves the right to discontinue the Competition at any time and in its sole and absolute
discretion may cancel, terminate or modify the Competition without the need to provide compensation to entrants or attempted entrants.
(b) The Promoter reserves the right, in its sole and absolute discretion to verify the validity of entries and entrants and to disqualify any
entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with (or whom the Promoter reasonably suspects
has tampered with) the entry process or the winner selection process or who has otherwise been misleading or fraudulent in the course of the
Competition.
(c) Cancellation clause: If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of
computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control
of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Promotion and invalidate any affected entries, or
suspend or modify a prize, subject to State or Territory regulation.
(d) The winner and their companion are responsible for ensuring that they have valid passports, and any requisite visas, vaccinations, and
travel documentation. The winner and their companion must depart from and return to the same departure point and travel together. Frequent flyer
points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers. The winner
may be required to present their credit card at time of accommodation check in.
(e) Subject to the terms and conditions of the participating prize provider(s), if for any reason the winner does not, once the prize has
been booked, take the prize (or an element of the prize) at the time stipulated, then the prize (or that element of the prize) will be forfeited and
will not be redeemable for cash.
(f) In the event of war, terrorism, state of emergency, pandemic or any other kind of disaster, the Promoter reserves the right to cancel,
terminate, modify or suspend the Competition or suspend, substitute or modify a prize, subject to any written directions from a relevant regulatory
authority.
9. Exclusion of Liability
(a) The Promoter makes no representation nor provides any warranties as to the quality or suitability of the prizes offered.
(b) The Promoter is not responsible for any losses associated with any change to the value of any prizes.
(c) To the extent permitted by law, the Promoter is not liable for any loss suffered or sustained by any person or to personal property
including, but not limited to, consequential (including economic) loss by reason of any act or omission, deliberate or negligent, by the Promoter or
its servants or agents, in connection with the arrangements for the supply of any goods or services by any person to the prize winner and where
applicable, to any person or persons accompanying the prize winner.
(d) The Promoter accepts no responsibility for any tax implications arising from a winner receiving a cash prize and the entrant must seek
their own independent financial advice. If, for GST purposes, this promotion results in any supply being made for non-monetary consideration,
entrants must follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of
equal GST inclusive market values.
(e) The Promoter’s decision on all matters relating to this Competition will be final.
(f) The Promoter is under no obligation to provide reasons for any of its decisions.
(g) The Promoter is under no obligation to engage in any form of correspondence whatsoever with entrants or purported entrants, or their
representatives, in any matters relating to the Competition. |
