How it works
Simply present your Qantas Frequent Flyer card during purchase in-store, or alternatively, add your Qantas Frequent Flyer Number during checkout when
you buy online and earn 1 Qantas Point for every $1 spent. You may also use Qantas Points to pay for purchases at Forty Winks, simply choose Qantas
Points as a payment option to cover some or all of your purchase
1. Information on how to enter and prizes form part of these conditions of entry. Entry into the promotion is deemed acceptance of these conditions of
entry. Entry is made in-store at Forty Winks entrants must retain proof of purchase.
2. The Promoter(s) are Forty Winks PTY LTD ABN 38 059 512 640 and Forty Winks Franchising PTY LTD of 88-90 Peters Ave, Mulgrave VIC 3170.
3. Entry is open to all permanent Australian residents over the age of 18 years who fulfill the entry requirements. Employees and their immediate
families of Forty Winks and printers, suppliers, providers and agencies associated with this promotion are ineligible. The promotion commences 9:00 AM
AEDT Monday, 4 November, 2024 and concludes at 5:00 PM AEDT on Sunday, 1 December, 2024.
4. To enter the promotion, participants must:
1) Purchase any product in-store or online from Forty Winks Australia and earn Qantas Points on your purchase between 4th November at 9.00am
and 1st December 2024 at 5:00pm AEDT.
2) Entrants must retain their proof of purchase to be in the draw;
3) Entrants must be Qantas Frequent Flyer member to be eligible; and
4) Sign up to the Forty Winks database and marketing messaging.
Entries will be forfeited if the order is cancelled, not paid for in full or returned.
5. Prize: 1 winner will win 1 million Qantas Points.
6. Only one prize will be awarded. The prize draw will occur at 1:00 PM AEDT 9 December 2024 and the winner will be announced via social media, and
email within 7 days of the draw.
7. Draw will be conducted in the presence of an independent scrutineer at TPAL at Level 2, 11 York Street, Sydney, New South Wales, 2000.
8. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of
residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry
process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not
constitute a waiver of those rights.
9. The winner will be notified via email within 7 days of the competition prize draw. The Promoter's decision is final, and no correspondence will be
entered into.
10. The winner will be announced within 7 days of the draw and will be contacted directly by email by the store they purchased from. The winner will
be published online at Forty Winks (https://www.fortywinks.com.au/qantas-points/) within 7 days of the draw. By participating in this promotion, the prize winner consents to their
information being shared and/or displayed on public channels, without notice.
11. The total prize pool of the competition is 1 million Qantas Points (notional value of total prize is AUD $78,500)
12. The first valid entry drawn will receive one million (1,000,000) Qantas Points to be awarded to their Qantas Frequent Flyer account within 45 days
of the winner being notified
13. The notional value of the prize is based on a sample of the Qantas Frequent Flyer Rewards that could be obtained by redeeming through the Qantas
Frequent Flyer program (as fully defined in the terms and conditions of the program available at qantas.com/terms). For example, 8,000 Qantas Points
could be redeemed for a one way Economy Classic Flight Reward from Melbourne to Sydney plus AU$53 in applicable taxes, fees and carrier charges,
accurate as at 27 September 2024. The dollar fare for an equivalent flex economy commercial flight totals AU$681 including taxes, fees and carrier
charges.
14. The estimate of the maximum notional value of each prize is provided for information purposes only. The maximum notional value of each prize will
vary depending on whether and how it is redeemed by a winner through the Qantas Frequent Flyer program. The Promoters accept no responsibility for any
variation in the maximum notional value of each prize.
15. Each prize is awarded and must be redeemed, in accordance with and subject to the Terms and Conditions of the Qantas Frequent Flyer program
(Qantas.com/terms), and any other terms and conditions disclosed at the time of redemption.
16. Prizes are not transferable or exchangeable and will only be awarded as a cheque or direct deposit, unless otherwise specified.
17. The winner may be required to take part in related publicity, including participation in ad- hoc media or social media activity with print and
broadcast media with reasonable advance notice.
18. Entrants consent to the Promoter and Qantas Airways Limited using their name, likeness, image and/or voice in the event they are a winner
(including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this
promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter as relevant to the
competition.
19. By entering the competition, the winner agrees that their entry can be posted on the Forty Winks website, on its Twitter, Instagram and Facebook
pages, and related Forty Winks online/social media platforms. By entering the competition, the winner agrees that their entry or images may be used by
Forty Winks as they wish without prior notice to the winner.
20. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the
reasonable control of the Promoter or Qantas Airways Limited, including but not limited to technical difficulties, unauthorised intervention or fraud,
the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any
written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
21. Any cost associated with accessing the promotional website/associated services is the entrant's responsibility and is dependent on the Internet
service provider used.
22. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as
provided under the Competition and Consumer Act, as well as any other implied warranties under the Australian Consumer Law or similar consumer
protection laws in the State and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded,
including the Non- Excludable Guarantees, the Promoter and Qantas Airways Limited (including its respective officers, employees and agents) excludes
all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect,
special or consequential, arising in any way out of the promotion.
23. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and Qantas Airways Limited
(including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal
injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any
technical difficulties or equipment malfunction (whether or not under the Promoter or Qantas Airways Limited’s control); (b) any theft, unauthorised
access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their
receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these
Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
24. The Promoter(s) collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third
parties, including but not limited to Qantas Airways Limited, agents, contractors, service providers, prize suppliers and, as required, to Australian
regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use
the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the
entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the
Promoter.
25. In the event the prize is unclaimed, an unclaimed prize draw will occur in the presence of an independent scrutineer at the same time and location
as the original draw on 10 March 2025. The unclaimed prize winner will be notified via email and published at https://www.fortywinks.com.au/qantas-points/ within 7 days of the unclaimed prize draw date.
