17. If a prize is provided to the Promoter by a third party, the prize is subject to the terms and conditions of the third party prize supplier.
The terms and conditions which apply to the prize at the time it is issued to the winner will prevail over these Conditions of Entry in the event of

subject to State or Territory regulation.
20. The Promoter reserves the right, at any time, to validate and check the authenticity of entries and entrant's details (including an entrant's
identity, age and place of residence). In the event that a winner cannot provide suitable proof as required by the Promoter to validate their entry,
the winner will forfeit the prize in whole and no substitute will be offered. Incomplete, indecipherable, inaudible, incorrect and illegible entries,
as applicable, will at the Promoter's discretion be deemed invalid and not eligible to win. Entries containing offensive or defamatory comments, or
which breach any law or infringe any third party rights, including intellectual property rights, are not eligible to win. The use of any automated
entry software or any other mechanical or electronic means that allows an individual to automatically enter repeatedly is prohibited and may render
all entries submitted by that individual invalid.
21. The Promoter reserves the right to disqualify entries in the event of non-compliance with these Conditions of Entry. In the event that there is
a dispute concerning the conduct of the Promotion or claiming a prize, the Promoter will resolve the dispute in direct consultation with the entrant.
If the dispute cannot be resolved the Promoter’s decision will be final.
22. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or
consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any
person's negligence or wilful misconduct) in connection with this Promotion or accepting or using any prize (or recommendation). For the sake of
clarity, this clause shall not apply where the Promoter has contributed to or caused such loss, expense, damage, personal injury or death and shall
not apply to any liability which cannot be excluded by law (in each case the Promoter’s liability is limited to the minimum allowable by law).
23. The winner(s) will participate in and co-operate as required with all reasonable marketing and editorial activities relating to the Promotion,
including (but not limited to) being recorded, photographed, filmed or interviewed and acknowledges that the Promoter may use any such marketing and
editorial material without further reference or compensation to them.
24. The Promoter accepts no responsibility for any tax implications and the entrant must seek their own independent financial advice in regards to
the tax implications relating to the prize or acceptance of the prize.
25. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of these rights.
26. Authorised under: ACT Permit No. TP 24/01851, NSW Authority No. TP/3533 and SA Permit No. T24/1394. |

I think this was for a trip to Paris? And yep the person they awarded it to is notorious for sending in “creative” entries and being awarded prizes
for those. |

Perhaps the person who made the post should answer the question otherwise speculation continues without any facts being provided. I fully support
mailed in creative entries being totally discarded and not considered when it was an online only method of entry. It's outrageous for a promoter to
accept them and then when challenged pretend they had the best 25wol or whatever excuse they come up with.
Coming from a work history of decades of insurance claims and the fiction and rewriting of history you see in those, I'm a stickler for the confirmed
facts and not a fan of unsupported comments.
I await a fuller explanation from the original poster of their comment before I purchase the product to enter.

kenoath, it may be difficult for the original poster to do that, as according to my search the comp closed well over 2 years ago, so won't be in the
lottos history perhaps? I could be wrong and others may be able to find it.
I personally didn't enter as the purchase required was quite expensive (in my view), and those entering were more than rightly disappointed at the
fact that the winner had submitted a creative support piece (known for doing this) for an online entry form...those entering may be able to give you
more details, as some had contacted the Promoter, via various methods, specially on Facebook and it did get quite ugly.. BUT allegedly, the prize was
still awarded to that person! Frankly, after that debacle, and how badly it was handled, I wouldn't be entering, even if I did usually drink it.
**Editing to say this was the competition via google search in Bottlemart.. the t' & c's link wouldn't open as I guess after all this time it
wasn't relevant...

No speculation about it
It happened
As did a lot of other things
It was several years ago that it happened so I doubt the OP would have kept a record of it after all this time, (and nor should they have to)
The promoter even blocked people on Facebook at the time for pointing out it was a purchase and WOL only competition but won with a 'creative' entry

It’s not speculation, it’s fact sadly. Was a trip to Paris and there was an almighty outrage! And it was the notorious entrant who won. I’m going to
guess 2017 or so - but can’t be certain of when. |

Agree, especially since it's quite an expensive purchase.
From my memory it was an elaborate diorama in a suitcase situation that was the cause of the drama? The backlash was huge. Hopefully this promoter
learnt their lesson not to be roped into that kind of debacle again.
But it's also a timely reminder (especially for the newbies but also everyone) that if you are entering big value competitions and entering as per
Ts&Cs, don't assume promoters are also going to stick to their end of the bargain. It's always worth a quick email to them beforehand mentioning
these past events and seeking reassurance the Ts&Cs will be adhered to. Too many times we have seen these underhanded methods wow these promoters
into giving them the prize, and then the disappointment and outrage that follows. Sometimes these competitions also require an expensive purchase,
which is hardly fair when you have made said purchase in good faith, followed the Ts&Cs, and then it seems you never had a chance. It's usually
high value/holiday comps with a WOL component, but draw comps don't escape either - the usual suspects will give anything a go if they think they can
get one "under the radar".
The lovely lottoer itspossible is a big advocate for this, and always posts the replies received from the promoters on the comps that she contacts. We
just can't always rely on her to do this though, as she doesn't enter and make contact on every single comp.
I'd encourage everyone to take the initiative to send those emails to the promoters - it's the only way to ensure it's an even playing field and the
winner is selected from the entry method per the Ts&Cs only.

Thanks gailg and Beagle - a lovely lottoer brought my attention to this thread, as I had "red x'd" it, due to not entering - this meant that I have
not contacted the promoter regarding creative entries.
Hopefully those who have entered, have taken precautions to ensure the promoters stick to drawing the winner from those who entered via the provided
online entry form only.
Good luck to all. |
